About modification and amendments in some orders of the Ministry of national economy of the Republic of Kazakhstan

I ORDER:

1. Approve the list of some orders of the Ministry of national economy of the Republic of Kazakhstan to which changes and additions, according to appendix to this order are made.

2. To provide to committee on cases of construction, housing and communal services and management of land resources of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in printing and electronic type on official publication in periodic printing editions and in information system of law of Ad_let, and also in the Republican center of legal information for entering into reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective since March 1, 2016 and is subject to official publication.

to the Order of the acting minister of national economy of the Republic of Kazakhstan of January 21, 2016 No. 24

The list of orders of the Ministry of national economy of the Republic of Kazakhstan to which changes and additions are made

1. In the order of the acting minister of national economy of the Republic of Kazakhstan of March 27, 2015 No. 270 "About approval of the standard of the state service "Provision of the Parcel of Land for Asset Construction within the Settlement" (registered in the Register of state registration of regulatory legal acts for No. 11051, published in information system of law of Ad_let of June 4, 2015) to make the following changes:

in the standard of the state service "Provision of the Parcel of Land for Asset Construction within the Settlement" approved by the specified order:

1) of Item 3 to state the subitem in the following edition:

"1) Non-commercial joint-stock company "The Government for Citizens State Corporation (Further — the State Corporation);";

state item 4 in the following edition:

"4. Term of rendering the state service:

1) from the date of delivery of document package in the State corporation and on the portal:

1 - stage: production of the act of the choice of the parcel of land, with the positive conclusions of the approving bodies and the organizations - 28 working days;

2 - stage: in case of approval of the final act of the choice and payment for services of land and cadastral works as uslugopoluchatel - decision about provision of the right of land use to the parcel of land - 22 working days;

refusal in consideration of the application by provision of incomplete document package - 2 working days;

refusal in rendering the state service in cases and on the bases, stipulated in Item 10 these standards of the state service - 14 working days.

2) the most allowed time of expectation for delivery of document package - 15 (fifteen) minutes;

3) the most allowed time of servicing - 15 (fifteen) minutes.

In case of the appeal to the State corporation day of documents acceptance does not enter rendering the state service in time.";

"Payment for production of the land cadastral plan on the parcel of land is performed in cash or non-cash form through banks of the second level on the settlement account of the relevant branch of the State corporation, or in cash desks of the building of branch of the State corporation which issue the payment document (receipt) confirming the size and payment date in form according to appendix 3 to this standard of the state service.";

in the State corporation:

1 - stage:

2) scheme of placement of the parcel of land;

3) the identity document (it is required for identification of the personality);

approval of the final act of the choice and payment for services of land and cadastral works as the applicant are performed within three working days. Effective period uncoordinated the applicant of the act of the choice constitutes ten working days. After the specified term the State corporation returns in the structural division of the relevant local executive body performing functions in the field of architecture and town planning for cancellation of the uncoordinated act of the choice with the notification of uslugopoluchatel;

2 - stage:

1) the final approved act of the choice;

2) the payment document for services of land and cadastral works.

The applicant after receipt of the notification within 3 (three) working days signs the agreement of temporary land use in duplicate. Effective period of the agreement of temporary land use unsigned by the applicant constitutes seven working days.

After the specified term the State corporation returns in the structural division of local executive bodies of area, city of republican value, the capital, area, city of regional value performing functions in the field of land relations for cancellation of the decision on provision of the parcel of land with the notification of uslugopoluchatel.

The service provider and the employee of the State corporation receives the consent of uslugopoluchatel to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.

In case of documents acceptance the employee of the State corporation reproduces electronic copies of documents then returns originals to uslugopoluchatel.

On the portal:

1 - stage:

1) the statement in electronic form in form according to appendix 1 to this standard of the state service;

2) electronic copy of the scheme of placement of the parcel of land;

approval of the final act of the choice and payment for services of land and cadastral works as the applicant are performed within three working days.

Effective period uncoordinated the applicant of the act of the choice constitutes ten working days. After the specified term the State corporation returns in the structural division of the relevant local executive body performing functions in the field of architecture and town planning for cancellation of the uncoordinated act of the choice with the notification of uslugopoluchatel;

2 - stage:

1) the final approved act of the choice in electronic form;

2) the payment document for services of land and cadastral works.

The applicant after receipt of the notification within 3 (three) working days signs the agreement of temporary land use.

Effective period of the agreement of temporary land use unsigned by the applicant constitutes seven working days.

The agreement of temporary land use signed by the applicant goes to the structural division of local executive bodies of area, city of republican value, the capital, area, city of regional value performing functions in the field of land relations for registration and issue to uslugopoluchatel through the State corporation.

Data on identity documents, on state registration (re-registration) of the legal entity, the service provider and the employee of the State corporation receive from the corresponding state information systems through lock of "the electronic government".

In case of documents acceptance through the State corporation the receipt on acceptance of the relevant documents is issued to uslugopoluchatel.

Issue of ready documents through the State corporation is performed based on the receipt on acceptance of the relevant documents, in case of presentation of the identity certificate (or his representative under the notarized power of attorney).

In case of the expiration of approval of the final act of the choice of the parcel of land the State corporation provides storage of result within three working days. On the expiration of three working days the State corporation sends documents to the service provider for cancellation and notifies uslugopoluchatel on the termination of the state service.

In case of the expiration of the conclusion of the paid provisional agreement (short-term, long-term) in the specified time the State corporation returns land use in the structural division of local executive bodies of area, city of republican value, the capital, area, city of regional value performing functions in the field of land relations for cancellation of the unsigned agreement of temporary land use with the notification of uslugopoluchatel on the termination of the state service.

In case of the address through the portal to uslugopoluchatel the status about acceptance of request for rendering the state service, and also the notification with indication of date and time (if issue on paper, it is necessary to specify the place of obtaining) receipts of result of the state service goes to "personal account".

On the portal acceptance of electronic request is performed in "personal account" of uslugopoluchatel".;

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within 15 (fifteen) working days from the date of its registration.";

"4. Other requirements taking into account features of rendering the state service including rendered electronically and through the State corporation";

Uslugopoluchatelyam of the functions of organism having violation of health with permanent frustration limiting its life activity, in case of need documents acceptance, for rendering the state service, is made by the employee of the State corporation with departure at the place of residence by means of the address through Single contact center 1414, 8 800 080 7777.";
