About approval of Sanitary regulations for organizations of early education
Based on provisions of the Law No. 10-XVI of February 3, 2009 on the state supervision of public health (The official monitor of the Republic of Moldova, 2009, No. 67, the Art. 183), with subsequent changes and amendments, DECIDES: the Government
1. Approve Sanitary regulations for organizations of early education it (is applied).
2. To the Ministry of Public Education together with bodies of local public authority of the first and second level, within six months to estimate costs for realization of provisions of the approved Regulations and to develop the National plan of gradual implementation of sanitary standards in organizations of early education.
3. The expenses connected with realization of provisions of the specified Regulations will become covered at the expense of means of the government budget, within transfers in local budgets for financing of organizations of early education, and also from other sources, according to the current legislation.
4. Recommend to local authorities of public management to provide implementation of these Regulations in development and upgrade of organizations of early education.
5. Provisions of the approved Regulations will be enacted since January 1, 2018 according to the National plan of gradual implementation of sanitary standards.
6. To impose control over the implementation of this resolution on the Ministry of Health.

1. The purpose of Sanitary regulations for organizations of early education (further – Regulations) – establishment of some health requirements for operation and content of organizations of early education, irrespective of the type of property and the organizational legal form directed to protection and strengthening of health, physical and nevropsikhichesky development of children, prevention of emergence of diseases in children in the course of educational and educational activities.
2. These Regulations include obligatory health regulations for physical persons and legal entities, with obligations in designing, construction, reconstruction, updating, operation and maintenance of organizations of early education, and also the organizations exercising the state supervision in the field of public health.
3. These Regulations represent obligatory standard rates of sanitary management and functioning of organizations of early education and are effective according to the existing legislation and requirements of regulations in construction area.
4. These Regulations establish health requirements to:
a) to placement of organizations of early education;
b) to arrangement and maintenance of the territory;
c) to equipping and content of rooms;
d) to natural and artificial lighting of rooms;
e) to heating and ventilation of rooms;
f) to water supply and sewerage;
g) to prevention of diseases of children;
h) organizations of food;
i) to personal hygiene of children of prepreschool and preschool age;
j) to hygiene of personnel;
k) to obligations of medical personnel.
5. The regulations contain sanitary standards about conditions of keeping and education of the children directed to preserving and strengthening of their health.
6. The buildings which are in blueprint stages and constructions shall meet these standards before commissioning.
7. Organizations of early education are subject to sanitary authorization.

Any change in activities of organizations of early education, conditions of training and care of children are coordinated by Service of the state supervision of public health.
8. The basic concepts used in these Regulations have the following values:
the resource center for inclusive education – support service of beneficiaries with special educational needs for providing the organization of special events for development/rehabilitation of children;
the manager – the employee of any economic agent (legal entity or physical person) or any public body or organization which fundamental service duties are obtaining storage and issue of the goods which are in property, management and use or ownership – even temporarily mentioned employers, irrespective of method of acquisition and the location of goods (as necessary, can be: material values, money or other values);
organization of early education – educational institution in which educational process and care of children aged to 6 (7) years, for the purpose of development of physical, cognitive, emotional and social skills is realized. The organization of early training is performed in groups or the mixed groups, as a rule, of the children created by age criterion, with use of qualified pedagogical personnel and the corresponding infrastructure;
pathogenic geohelminths – the worms parasitizing at the person, and the soil contaminated by viable eggs of helminths has special role in spread of diseases;
pathogenic microorganisms – microorganisms (bacteria, viruses, rickettsiae, parasites, mushrooms) and other microorganisms, such as prions which can cause disease of people and animals;
toxic chemicals – chemical element and its connections which can influence human health by means of direct or indirect contact in case of inhalation or proglatyvaniye and for which threshold limit values are established;
biodistruktivny means – the active agents and medicines containing one or several active agents, in shape in which they are brought to the user intended for destruction and prevention of harmful organisms or the prevention of their action and also on fight against them in any manner by means of the chemical or biological actions used for disinfection.
9. Organizations of early education render services in training and leaving of children up to 7 years and specialized services for children with special education requirements. In case of transfer of children in organization the possibility of the organization of the day regimen corresponding to anatomo-physiological features of each age group and/or depending on type of limited opportunities shall be considered.
10. The number of children in groups of organizations of early education is determined proceeding from group rooms, the game hall and the dining room for children under 3 years (prepreschool children) whose areas shall be at least 2,5 of sq.m on 1 child and for groups with children from 3 to 7 years (preschool children) – at least 2,0 of sq.m on one child who is actually in group. For organizations of early education where the game hall is combined with bedroom, the area for one child increases by 1,0 of sq.m for all age groupes.
11. Number of children in groups: prepreschool children – to 15 children, preschool children – to 20 children.
12. The number of children with limited opportunities in prepreschool and preschool groups shall be 1-2 children in group.
13. Responsibility for respect for sanitary standards of these Regulations is conferred on the manager and the director of organization. Non-compliance with these sanitary Regulations attracts the administrative responsibility according to the current legislation.
14. Organizations of early education are placed in the intra quarter territories of residential residential districts, outside sanitary protection zones of the companies, constructions or other objects and the contaminating sources and at the distance providing observance of maximum permissible levels of pollution of atmospheric air proceeding from standard rates of insolation and natural lighting of rooms and playgrounds.
15. The land area shall be well trained, without waste, the soil shall not contain dangerous levels of toxic chemicals or pathogenic microorganisms. Underground waters shall be at least 0,5-1 m lower than the level of building foundation of organization of early education. It is forbidden to place organizations of early education in areas with risk of landslides and floods.
16. Buildings of organizations of early education can be placed separately or to be attached to residential buildings or buildings of social appointment, including educational institutions, except for buildings of industrial enterprises and those that provide services, with observance of the following conditions:
a) shall be not above the second floor;
b) have the certain fenced site;
c) have different inputs and outputs for children and vehicles;
d) have autonomous water supply, the sewerage, heating;
e) shall be provided audio-and waterproofing of the apartment house, etc.
f) shall be provided with the corresponding ventilation;
g) shall respect the rules concerning designing, the locations, the equipment, isolation of the room, etc. described in Regulations;
h) be without pollution sources;
i) shall not take place in basement and in insanitary rooms.
17. Managers of organizations of early education take measures for ensuring the sanitary standards stated in Items 14 and 15, and in case of impossibility of providing specified in provision, possibilities of placement in residential quarters where maximum permissible levels of air pollution and the soil, insolation and natural lighting of rooms and playgrounds are observed are found.
18. The distance from organization of early education to radio engineering objects and sources of pollution, the located gas stations oil products shall be at least 50 meters.
19. Arrangement of the territory of organizations of early education shall conform to requirements of standard rates in construction Construction Norms and Regulations 01.02-99 "Building designing of kindergartens" (are approved by the Ministry of Regional Development and Construction the order No. 239 of December 21, 1998, with enforcement since January 1, 1991). The territory is planted trees and shrubs calculated on the basis of at least 50% of the area of the territory, free from building. Green plantings are used for separation of playgrounds from each other and departments of group platforms from economic zone.
When gardening the territory landing of the fructifying trees and prickly bushes with poisonous fruits is not allowed.
Green plantings shall not interfere with maintenance of optimum level of insolation and natural lighting of rooms and playgrounds.
20. When designing organizations of early education in the territory the place for carriages, bicycles and the sledge protected by canopy from atmospheric precipitation is provided.
For the prevention of flooding and pollution of playgrounds systems of removal of storm waters are provided.
21. Buildings of organizations of early education are under construction and adapt to needs of children with limited opportunities by the following means: available ways according to the regulations and national standards in construction adapted for needs of persons with limited opportunities; available toilets; available/wide doors and elevators; nonskid tiles and faience and notable reflection for physically disabled people on sight, etc., according to requirements of the state standard rates in construction of WEDNESDAY of Page 01.02-2014 "Designing and construction of buildings and constructions taking into account availability to persons with limited opportunities. General provisions" and NCM of Page 01.06-2014 "General requirements of safety for construction of organizations for the purpose of their use and availability to persons with limited opportunities".
22. Paths and sidewalks in the territory of organization of early education for children with violations of the musculoskeletal device shall not have inclination more than 5 degrees with width of at least 1,6 of m. On turns and through each 6 meters rest areas shall be equipped.
23. Width of paths in the territory of organizations of early education for children with severe violations of sight for the purpose of safe movement of children shall be at least 3 meters, and also on both sides shall be equipped with handrail 90 cm high and level at the level of 15 cm. Near turns, intersections, buildings, columns and other obstacles of path shall have coarse-grained structure of covering or rough surface which serve as sign for reduction in the rate of movement. The surface of paths shall have in profile the arc-shaped form, depending on their width, the middle shall tower over the parties on 5-15 cm.
24. In organizations of early education safety of operation which assumes protection of all children, including with special education requirements is observed, protecting them from risk of damage during regular operation of internal space of buildings, and also the space relating to them, way:
a) preventions of sliding:
use of protective layer so that to prevent fall by sliding, even in rainy weather;
steps and ramps are made so that to avoid sliding, and with notable reflection for persons with limited opportunities on sight;
on the stairs accumulation of water and formation of ice shall be excluded;
b) prevention of falls, spotykaniye:
changes of roughnesses shall be supplied with visible markings;
the edge of step shall be visible, it shall not be similar to the drawing on horizontal surface of steps.
25. In the territory of organizations of early education objects (trees, bushes, columns, etc.) shall not interfere with promotion, walks and games.
26. The territory of organizations of early education shall have system of outside electric lighting. Level of artificial lighting during stay of children in the territory shall be at least 10 lx at ground level in night-time and 40 lx for children with sight violations.
27. Noise levels and pollution of atmospheric air in the territory of organizations of early education shall not exceed the admissible levels established for the territory of the housing estate. Noise levels in the territory of organization of early education are specified in appendix No. 1.
28. For organizations of early education the equipped places for walks of children and exercises shall be provided. For walks the territories of squares, parks and other territories equipped for these purposes can be used.
29. The area of the playground is calculated proceeding from 7,2 of sq.m on one child for children up to 3 years and at least 9,0 of sq.m on one child for children from 3 to 7 years including the sports ground.
30. In the conditions of the existing (dense) urban development use of playgrounds for 2 groups, but taking into account establishment of the separate mode of the organization of walks in the fresh air is allowed.
31. Playgrounds shall be located near group rooms and have convenient exit. The covering of playgrounds shall be grassy, with the stamped soil, without dust, or prepared from the materials which are not making harmful effects on health of the person and shall be divided by paths, with dense surface that ensures safety of children.
32. Playgrounds for groups of the preschool children located in the building of schools shall be separated recreational platforms of pupils.
33. Terraces and shadow canopies are equipped with wooden floors (or other construction materials harmless to health of the person) at distance at least 15 cm from the earth.
34. Terraces for children up to 3 years are allowed to be attached to the building of organization of early education and to use for the organization of walks or dream. The terraces attached to buildings shall not reduce natural lighting of rooms for groups.
35. The equipment of game and sports grounds shall correspond to age of children and to be made of the materials which are not making harmful effects on health with smooth surfaces, without keen edges and corners, of corrosion-proof materials, with easily cleaned surfaces.
36. The materials used for playgrounds shall be environmentally friendly: the tree impregnated with antiseptic agent; metal with anticorrosive covering; stainless steel without welding seam on hill; the waterproof plywood covered with layer of nonskid material; the plastic steady against impact of sunshine (does not become colourless) also to temperature fluctuations (does not form microcracks). Accessories shall be galvanized. All connections shall have plastic caps, sitting of roundabout, swing and swing rocking chairs shall have special nonskid covering.
37. Annually, during the spring period, on playgrounds complete change of sand is carried out. Again delivered sand shall correspond to sanitary and chemical standard rates on parasitological, microbiological, radiological indicators of safety. Sandboxes in the absence of children need to be closed in order to avoid sand pollution (covers, polymeric films or other defensors). In case of detection of causative agents of parasitic diseases perform complete replacement of sand.
38. The territory of organizations of early education shall be kept clean, without garbage, without excrement of animals, to be free from insects and rodents, without open or available wells, tanks, septic holes and other places which can constitute danger to children.
