According to article 6 of the Law of the Republic of Tajikistan "About scientific activities and the state scientific and technical policy" and article 51 of the Law of the Republic of Tajikistan "About regulatory legal acts" the Government of the Republic of Tajikistan decides:

1. Approve Standard regulations on dissertation council, the Procedure for assignment of academic degrees and award of academic statuses (the associate professor, professor), the Procedure for state registration of the defended scientific dissertations (appendices 1, 2 and 3).

2. To provide to public institution "Highest certifying commission in case of the President of the Republic of Tajikistan", the Ministry of Education and Science of the Republic of Tajikistan, the Ministry of Economic Development and Trade of the Republic of Tajikistan, the Ministry of Finance of the Republic of Tajikistan, Academy of Sciences of the Republic of Tajikistan and industry academies realization of these regulatory legal acts.

3. Approve the state samples of diplomas of the doctor of philosophy (PhD), doctors in the specialty, the candidate of science, the doctor of science and certificates of the associate professor and professor (are applied).

4. Consider invalid the orders of the Government of the Republic of Tajikistan of November 2, 2012, No. 625 "About approval of the Procedure for creation and statement of dissertation councils on protection of theses on competition and award of academic degree of the doctor of philosophy (PhD), the doctor in the specialty".

5. To impose control of execution of this resolution on Public institution "Highest certifying commission in case of the President of the Republic of Tajikistan".

Standard regulations on dissertation councils

1. General provisions

1. The standard Regulations on dissertation councils (further - the Provision) are constituted on the basis of the Law of the Republic of Tajikistan "About scientific activities and state policy in science and technology", the Law of the Republic of Tajikistan "About higher education and postgraduate professional education", Regulations on the Highest certifying commission in case of the President of the Republic of Tajikistan and others are normative - legal acts of the Republic of Tajikistan, determine procedure for creation and activities of council on protection of theses (further - Council) for degree of the doctor of philosophy (PhD), the doctor in the specialty, establishes rules of holding meetings of Council, conducting the examination of theses including primary examination, examination by official opponents and the opposing organization, public protection in council on protection of theses; recertifications of owners of the qualification documents on academic degree issued in foreign states; deprivations (recovery) of academic degree.

2. Councils on protection of theses provide unity of requirements to job seekers of academic degrees and to their theses, and also perform the analysis of content and give assessment of the provided theses.

3. Activities of Council are performed according to the legislation of the Republic of Tajikistan, normative legal documents in the field of science and education of the Republic of Tajikistan, and also on the basis of this provision.

4. Consideration of the thesis in Council includes the following stages:

- primary examination;

- examination by official opponents and the opposing organization;

- public defense of a thesis.

5. By results of public defense of a thesis for degree of the doctor of philosophy (PhD), the doctor in Council makes the decision:

- about the petition in the Highest certifying commission in case of the President of the Republic of Tajikistan (further - VAK) about award of academic degree of the doctor of philosophy (PhD), the doctor in the specialty;

- draws the additional conclusions according to theses which protection was carried out in other councils;

- draws the conclusion about results of appeal concerning award of academic degrees regarding violation of procedure for representation to protection and defense of a thesis (further - the appeal);

- carries annually out the analysis of the activities, including contents of the defended dissertations;

- performs other powers established by Procedure about award of academic degrees and assignment of academic statuses (the associate professor, professor).

6. Council bears responsibility for thesis compliance to the declared specialties and branch of science, for quality and objectivity of its examination, for justification of the decisions made according to the thesis according to the requirements established by acts of the legislation of the Republic of Tajikistan and this Provision. Council shall give all necessary explanations at the request of VAK and provide the materials concerning conducting examination and defense of a thesis.

7. In case of violation of procedure for representation and protection of theses, bias of their examination of VAK has the right to suspend or stop activities of council.

8. If as a result of examination of the materials represented to VAK violation by council of requirements for the procedure of protection is revealed, VAK has the right to return the thesis in this council for its de novo review.

9. Council provides to job seekers of academic degrees opportunity to get acquainted with materials, belonging to its thesis, and gives scientific and methodical help on the questions connected with its protection.

10. Members of council carry out the obligations according to Item 155 of this provision.

11. The organization based on which council is created provides possibility of placement by the job seeker of academic degree of the complete text of the thesis on the official site of the organization based on which council is created, on the Internet (further - the website of the organization); will organize holding meetings of council and preparation of certification cases of job seekers of academic degrees; posts on the website of the organization information materials according to Procedure for prisvoveniye of academic degrees and award of academic statuses (the associate professor, professor); provides publicity of work of council.

12. Expense recovery, connected with consideration and defense of a thesis, at the expense of job seekers of academic degree is inadmissible.

13. The expenses connected with participation of official opponents in work of Council are born by the organization based on which council is created.

14. The head of the organization based on which council is created, is responsible for compliance of structure and activities of council to requirements of this provision and other regulatory legal acts regulating the procedure of the state scientific certification of scientific and scientific and pedagogical workers.

15. Government employees defend the dissertations according to the procedure, established by the current legislation. Protection of theses by government employees in councils under the organizations, subordinate (subordinated) to state bodies in which they work and also heads of higher education institutions and scientific organizations and their deputies in councils under the higher education institutions and the scientific organizations run by them is performed with the permission of VAK and under condition if in the Republic of Tajikistan there are no other councils on the corresponding specialties and branches of science.

16. Theses of foreign citizens can be accepted by councils to protection in cases when it is provided by the international agreements recognized by the Republic of Tajikistan or under condition if the thesis was carried out on the basis of the contract signed between the job seeker of academic degree and the organization of the Republic of Tajikistan performing training of scientists of the top skills. In the latter case representation to protection and preliminary expert examination of the thesis of the foreign citizen shall be carried out in this organization. Protection of theses by foreign citizens, is performed according to the same requirements, as for citizens of the Republic of Tajikistan, in case of payment term the job seeker or the directing organization of expenses on carrying out public defense of a thesis and its examinations if other is not established by international treaties (agreements) recognized by the Republic of Tajikistan

2. Procedure for forming of councils

17. Councils are created according to the solution of VAK under the scientific organizations and higher educational institutions (further - the organizations) provided with the highly qualified scientific personnel having considerable scientific achievements and actively performing scientific research in the corresponding directions of science and also training of scientists of the top skills within postgraduate study (graduate military course), doctoral studies, post-doctoral studies.

18. For protection of theses for degree of the doctor of philosophy (PhD), the doctor separate councils on protection of theses for degree of the doctor of philosophy (PhD), the doctor in the specialty in the specialty are created. VAK determines one or several close specialties (no more than five) on one or two allied industries sciences On which council on protection of theses has the right to carry out protection of theses. In cases, stipulated in Item 22 this provision, VAK can permit council to carry out one-time protection of theses on the specialties and branches of science close to its profile.

19. Under the organization of council on protection of theses it is necessary for creation that in the Republic of Tajikistan there were at least 3 doctors of science on this specialty and branch of science, 2 of which shall be the staff employee of this organization working at permanent basis (according to the procedure of exception for separate specialties VAK can resolve 2 doctors of science on the this specialties and branch of science, one of which shall be the staff employee of this organization working at permanent basis). Their compliance to specialty and branch of science is confirmed by diplomas about academic degree and (or) scientific publications.

20. Councils are created for a period of up to five years on one or several (as a rule, no more than five) to close specialties of one or two allied industries of science. After effective period of Council of VAK for the petition of the head of the organization under which Council is created makes the decision on prolongation of its powers with change or without change of structure of Council.

21. Councils the doctors of science and doctors of philosophy (PhD), doctors in the specialty (candidates of science) having the monograph on the corresponding specialty and branch of science or at least three scientific works published for the last five years in the reviewed scientific publications VAK are included. 24. Council doctors of science, candidates of science, doctors of philosophy (PhD), the doctor in the specialty are included. Council shall include:

- at least five specialists with academic degree; at least one doctor of science on each of specialties of the corresponding branch of science on which Council is granted the right to carry out protection of theses;

- at least one specialist in each specialty of the corresponding branch of science working in the organization under which Council is created;

25. 26. The doctor of science who prepared doctors of philosophy (PhD), doctors in the specialty (candidates of science) and being the employee of the organization under which council is created shall be the chairman of the board known for the scientific achievements in the respective area of researches. 27. The member of Presidium of VAK, the member of advisory council of VAK on profile of the created council on protection of theses, and also the head and the deputy manager of state body cannot be the chairman of the board, his deputy and the scientific secretary. The scientific secretary of Council shall be the staff employee of the organization under which Council is created.

28. Change of structure of Council, replacement of the chairman, vice-chairman and scientific secretary of council is performed according to the solution of VAK based on the petition of the organization supported by the academic council under which Council is created. Change of structure of Council, including replacement of the chairman, can be performed also at the initiative of VAK.

29. In case of change of the list of specialties and branches of science on which Council is granted the right to carry out protection of theses and also in case of prolongation of term of office of Council document creation is made in the same order, as during creation of new Council.

30. Council has the right to carry out one-time protection of theses on specialties which are close to its profile. One-time protection are carried out in case of absence in the Republic of Tajikistan of Councils in the specialty and branches of science, declared in the thesis and also in case Council for the declared specialties and branches of science is available, but is created under the organization which is under supervision at the job seeker. Carrying out one-time protection requires permission of VAK. At the same time in the absence of the approved passport of specialty on which one-time protection will be organized Council represents the draft of the passport of specialty to VAK.

31. For carrying out one-time defense of a thesis of Council with the right of casting vote the specialists (no more than two) having academic degree whose scientific profession corresponds to specialty and branch of science on which the thesis is provided to protection in addition are included. For receipt of permission to one-time defense of a thesis the chairman of the board sends to VAK the petition for increase in amount of specialties to members of council and (or) about inclusion in its list of additional members. Candidates for members of council thanks to which the amount of specialties increases and (or) the additional members of council included in its structure on one meeting for carrying out one-time defense of a thesis are recommended by Council in case of adoption of the thesis for protection.

33. Certificates of structure of Council according to appendix 2 and certificates of the main publications of members of council according to appendix 3 are attached to petitions for creation of Council, for prolongation of term of its powers, for change of its structure or for additional introduction in its list of specialists for carrying out one-time defense of a thesis. Certificates of the main publications of these members of council in the specialty on which one-time protection is carried out are attached to the petition for carrying out one-time defense of a thesis with increase in amount of specialties to members of council.

3. Procedure for holding meetings of Council

34. Within one working day no more than three meetings of Council can be held. At one meeting one defense of a thesis, or consideration of one thesis sent to VAK for conducting examination in connection with recertification in academic degree or one question of deprivation (recovery) of academic degree for representation of materials is carried out to Presidium of VAK. In addition at such meeting Council has the right to consider question of adoption of the thesis to protection, and also other organizational matters.

35. The meeting of Council is considered competent if took part in its work at least 2/3 from total quantity of his members, including the specialists who are in addition entered into structure of Council for carrying out one-time protection (at least two specialists having academic degree whose scientific profession corresponds to specialty and branch of science, on which the thesis for degree of the doctor of philosophy (PhD), doctors (one of them shall be doctor of science). The members of council who were present during all meeting and participating in closed ballot are considered participated in meeting.
