About approval of Rules, programs and the organization of testing of the citizens arriving on law-enforcement service

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services", with the subitem 5) of Item 2 of article 5 of the Law of the Republic of Kazakhstan "About public service of the Republic of Kazakhstan", I ORDER:

1. Approve the enclosed Rules, programs and the organization of testing of the citizens arriving on law-enforcement service.

2. And to anti-corruption to provide to department of public service of the Agency of the Republic of Kazakhstan for public service:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan its direction on official publication in periodic printing editions and information system of law of Ad_let;

3) within ten calendar days from the date of receipt of this order the direction it in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

4) placement of this order on official Internet resource of the Agency of the Republic of Kazakhstan for public service and to anti-corruption.

3. To impose control of execution of this order on the vice-chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption supervising questions of public service.

4. This order becomes effective from the date of enforcement of the Law of the Republic of Kazakhstan of December 20, 2016 "About modification and amendments in some legal acts of the Republic of Kazakhstan concerning public service".

Rules, programs and the organization of testing of the citizens for the first time arriving on law-enforcement service

Chapter 1. General provisions

1. These rules, programs and the organization of testing of the citizens arriving on law-enforcement service (further – Rules), are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services", with the subitem 5) of Item 2 of Article 5 and Item 2 of article 16 of the Law of the Republic of Kazakhstan "About public service of the Republic of Kazakhstan", and also according to Item 7 of article 6 of the Law of the Republic of Kazakhstan "About law-enforcement service".

Rules determine procedure, programs, the organization of testing for knowledge of state language and the legislation of the Republic of Kazakhstan (further – testing) and personal evaluations of the citizens arriving on law-enforcement service (further – the candidate), and also procedure for appeal of results of testing.

2. Testing is held in the presence of the operator of testing who is the worker of the legal entity with whom according to the legislation of the Republic of Kazakhstan on public procurements the service provision agreement on technical supply of test procedures of administrative government employees, candidates for occupation of the managerial state positions and citizens arriving on law-enforcement service is signed (further – the operator).

3. Technical supply of test procedures, forming of the database of test tasks and their updating is performed by the legal entity with whom according to the legislation of the Republic of Kazakhstan on public procurements the service provision agreement on technical supply of test procedures of administrative government employees, candidates for occupation of the managerial state positions and citizens arriving on law-enforcement service is signed (further – the service provider).

Chapter 2. Testing of the citizens arriving on law-enforcement service

4. The service provider holds testing of candidates in process of the address of citizens.

5. The citizens of the Republic of Kazakhstan who reached eighteen-year age take part in testing.

5-1. The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service (further – the List) is given in appendix 1-1 to these rules.

The authorized body in the field of public service within three working days from the date of modification and (or) amendments of Rules, staticizes information and sends it to the service provider, the operator of information and communication infrastructure of "the electronic government", and also to Single contact center.

6. For participation in testing candidates no later than one calendar day about day of testing submit the application in form, according to appendix 1 to these rules (further – the statement) through the web portal of "the electronic government" (further – the portal).

Data on identity documents, the service provider receives from the corresponding state information systems through lock of "the electronic government".

In case of the address through the portal in "personal account" of the candidate the status about adoption of the statement for rendering the state service is reflected.

Confirmation of documents acceptance is the receipt with indication of date, time and the place of passing of testing in form according to appendix 2 to these rules which is signed by the digital signature of the service provider.

In case of representation by the candidate of incomplete document package according to the list, stipulated in Item 8 Lists, and (or) documents with the expired effective period the service provider refuses reception of an application.

Candidates can get information and advice concerning submission of documents for testing through the web portal of "the electronic government" in Single contact center.

7. The candidate chooses day and time of testing proceeding from availability of empty seats for conducting testing no later than one calendar day about day of testing.

Record for testing is confirmed by the receipt in form, according to appendix 2 to these rules.

7-1. The bases for refusal in passing of testing are specified in Item 9 of the List.

8. The candidate passes test according to programs of testing of the citizens arriving on law-enforcement service on knowledge of state language and the legislation of the Republic of Kazakhstan according to appendix 3 to these rules (further – programs of testing), on that category of position of law-enforcement service which is specified in its statement.

9. Value for passing of testing for knowledge of state language of the Republic of Kazakhstan is not established.

10. The candidates having in case of themselves the identity document of the citizen of the Republic of Kazakhstan containing individual identification number (further – IIN), or the electronic document from service of digital documents are allowed to testing (for identification).

11. Prior to testing the operator instructs for tested on testing and answers the questions which arose at them.

12. The candidates having unsatisfactory health prior to conducting testing report about it to the operator. In this case testing of such candidates is held in other time during this day or in other day according to the schedule of testing.

13. Time of conducting testing is determined by the service provider.

14. The hall of testing is equipped with suppressor of cellular communication, for the purpose of identification of the candidate – card reader, and also for maintaining video and audio recording of process of testing – technical means of record.

15. Each workstation is equipped with the webcam for removal of the photo of the candidate and maintaining video of process of testing.

16. The tested candidates do not talk to other tested candidates, do not exchange materials, do not use information on paper, electronic and other media, do not leave the room.

The tested persons are not allowed to bring to the hall of testing the prinimayushche-transferring electronic devices (including mobile phones and others electronic the equipment). Such devices for the period of conducting testing are located on storage in special cases with cells.

17. In case of violation by the tested candidate of requirements of Item 16 of these rules, the operator stops process of testing of such candidate and deletes it from the room for testing.

At the same time the operator draws up the statement of abuse of regulations, programs and the organization of testing of the citizens arriving on law-enforcement service (further – the act of violation) in form, according to appendix 4 to these rules, within one working day.

17-1. In case of identification of the figurehead during start for testing or when conducting testing by the operator this person for testing is not allowed, or the operator stops process of testing of such person and deletes it from the room for testing.

At the same time the operator draws up the Statement of identification of the figurehead when testing in form, according to appendix 4-1 to these rules.

18. In case of impossibility of continuation of testing owing to force majeure (the spontaneous phenomena, military operations and so forth), and also because of technical malfunctions testing stops.

In this case the act of suspension of test procedure in form, according to appendix 5 to these rules is drawn up, and testing is held in other time during this day or in other day, according to the schedule of testing.

19. After the allowed time testing automatically comes to the end.

20. Calculation of the correct answers of testing is performed automatically, by means of the computer program of testing.

21. No later than twenty minutes after testing completion their results are issued to candidates.

22. In case of receipt by the candidate of result of testing is not lower than the values specified in programs of testing, in the integrated information system "E-Kyzmet" the certificate on passing of testing for knowledge of state language and the legislation of the Republic of Kazakhstan in form, according to appendix 6 to these rules is created.

Results of testing on the first program of testing are valid for categories of the positions of law-enforcement service relating to the first, second and third programs of testing.

Results of testing on the second program of testing are valid for categories of the positions of law-enforcement service relating to the second and third programs of testing.

Results of testing on the third program of testing are valid for categories of the positions of law-enforcement service relating to the third program of testing.

23. Results of testing are valid within one year from the date of its passing.

24. To the candidates who received results of testing is lower than the values specified in programs of testing, the certificate of passing of testing with results below values of passing of testing in form, according to appendix 7 to these rules is issued.

The candidates who received results of testing are lower than the established values, are allowed to repeated testing not earlier than in fifteen calendar days from the date of testing passing.

25. Candidates can receive results of testing for knowledge of state language and the legislation of the Republic of Kazakhstan on form according to appendix 6 to these rules, through the web portal of "the electronic government" or by means of the appeal to the State corporation in the presence of the digital signature.

Chapter 3. Procedure for evaluating personal qualities of candidates

26. Personal evaluation of candidates is carried out in the form of testing.

27. Testing for personal evaluation of candidates is held no later than twenty minutes after completion by them of testing for knowledge of state language and the legislation of the Republic of Kazakhstan. At the same time the candidates who received results of testing for knowledge of state language are allowed to testing for personal evaluation and legislations of the Republic of Kazakhstan are not lower than the values specified in programs of testing.

28. The candidates who received results of testing are not lower than the values specified in programs of testing, and not been on personal evaluation in time, established in Item 27 of these rules, stipulated in Item 7 these rules are allowed to participation in testing for personal evaluation according to the procedure.

29. The candidate passes test for personal evaluation according to programs of testing for personal evaluation of candidates for holding the posts of law-enforcement service according to appendix 9 to these rules on that category of position of law-enforcement service which is specified in its statement.

30. By results of testing for personal evaluation of the candidate in the integrated information system "E-Kyzmet" the conclusion by results of testing for personal evaluation of the candidate for position of law-enforcement service in form, according to appendix 10 to these rules is created.

The conclusions created by results of testing for personal evaluation of the candidate are valid within year from the date of testing passing.

Chapter 4. Procedure for appeal of results of testing

31. The candidates who received results of testing are lower than values of passing of testing, have the right to give on the appeal to the appeal commission of authorized body.

32. The application is submitted for the appeal addressed to the chairman of the appeal commission by the candidate who received results of testing is lower than the values specified in programs of testing in form according to appendix 11 to these rules. Statements on the appeal are adopted within ten calendar days after passing of testing and are considered by the appeal commission at meeting according to the schedule determined by the appeal commission.

The meeting of the appeal commission is held as required, depending on the number of the arriving statements.

32-1. The statement on the appeal is adopted from the candidate in appeal cases:

1) correctnesses of specific questions;

2) results of testing with reference to technical malfunctions;

3) act of testing abuse of regulations;

4) results of testing with reference to availability of the circumstances interfering the normal course of testing.

32-2. At meeting of the appeal commission test tasks on which the candidate who submitted the application for the appeal answered incorrectly, and its possible answers, and (or) video and audio recordings of process of testing of the candidate are considered.

32-3. Test tasks, and also video and audio recordings of process of testing of the candidate are provided in the appeal commission by the service provider at the request of authorized body for public service (further – authorized body).

At the same time test tasks are issued to candidates for acquaintance.

33. The decision of the appeal commission is made by a majority vote from total number of members of the commission. In case of equality of votes, the voice of the chairman is decisive. Decisions of the appeal commission are drawn up by protocols which shall be constituted in duplicate and signed all members of the appeal commission participating in this meeting. The second copy of the minutes of the appeal commission is transferred to the service provider and stored within one year.

The decision of the appeal commission is competent in the presence of 2/3 (two thirds) members from total number.

The appeal commission consists at least of five members, including the chairman.

34. By results of consideration of the received application on the appeal, the appeal commission within five working days from the date of receipt of the appeal accepts one or the other decisions:

1) to leave the appeal without satisfaction;

2) to satisfy the appeal of the candidate and to allow him on testing repeating an examination.

In case of leaving of the appeal of the candidate without satisfaction, he is allowed to repeated testing not earlier than in fifteen calendar days from the date of testing passing.

Chapter 5. Procedure for appeal of decisions, actions (failure to act) of service providers and (or) their officials, the State corporation and (or) their workers concerning testing passing

35. The claim to the decision, actions (failure to act) of the candidate concerning rendering the state service can be submitted addressed to the head of the service provider, to the official whose decision, action (failure to act) are appealed.

Consideration of the claim concerning rendering the state services is made by higher administrative authority, the official (further – the body considering the claim). The service provider, the official, whose decision, action (failure to act) are appealed, no later than three working days from the date of receipt of the claim send it and administrative case to the body considering the claim.

At the same time the service provider, the official whose decision, action (failure to act) are appealed, has the right not to send the claim to the body considering the claim if he within three working days makes the favorable decision, will make administrative action, completely meeting requirements specified in the claim.

The claim of uslugopoluchatel which arrived to the service provider who is directly rendering the state service according to Item 2 of article 25 of the Law of the Republic of Kazakhstan "About the state services" is subject to consideration within five working days from the date of its registration.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within fifteen working days from the date of its registration.

If other is not provided by the law, appeal to the court is allowed after appeal in pre-judicial procedure.

36. In disagreement cases with results of the rendered state service, the candidate has the right to take a legal action according to the procedure, established by the legislation of the Republic of Kazakhstan.

7	Working schedule	1) the service provider - Monday through Friday from 09:00 till 18:30 o'clock, with lunch break from 13:00 till 14:30 o'clock, except days off and holidays, according to the Labor code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan "About holidays in the Republic of Kazakhstan"; Issue of result of rendering the state service is performed in working hours, in turn, without making an appointment and the accelerated servicing; 2) the portal – round the clock, except for the breaks connected with carrying out technical works (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the Labor code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan "About holidays in the Republic of Kazakhstan", reception of an application and issue of result of rendering the state service is performed the next working afternoon). 9	The bases for refusal in rendering the state service established by the legislation of the Republic of Kazakhstan	1) passing by the candidate of testing during the last fifteen calendar days with results below threshold values; 2) availability of the act of abuse of regulations of the organization of testing, approved by the order of the Chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption of the February 21, 2017 No. 40 (registered in the Register of state registration of regulatory legal acts for No. 14939) constituted by the service provider within six last months; 3) availability of the Act of identification of the figurehead when testing, according to appendix 4-1 to these rules, constituted by the operator within the last year; 4) lack of consent of the uslugopoluchatel provided according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access which are required for rendering the state service. 5) Availability of the valid certificate according to the program of testing for knowledge of state language and the legislation of the Republic of Kazakhstan.
10	Other requirements taking into account features of rendering the state service	The candidate receives the state service electronically through the portal by means of use of the EDS. The candidate has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of "personal account" of the portal, service desks of the service provider, and also Single contact center "1414", 8-800-080-7777.

Note: the candidates for holding the post of law-enforcement service who received results when passing testing for knowledge of the legislation of the Republic of Kazakhstan are lower than values of passing of testing, pass repeated test not earlier than in fifteen calendar days from the date of testing passing.

In case of satisfaction with the appeal commission of the appeal of the candidate, he is allowed on repeating an examination of testing for knowledge of state language and the legislation of the Republic of Kazakhstan without observance of the above-stated term.

It is issued through the portal of "the electronic government" by the automated system of registration of authorized body for public service on testing passing.

Value of passing of testing according to the program makes at least 95 correct answers from total quantity of questions (135 questions) on all regulatory legal acts and at least 5 correct answers on each regulatory legal act.

General time for accomplishment of tests for knowledge of the legislation of the Republic of Kazakhstan constitutes 110 minutes.

2) the second program is intended for positions of law-enforcement service on categories C-SV-8, C-SV-10, C-SVO-3, C-SVO-5, C-SVO-7, C-SVO-9, C-SVR-4, C-SVR-5, C-SVR-8, C-SVU-13, C-SVU-14, C-SGU-11, C-SGU-12, C-SGU-13, B-PK-4, B-PK-5, B-PK-6, B-PK-7, B-PK-8, B-PKO-4, B-PKO-5, B-PKO-6, B-PKO-7, B-PKO-8, C-FM-5, C-FM-6, C-FMO-5, C-FMO-6 and includes:

tests for knowledge of state language of the Republic of Kazakhstan (20 questions) lasting 20 minutes.

tests for knowledge of the Constitution of the Republic of Kazakhstan (15 questions), the Criminal Code of Kazakhstan (15 questions), the Code of penal procedure of the Republic of Kazakhstan (15 questions), the Code of the Republic of Kazakhstan about administrative offenses (15 questions), the laws of the Republic of Kazakhstan "About anti-corruption" (15 questions), "About law-enforcement service" (15 questions), the Ethical code of law enforcement officers, bodies of civil protection and the Public courier service of the Republic of Kazakhstan approved by the Presidential decree of the Republic of Kazakhstan of January 2, 2023 No. 81 (15 questions).

Value of passing of testing according to the program makes at least 63 correct answers from total quantity of questions (105 questions) on all regulatory legal acts and at least 5 correct answers on each regulatory legal act.

General time for accomplishment of tests for knowledge of the legislation of the Republic of Kazakhstan of the second program constitutes 90 minutes.
