According to article 7 of the Law of Ukraine "About power industry" and to the Regulations on the Ministry of Fuel and Energy of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 382, for the purpose of enhancement of interaction of the State company "The national energy company "Ukrenergo" and subjects (objects) of power industry in the conditions of parallel work as a part of the Integrated power system of Ukraine I ORDER:

1. Approve Changes in Rules of relations between the State company "The national energy company "Ukrenergo" and subjects (objects) of power industry in the conditions of parallel work as a part of the Integrated power system of Ukraine, No. approved by the order of the Ministry of Fuel and Energy of Ukraine of June 2, 2008 303, registered in the Ministry of Justice of Ukraine on July 23, 2008 for No. 673/15364, which are applied.

2. (Serdyukov R. P.) in accordance with the established procedure to submit to department of power industry this order on state registration to the Ministry of Justice of Ukraine.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the deputy minister Ulida V. Yu.

"These Rules extend to subjects of managing of Ukraine, irrespective of their subordination and pattern of ownership which power generation facilities carry out parallel work as a part of the Integrated power system of Ukraine or its isolated part, and also the body performing management functions, regulation and the state supervision (control) in power industry. These Rules govern the operational and technological relations arising between GP "NEK "Ukrenergo" and its separate divisions (electric utility systems) and subjects (objects) of power industry in the conditions of parallel work as a part of the Integrated power system of Ukraine.".

2. State the Section I in the following edition:

"I. TERMS AND DETERMINATIONS

In these Rules terms are used in the following values:

absolute capacity limitation - restriction of active capacity from in advance set capacity limit;

alternative power engineering - the sphere of power providing development of electrical, heat and mechanical energy from alternative energy sources;

alternative energy sources - renewable energy resources which treat energy solar, wind, geothermal, wave energy and inflows, hydraulic power, energy of biomass, gas from organic waste, gas of sewer treatment plants, biogas and secondary energy resources to which domain and coke gases, gas methane of decontamination of coal fields, transformations of waste energy potential of engineering procedures belong;

the isolated part of the Integrated power system of Ukraine - set of power plants or separate generators of power plants and power networks which are placed in the territory of Ukraine and work separately from the main network of the Integrated power system of Ukraine in connection with technological need or technical impossibility of parallel work;

delta restrictions - restrictions of available active capacity on set in relative units of the size (delta);

the agreement on parallel work - the agreement which establishes rules of interaction and regulates operational and technological relations between GP "NEK "Ukrenergo" and the subject of power industry of Ukraine in the conditions of parallel work of its objects as a part of the Integrated power system of Ukraine;

electric utility system - separate division of GP "NEK "Ukrenergo" which acts on the basis of the Provision approved by the head of GP "NEK "Ukrenergo" and carries out operation main, interstate (in the territory of Ukraine) power networks and management of the modes of production dispatching (quickly), transfers and distributions of electrical energy in the territory of regions (areas) of Ukraine subordinated to it regarding centralized dispatching (operational and technological) management;

power supply system - set of power plants, power and thermal networks, other power generation facilities which are combined by general regime of production transfers and distributions of electrical and heat energy and are territorially placed in the region of Ukraine subordinated regarding centralized dispatching (operational and technological) management of operating mode to one electric utility system of GP "by NEK "Ukrenergo";

The integrated power system of Ukraine (further - OES of Ukraine) set of power plants, power and thermal networks, other power generation facilities which are combined by general regime of production, transfer and distribution of electrical and heat energy under centralized management of this mode within Ukraine;

object of alternative power engineering - the power generating and other equipment which makes energy due to use of alternative energy sources which share constitutes at least 50 percent from installed capacity of all power sources involved on object;

subject to scheduling - the equipment of power plants and substations, power lines, devices of relay protection, antiemergency automatic equipment, excitement, system of automatic control of frequency and overflows of capacity, means of the automated accounting of the electric power, means of the automated systems of dispatching management which are under operational supervision of dispatching personnel, according to multi-level structure of centralized OES Regional Public Institution of Ukraine;

restriction of gradient of capacity - maximum speed limit with which active capacity of VES (SES) can be changed in case of change of speed of wind (intensity of solar radiation) or change of installation of absolute capacity limitation;

operational team - oral specifying which is given by the communication channels dispatcher of the highest level of organizational structure of centralized dispatching (operativnotekhnologichesky) management of OES of Ukraine to the dispatcher or operation personnel of the lowest level of management on accomplishment of specific actions on management of operating modes of OES of Ukraine and operational condition of subjects to scheduling. Instruction is considered executed if the dispatcher received in oral form on communication channels the message on its accomplishment from the face which specifying received. operational maintaining by subject to scheduling - category of operational subordination of subject to scheduling which provides the organization of control of its condition or operating mode by operation personnel under which operational authority the specified subject to scheduling, by provision of the corresponding permissions or prohibitions on carrying out technological transactions on change of its condition or operating mode to operation personnel in which operational management there is subject to scheduling is;

operational subordination - operational management or operational maintaining;

the operational order - the written order of heads of all levels of organizational structure of centralized dispatching office of system of operational and technological management of OES of Ukraine on change of operating modes of OES of Ukraine and operational condition of subjects to scheduling or modification of the approved existing instructions transferred by facsimile or electronic means of communication;

operational management - category of operational subordination of subject to scheduling when technological transactions on change of its condition or operating mode require coordination of subordinate operation personnel and are performed by subject to scheduling or directly operation personnel in which operational management there is subject to scheduling, or his team. Operational management is exercised after receipt of permission from operation personnel under which authority above-mentioned object of management is;

parallel work of power generation facilities - joint synchronous operation of power generation facilities (power plants and power networks) for providing consumers with electrical energy under centralized dispatching (operational and technological) management of the mode of their work;

regulations on the operational and technological relations - the document which is the integral appendix to the agreement on parallel work which governs the operational and technological relations between GP "NEK "Ukrenergo", ES, EPK, EGK and power generation facilities (attached to network) regarding ensuring dispatching (operational and technological) management by preparation and maintaining the normal and repair modes, equipment conclusion from work or reserve and its introduction in work, the choice of settings of operation for devices of relay protection and antiemergency automatic equipment, joint operation of devices of telemechanics, communication, means of dispatching (operational and technological) management, maintaining single technical policy regarding questions of scientific and technical ensuring reliable and steady functioning of OES of Ukraine, development perspective;

point of general accession - point of power network of general purpose to which attach the line of issue of power of the power plant and to which are attached or other power plants or consumers can be attached.".

3. In the Section II:

"All subjects (objects) of power industry, irrespective of their subordination and pattern of ownership, shall fulfill requirements of regulatory legal acts and normative and technical documents of the Ministry of Energy and Coal Mining of Ukraine, relevant provisions and instructions of GP "NEK "Ukrenergo" for providing centralized regional public institution and reliable and steady work of OES of Ukraine.";

add Item with new paragraphs of the following content:

"Ensuring reliable functioning of OES of Ukraine, stable parallel work of energy objects of Ukraine, prevention of violations of normal operating mode of OES of Ukraine and accidents of system value, observance of requirements of energy security of Ukraine are performed by respect for criteria and borders of reliable and safe operation of the equipment, stability conditions of OES of Ukraine and its elements according to the existing regulatory legal acts and normative and technical documents and unconditional accomplishment by the determined Ministry of Energy and Coal Mining of Ukraine, GP "NEK "Ukrenergo" of antiemergency actions.

Features of regulation of the legal, economic and organizational relations connected with sale of electrical energy from the wholesale market of electrical energy of Ukraine on temporarily occupied territory and also the relations connected with production, transfer, distribution, supply, purchase, sale and use of electrical energy in temporarily occupied territory are established by the Cabinet of Ministers of Ukraine.";

Items 3.1. 3.1.4 to state 3, in the following edition:

"3.1.3. Most the power generation facilities (power networks, power plants and combined heat and power plants) located in the territory of Ukraine irrespective of subordination and pattern of ownership of subjects of managing which part they are work in parallel as a part of OES of Ukraine, except for those objects which by technological need or for technical reasons work separately from the OES main network of Ukraine.

3.1.4. Reliable parallel work of power generation facilities as a part of OES of Ukraine in comparison with their separate work gives the chance:

increase reliability and profitability of power supply of consumers;

reduce total capacity of size of emergency reserve which is necessary for steady work of OES;

raise possibilities of maneuvering by energy resources;

increase energy security of Ukraine.";

after Item 3.1.4 to add Chapter with new Item 3.1.5 of the following content:

"3.1.5. Reliable and economic functioning of OES of Ukraine is ensured for the account:

respect for the established criteria and limits of reliability, safety and profitability of operation of the equipment and functioning of OES of Ukraine in general;

parallel work of OES of Ukraine with power supply systems of the adjacent states;

developments of power systems, power networks and means of regulation by electric power overflows in OES of Ukraine for ensuring long-term and medium-term demand for electrical energy;

regulations of overflows on power lines of interstate bonds;

primary, secondary and tertiary regulation of frequency and capacity of power units.".

With respect thereto to consider Item 3.1.5 Item 3.1.6;

add Chapter with new Item of the following content:

"3.1.7. GP "NEK "Ukrenergo" and its separate divisions - ES together with subjects (objects) of power industry pursue the single technical policy regulated by the existing regulatory legal acts and normativnotekhnichesky documents of the Ministry of Energy and Coal Mining of Ukraine.

The single technical policy regarding questions of scientific and technical ensuring reliable and steady functioning of OES of Ukraine extends to all subjects (all objects) of power industry working in the parallel mode as a part of OES of Ukraine. Subjects (objects) of power industry approve performance of works on designing, construction, commissioning, operation, repair, reconstruction and conclusion from operation of the capital equipment of power plants and networks, means and systems of their automatic control and management, and also complexes of the Russian Railway and the PAS and funds of ASDU and SDTU from ES GP "NEK "Ukrenergo" and the general designer if this equipment is under operational authority or operational management.";

2) in Chapter 3.2:
