No. 297-300, 544), with subsequent changes, parts (12) Articles 4, Chapters V of the Law on currency control No. 62/2008 (repeated publication: Monitorul Oficial al Republicii Moldova, 2016, No. 423-429, the Art. 859), with subsequent changes, DECIDES: Executive committee of National Bank of Moldova
1. Approve Regulations about activities of organizations for currency exchange according to appendix to this resolution.
2. This resolution becomes effective on December 10, 2016.

1. In these regulations the concepts determined by the Law on currency control No. 62/2008 are used (repeated publication: Monitorul Oficial al Republicii Moldova, 2016, No. 423-429, the Art. 859), with subsequent changes (further – the Law No. 62/2008), and also the Regulations about licensing, organizations on currency exchange approved by the Resolution of Executive committee of National Bank of Moldova No. 304 of November 10, 2016.
2. These regulations regulate:
a) features concerning information which is hung out by organizations on currency exchange;
b) some aspects of rather currency rates and commission charges which are applied when implementing cash exchange currency transactions with physical persons;
c) transactions of organizations on currency exchange within activities for cash currency exchange with physical persons;
d) procedure of cash exchange currency transactions with physical persons.
3. Organizations on currency exchange perform activities for cash currency exchange with physical persons according to Law No. 62/2008 provisions taking into account the features established by these regulations.
4. In cases, stipulated in Item c) parts (2) and Item f) parts (3) article 42-1 of the Law No. 62/2008, determination of equivalent in other currency is performed using the official rate of the Moldovan leu in relation to foreign currencies operating on the date of implementation of exchange currency transaction.
4-1. When implementing of cash exchange currency transactions by licensed bank with physical persons by means of the exchange currency bureaus the licensed bank issues to the clients the check of currency exchange which conforms to requirements, stipulated in Item the 10th appendices to the Regulations on operation of the control and cash equipment when implementing cash cash calculations and/or by means of other payment instrument, approved by the Order of the Government No. 141/2019 about use of the control and cash equipment when implementing calculations.
4-2. The licensed bank reflects elements of the check of currency exchange in information system of bank.
5. Indoors, in which cash exchange currency transactions with physical persons are directly performed through windows/windows, the organization on currency exchange shall hang out in available to review physical persons the place the following documents / information:
a) the copy of the license of exchange currency cash desk / hotel, and in case of department of exchange currency cash – the copy of the verified copy of the license based on which activities for currency exchange are performed. The corresponding copy is confirmed by the signature of the managing director of exchange currency cash desk / managing of hotel, responsible for activities for cash currency exchange with physical persons of hotel or authorized by it person. Posting of the corresponding copies by licensed banks is performed according to the Regulations about requirements to publication of information by banks approved by the Resolution of Executive committee of National Bank of Moldova No. 158/2020;
b) the existing working schedule of organization on currency exchange;
c) information on the obligatory payment levied from physical persons according to the Law on Fonda of support of the population No. 827/2000;
d) the order about buying rates and the sales (the order about the currency rates) operating for implementation of cash exchange currency transactions with physical persons, which is drawn up according to the requirements established by Chapter III;
e) the order about the operating commission charges applied when implementing cash exchange currency transactions with physical persons which is drawn up according to the requirements established by Chapter III;
f) criteria of solvency of banknotes according to appendix No. 1;
g) information for clients (announcement) of the following content:
"IMPORTANT INFORMATION FOR THE CLIENT:
- Before implementation of exchange currency transaction obtain information on the currency rate by which exchange currency transaction, the size of the applied commission charges and obligatory payment, and also about cash amount which you actually receive is performed.
- The organization on currency exchange shall issue you the cash register receipt or the check of currency exchange which cannot be replaced with the reference of currency exchange.
- You have the right to require withdrawal of exchange currency transaction before its completion, and also within 30 minutes after transaction completion if the following conditions are at the same time complied: during the specified period the rate of purchase/sale of the purchased/sold foreign currency was not changed and the requirement about withdrawal of transaction was performed at least in 30 minutes prior to the termination of the working day of organization on currency exchange. The withdrawal of transaction after its completion is performed based on the written application to which the cash register receipt issued by exchange currency cash desk / hotel or the check of currency exchange issued by licensed bank is enclosed.

6. Information on the established currency rates and information on the commission charges applied when implementing cash exchange currency transactions with physical persons is hung out also on billboard with observance of the requirements established by parts (13) - (15) article 43 of the Law No. 62/2008.
7. The currency rates which are hung out on billboard shall correspond to the currency rates established by the order (which is valid during the corresponding period of the working day) about the currency rates for implementation of cash exchange currency transactions with physical persons with observance of provisions of part (8-1) articles 43 of the Law No. 62/2008. This provision is applied respectively and to information on the commission charges applied by organization on currency exchange.
8. On billboard the department of decimal signs from integer is performed by means of clear space, comma or point. The quantity of the decimal signs relating to buying rates of foreign currencies shall correspond to quantity of the decimal signs relating to selling rates of the corresponding foreign currencies. All figures shall be visible entirely, without overshoot, including partial overshoot.
9. Information on billboard as it is provided by Items 6-8, and also the orders specified in subitems d) and e) Item 5, are hung out prior to implementation of cash exchange currency transactions with physical persons. If the organization on currency exchange changes the currency rates during the working day, it shall hang out the corresponding orders and information prior to implementation of transactions using the established new rates. The relevant information shall be hung out during all working day of organization on currency exchange.
9-1. On entrance to organization on currency exchange, including at each window of organization on currency exchange, the sign/pictogram specifying surveillance camera availability, approved by the solution of the National center for personal data protection No. 581/2015 on approval of the standard form of informing on video surveillance implementation is hung out.
10. On the case of the foreign exchange device in available to review physical persons the place the organization on currency exchange shall hang out the following information:
a) identification and contact information of organization on currency exchange (the name, form of business, the location, IDNO, contact telephone numbers of organization on currency exchange);
b) contact information of National Bank of Moldova on which it is possible to file in the procedure established by the law claims of rather exchange currency transactions (Grigor Blvd. Viera, 1, of MD-2005, мун. Chisinau), and also phone number of National Bank of Moldova on which the physical person can address for receipt of information concerning activities for currency exchange (022 822 502) and corresponding are automatically taped telephone conversation.
11. The organization on currency exchange provides display on the screen of the foreign exchange device at least to information provided by subitems b) and h) part (3) article 42-1 of the Law No. 62/2008, with observance of the requirements established by parts (14) and (15) article 43 of the same law.
12. The currency rates displayed on the screen of the foreign exchange device shall correspond to the currency rates established by the order (which is valid during the corresponding period of the working day) about the currency rates for implementation of transactions by means of the foreign exchange device with observance of provisions of part (8-1) articles 43 of the Law No. 62/2008. This provision is applied respectively and to information on the commission charges applied by organization on currency exchange when implementing transactions by means of the foreign exchange device.
13. In case of display of the currency rates on the device screen the department of decimal signs from integer is performed by means of clear space, comma or point. The quantity of the decimal signs relating to buying rates of foreign currencies shall correspond to quantity of the decimal signs relating to selling rates of the corresponding foreign currencies.
