According to the subitem 16) of Item 1 of article 5 of the Law of the Republic of Kazakhstan "About mail" and the subitem 70) of Item 15 of the Regulations on the Ministry of the digital development, innovations and the aerospace industry of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of July 12, 2019 No. 501 I ORDER:

1. Approve the enclosed Rules of provision of services of mail service (further – Rules).

2. To provide to department of communication of the Ministry of information and communications of the Republic of Kazakhstan (V. Yaroshenko):

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days from the date of its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican center of legal information for inclusion in reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of information and communications of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of information and communications of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of information and communications of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication, except for the subitem 4) of Item 70 and Items 136, of 139, of 140 Rules which become effective since January 1, 2019.

At the same time the subitem 1) of Item 71 of Rules is effective till January 1, 2019.

Rules of provision of services of mail service

Chapter 1. General provisions

1. These rules of provision of services of mail service (further - Rules) are developed according to the subitem 16) of Item 1 of article 5 of the Law of the Republic of Kazakhstan "About mail" (further - the Law), the subitem 70) of Item 15 of the Regulations on the Ministry of the digital development, innovations and the aerospace industry of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of July 12, 2019 No. 501 and determine procedure for provision of services of mail service by operators of mail.

2. The following services of mail service belong to post activities:

1) universal services of mail service;

2) services in transfer of the registered mailings;

3) services of the accelerated and express mail service;

4) postal money transfers;

5) services in distribution of periodic printing editions in subscription and retail sale;

6) services in realization of signs of post payment and philatelic products;

7) services in transfer of hybrid departure;

8) services of special mail service according to article 9-1 of the Law;

9) services which provision is inseparably linked with services of mail service:

the courier's challenge on the house;

filling of the address;

tracking of the mailing;

packaging and execution of the mailing;

readdressing of the mailing;

forms on the mailing;

notification on delivery or delivery of the mailing;

storage of the mailing;

notice on the mailing;

home delivery.

3. In these rules the following basic concepts are used:

1) defective departure - the mailing having signs of access to investment (violation of integrity of packaging) or weight of which does not correspond to weight in case of acceptance;

2) the mailing with the notification on obtaining - the registered mailing when which giving the sender charges to the operator of mail to tell him or person specified to them when also who is handed the mailing;

8) departures of express mail service - the registered mailings processed and delivered with use of the courier;

9) the mailing with the announced value - the mailing (except postcard) when which giving by the sender its cost by submission of supporting documents according to the procedure appears, determined by authorized body in the field of mail;

10) operational window - the equipped workplace on production facility of the operator of mail where it are provided to the user of services of the operator of mail one or more types of service;

11) packet - the registered mailing sent without drawing signs of post payment including the state signs of post payment, investment, the sizes, weight and which packaging are provided by these rules;

12) category of the mailing - set of the signs determining procedure and conditions of acceptance, processing, transfer and delivery of the mailing (which are not registered custom, with the announced value, with special marks);

13) the term of transfer of mailings, postal money transfers, departures of the accelerated and express mail service - the term during which the operator of mail performs transfer of departures from production facility of the place of their acceptance to production facility of the place of their issue;

14) sekogramma - the mailing with investment of the written messages written by sekografichesky method, submitted openly, cliche with signs of sekografiya, the sound records intended only for blind people;

Chapter 2. Procedure for the organization of post network and servicing of mail of users of services of the operator of mail by operators, including on easy access to persons with disability to services of mail service

4. Operators of mail independently create post networks for provision of services of mail service, except as specified, the stipulated in Clause 10 Laws.

For the purpose of the organization of post network the operator of mail creates and uses production facilities, and also post routes.

By provision to users of services of the operator of mail of universal services of mail service, creation and functioning of post network is performed according to indicators of quality of universal services of mail service, information approved by the order of the Minister and communications of the Republic of Kazakhstan of July 20, 2016 No. 44 (it is registered in the Register of state registration of regulatory legal acts for No. 14130).

7. For provision of services of mail service in production facilities of the operator of mail operational windows with workplaces for provision of services of mail service during the whole operational day are equipped.

8. At entrance to production facilities of the operator of mail the sign with indication of the name of production facility and operating mode is established. In the production facilities located in the cities and working on a rolling basis with lunch break or with the day off, the announcement of the location and operating mode of the next production facility providing services without interruption or without the days off is also placed.
