About modification and amendments in the Law on compensation No. 847-XV of February 14, 2002

The Parliament adopts this organic law.

Art. I. – In the Law on compensation No. 847-XV of February 14, 2002 (Official monitor of the Republic of Moldova, 2002, Art. No. 50-52, 336), with subsequent changes and amendments, to make the following change and addition:

1. Add Article 12 with parts (4) and (5) the following content:

"(4) the Guaranteed minimum size of the salary in the real sector forms basis for differentiation of official salaries / the tariff charges depending on qualification, the professional training level and competence of the worker, and also from level of responsibility which is assumed by the carried-out obligations/works, and difficulties of the last.

(5) the guaranteed minimum size of the salary in the real sector does not join the additional salary and other stimulating or compensation payments.".

2. State Article 14 in the following edition:

"Article 14. The tariff charge for the I qualification category (the I category of compensation)

(1) In case of application of tariff wage system the tariff charge for the I qualification category (the I category of compensation) of scale of charges is the main and obligatory element and forms basis for establishment of the specific tariff charges and official pay rates.

(2) the Tariff charge for the I qualification category (the I category of compensation) is established:

a) in the budget sector – the law and in the amount of, equal or exceeding the size of minimum wage over the country;

b) in the real sector – by collective bargainings at the industry level and in the amount of, at least, the equal or exceeding guaranteed minimum size of the salary in the real sector established annually by the order of the Government, and at the enterprise level of the corresponding industry – at a rate of not less than established at the industry level.
