ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

About approval of Veterinary sanitary standards about health of animals when importing reproductive material

(as amended on 04-10-2023)

According to article 29 of the Law No. 221-XVI of October 19, 2007 on veterinary and sanitary activities (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 125-129, 396) and article 59 of the Law No. 213/2022 on livestock production (The official monitor of the Republic of Moldova, 2022 No. 267-273, of the Art. 556) and for the purpose of protection of the territory of the Republic of Moldova against penetration and the outbreak of the diseases which are subject to the notification, the statement for them and imposing of quarantine, the Government DECIDES:

1. Approve:

Veterinary sanitary standard about health of animals when importing reproductive material of cattle according to appendix No. 1;

Veterinary sanitary standard about health of animals when importing reproductive material of pigs according to appendix No. 2;

The veterinary sanitary standard establishing some samples of certificates about health when importing reproductive material, ova and embryos of animals of family horse, sheep and goats and also ova and embryos of pigs according to appendix No. 3.

The veterinary sanitary standard establishing the requirements to health regulating placement in the market and trade (import and export) in animals, seed material, ova and embryos of artiodactyl types (Artiodactyla), the mammals belonging to Lagomorpha groups (rabbit) and Carnivora (mink, fox, dog, cat and polecat) including birds except hens, turkeys, guinea fowls, ducks, geese, quails, pigeons, pheasants, partridges, rathites, ostriches according to appendix No. 4

2. To impose control of execution of this resolution on the National agency on safety of foodstuff and the Ministry of Agriculture and the food industry.

Veterinary sanitary standard about health of animals when importing reproductive material of cattle

The this Regulation partially shifts the Directive of Council No. 88/407/EEC of June 14, 1988 establishing the requirements applied to trade in Community and to import of reproductive material of cattle (JO L194, on July 22, 1988, p. 10), thus, as it was changed last time by the Decision of the Commission on implementation No. 2011/629/EU of September 20, 2011 (JO L 247, on September 24, 2011, p. 2).

Chapter I General provisions

1. The veterinary sanitary standard about health of animals when importing reproductive material of cattle (further – this Veterinary sanitary standard) establishes requirements to health of animals when importing reproductive material of cattle.

This Veterinary sanitary standard does not concern the zootechnical provisions regulating the organization of artificial insemination of cattle and distribution of reproductive material large horned the cattle.

2. In this Veterinary sanitary standard the used concepts have the following values:

reproductive material – the eyakulyata received from domestic cattle, processed or diluted;

the center for capture of reproductive material – the company having veterinary and sanitary authorization and officially controlled at which receive reproductive material for artificial insemination;

the center for storage of reproductive material (спермобанк) – the company having veterinary and sanitary authorization and officially controlled in which store reproductive material for artificial insemination;

the veterinarian of the center – the veterinarian authorized by competent veterinary authority to which duties ensuring daily observance in the center of the requirements provided in this Veterinary sanitary standard belongs;

batch – batch of reproductive material on which one veterinary sanitary certificate is issued;

the country of capture of reproductive material – the country in the territory of which reproductive material is received and from where it is sent to other country;

the authorized laboratory – the laboratory authorized by competent veterinary and sanitary authority to conduct the researches specified in this Veterinary sanitary standard;

capture – receipt of reproductive material (sperm) from donor male.

Chapter II General requirements

3. Reproductive material which conforms to the following general requirements is allowed to import:

a) it is received and processed and/or placed in storage, as necessary, in the center for capture or storage authorized for this purpose, and intended for artificial insemination;

b) it is received from cattle which state of health conforms to the requirements specified in this Veterinary sanitary standard;

c) it is received, processed, it is stored and transported according to requirements to authorization and official supervision of the centers, and also with the requirements to the reproductive material intended for import, specified in this Veterinary sanitary standard;

d) is followed during transportation to the country of destination by the certificate about health of animals completed according to provisions of this Veterinary sanitary standard.

4. The reproductive material received from cattle vaccinated against foot-and-mouth disease is allowed to be imported, only if:

a) it is received twelve months later after vaccination against foot-and-mouth disease; and

b) 5% of reproductive material from each batch (at least 5 subject glasses) were exposed in laboratory of the country of destination or in the laboratory authorized by competent veterinary and sanitary authority of the country of destination, to the test on isolation of virus for detection of foot-and-mouth disease with negative result.

5. The center for capture or storage of reproductive material shall be:

a) it is authorized and observe requirements of this Veterinary sanitary standard;

b) single number of veterinary registration is registered and have.

6. Official veterinarian:

a) checks observance of requirements of this Veterinary sanitary standard;

b) withdraws veterinary and sanitary authorization in case of non-compliance with one or several requirements specified in this Veterinary sanitary standard.

7. Competent veterinary and sanitary authority:

Constitutes 1), regularly updates and informs the public the list of the countries from which import of reproductive material, taking into account the following criteria is resolved:

a) the state of health of these animals, other domestic and wild animals in the exporting country, especially considering exotic diseases of animals, and also state of environment in the respective country which can threaten health of livestock in the country;

b) the offer of modification and amendments in this Veterinary sanitary standard according to technological progress;

c) regularity and speed of information provided by the exporting country on availability in its territory of infectious diseases of animals, in particular those which are mentioned in lists A and B of the World Health Organization of animals (further – MEB);

d) documents of the exporting country on prevention and fight against diseases at animals;

e) structure of veterinary services of the exporting country and priorities of these services;

f) organization and enforcement of actions for the prevention and fight against infectious diseases;

g) the guarantees provided by the exporting country, concerning observance of requirements of this Veterinary sanitary standard;

2) approves detailed work instructions for uniform application of this Item;

3) is not approved by import of reproductive material from the countries which are not included in the list of the countries from which import of reproductive material is resolved.

8. The reproductive material allowed to import shall be followed by the certificate about health of animals of equivalent sample specified in appendix to this Veterinary sanitary standard, the filled and signed official veterinarian of the country of capture of reproductive material, which:

a) it is filled in one of official languages of the country of capture of reproductive material and in one of languages of the country of destination or its certified translation is applied;

b) accompanies consignment to the destination, in the original;

c) consists of one leaf;

d) it is provided for one receiver.

9. Competent veterinary and sanitary authority:

a) prohibits import of batches of reproductive material if in case of verification of documentation non-compliance with requirements of Item 3 of this Veterinary sanitary standard is revealed;

b) takes necessary measures, including imposing of quarantine for receipt of incontestable proofs in case of suspicion on initiation or infection of reproductive material with pathogenic microorganisms;

c) permits, at the request of the consignor or his representative, return of reproductive material if it is not contraindicated because of the state of health;

d) resolves destruction of the reproductive material, non-compliant to the requirements if the exporting country within thirty days does not agree to its return; and

e) notifies on it the consignor or his representative about the fundamental reasons of adoption of such decision.

Chapter III of the Requirement to import

10. When importing the competent veterinary and sanitary authority shall be convinced that competent authority of the exporting country:

Constitutes 1), updates and informs the public the list of the centers for capture and storage of reproductive material, registers and assigns to each of them single veterinary registration number;

2) provides the guarantees concerning observance of requirements relatively:

a) official authorization for export of the centers for capture or storage of reproductive material, specified in this Veterinary sanitary standard;

b) supervision of these centers according to requirements of this Veterinary sanitary standard;

c) stays under observation of the veterinarian of the center;

d) official inspection of the centers included in the list, at least two times a year;

e) immediate suspension or cancellation of authorization by competent authority of the exporting country in case of non-compliance with provisions of this Item;

f) uniform accomplishment of this Item.

11. Reproductive material shall be received from animals who before its capture were at least six months in the territory of the exporting country included in the list of the countries from which import of reproductive material and, respectively, in the list of the centers for capture and storage of the reproductive material allowed to export is allowed.
