About approval of the Regulations on procedure for issue of permissions to the right of implementation of functions of the specialized organizations in the field of nondestructive control and (or) welding production when implementing activities for use of atomic energy and entering of amendment into the Resolution of Council of Ministers of the Republic of Belarus of February 17, 2012 No. 156

Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed Regulations on procedure for issue of permissions for the right of implementation of functions of the specialized organizations in the field of nondestructive control and (or) welding production when implementing activities for use of atomic energy.

2. Add the single list of the administrative procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, approved by the resolution of Council of Ministers of the Republic of Belarus of February 17, 2012 No. 156 "About approval of the single list of the administrative procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, making amendment into the resolution of Council of Ministers of the Republic of Belarus of February 14, 2009 No. 193 and recognition voided some resolutions of Council of Ministers of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2012, No. 35, 5/35330; National legal Internet portal of the Republic of Belarus, 16.04.2013, 5/37100), Item 20.44 of the following content:

"20.44. Issue of permission for the right of implementation of functions of the specialized organizations in the field of nondestructive control and (or) welding production when implementing activities for use of atomic energy (further in this Item – permission), prolongation of term of its action, modification of permission, issue of its duplicate	Gosatomnadzor	for receipt of permission, prolongation of term of its action: the statement in the established form the copy of the certificate of accreditation confirming accreditation availability in the National accreditation system of the Republic of Belarus in the field of nondestructive and (or) the destroying control in case of quality evaluation of welded connections copies of constituent documents information about the works managers (at least two) who are on the staff which was trained, instructing and assessment of knowledge of regulatory legal acts, including technical regulatory legal acts, in the field of ensuring nuclear and radiation safety according to the legislation (except for receipts of permission to carrying out certification of personnel in the field of welding production): copies of the documents confirming position assignment of heads minutes abstracts of knowledge assessment of regulatory legal acts, including technical regulatory legal acts, in the field of ensuring nuclear and radiation safety of works managers or the copy of such protocols, certified in accordance with the established procedure for receipt of permission to carrying out research, project, developmental works in the field of nondestructive control, welding, related processes and technologies, prolongation of effective period of permission: the quality assurance program in case of performance of works and provision of services on the declared activities information about the workers who are on the staff having the higher education and work experience in the field of materials science, nondestructive control, welding, related processes and technologies at least 10 years: copies of education documents of workers the copies of service records of workers certified in accordance with the established procedure information about the workers who are on the staff having experience of accomplishment of research, developmental works in the field of materials science, nondestructive control, welding, related processes and technologies at least 10 years – the list of the scientific research and developmental works executed by such workers information about the workers (at least three) who are on the staff having academic degree in the field of materials science, nondestructive control, welding, related processes and technologies: copies of the documents confirming availability of academic degree copies of the documents confirming position assignment the copy of the order on creation of scientific and technical council certified in accordance with the established procedure the data on availability of the experimental base completed with the equipment, stands, samples, devices and techniques for carrying out researches and testing, certified by signatures of the head and person performing management of financial accounting for receipt of permission to carrying out the analysis of the project, design and technological documentation at the request of state bodies operating the organizations for durability, reliability and durability of welded connections, use of new main and welding materials, causes of destruction of welded connections and designs of objects, prolongation of effective period of permission: the quality assurance program in case of performance of works and provision of services on the declared activities information about the workers who are on the staff having the higher education and work experience in the field of materials science, nondestructive control, welding, related processes and technologies at least 10 years: copies of education documents of workers the copies of service records of workers certified in accordance with the established procedure information about the workers who are on the staff having experience of accomplishment of research, developmental works in the field of materials science, nondestructive control, welding, related processes and technologies at least 5 years – the list of the scientific research and developmental works executed by such workers information about the workers (at least three) who are on the staff having academic degree in the field of materials science, nondestructive control, welding, related processes and technologies: copies of the documents confirming availability of academic degree copies of the documents confirming position assignment for receipt of permission to participation in production certification of technology of welding (development, research and production certification of engineering procedures of welding, heat treatment and control with issue of the conclusion about possibility of use at the company), prolongation of effective period of permission: information about the workers who are on the staff having the higher education and work experience in the field of materials science, nondestructive control, welding, related processes and technologies at least 5 years: copies of education documents of workers the copies of service records of workers certified in accordance with the established procedure the data confirming experience of development of production and technological documentation in the field of materials science, weldings, related processes and technologies: copies of the agreements signed on accomplishment of the corresponding works the list of the performed works in the respective area information about the workers who are on the staff having experience of accomplishment of research, developmental works in the field of materials science, nondestructive control, welding, related processes and technologies at least 5 years: copies of education documents of workers the copies of service records of workers certified in accordance with the established procedure for receipt of permission to carrying out certification of personnel in the field of welding production, prolongation of effective period of permission: the copy of permission of Gosatomnadzor to the right of carrying out professional training, retraining and advanced training of the persons responsible for nuclear and radiation safety, and also the persons responsible for radiation control at facilities and productions supervised by Gosatomnadzor data on availability of the production rooms equipped with welding cabins for check of practical skills of the certified welders: copy of the certificate on state registration of real estate object or copy of the lease agreement the copy of extrackt from technical data sheet of the room (if present) the data on availability of the welding and service equipment by the corresponding types of welding certified by signatures of the head and person performing management of financial accounting data on availability of the equipment for preparation of control samples for welding, monitoring procedures and testing of welded connections, other necessary tools and accessories certified by signatures of the head and person performing management of financial accounting data on audience availability for carrying out training and the passing theoretical examination equipped with visual aids, reference books and literature on technology of welding, metallurgical science, welding materials, the device and the principles of operation of the welding equipment: copy of the certificate on state registration of real estate object or copy of the lease agreement the copy of extrackt from technical data sheet of the room (if present) list of visual aids and reference books	30 days	5 years
		for modification of permission – the statement in any form with application of copies of constituent documents		on effective period of the issued permission
		for receipt of the duplicate of permission – the statement in any form		on effective period of the issued permission

3. This resolution becomes effective in three months after its official publication.

Regulations on procedure for issue of permissions for the right of implementation of functions of the specialized organizations in the field of nondestructive control and (or) welding production when implementing activities for use of atomic energy

1. This Provision determines procedure for issue of permissions to the right of implementation of functions of the specialized organizations in the field of nondestructive control and (or) welding production when implementing activities for use of atomic energy (further - permission).

2. The specialized organizations are the organizations performing the works in the field of nondestructive control, welding, related processes and technologies and also rendering services in production certification of technology of welding and certification of personnel in the field of welding production when implementing activities for use of atomic energy.

Surfacing, soldering, coating, thermal cutting, and also development of highly effective resource-saving technologies for materials connection, methods of designing of strong and reliable welded designs belong to related processes and technologies.

3. Permission is issued on implementation of one or several types of activity:

carrying out research, project, developmental works in the field of nondestructive control, welding, related processes and technologies;

carrying out the analysis of the project, design and technological documentation at the request of state bodies operating the organizations for durability, reliability and durability of welded connections, use of new main and welding materials, causes of destruction of welded connections and designs of objects;

participation in production certification of technology of welding (development, research and production certification of engineering procedures of welding, heat treatment and control with issue of the conclusion about possibility of use at the company);

certification of personnel in the field of welding production.

4. For receipt of permission and prolongation of term of its action the specialized organization (further - the applicant) submits to Department on nuclear and radiation safety of the Ministry of Emergency Situations (further - Gosatomnadzor) the statement in form according to appendix, and also the documents and data specified in Item 20.44 of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, the Council of Ministers of the Republic of Belarus approved by the resolution of February 17, 2012 No. 156 "About approval of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs entering of amendment into the resolution of Council of Ministers of the Republic of Belarus of February 14, 2009 No. 193 and recognition voided some resolutions of Council of Ministers of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2012, No. 35, 5/35330).

The applicant gives to Gosatomnadzor:

for modification of permission - the statement in any form with application of copies of constituent documents;

for issue of the duplicate of permission - the statement in any form.

5. Gosatomnadzor in case of consideration of the application, the this provision specified in item 4, accepts according to article 24 of the Law of the Republic of Belarus of October 28, 2008 "About bases of ministerial procedures" (The national register of legal acts of the Republic of Belarus, 2008, No. 264, 2/1530) one of the following executive decisions:

about refusal in adoption of the statement;

about issue (prolongation of effective period, modification, issue of the duplicate) of permission;

about refusal in issue (prolongation of effective period, modification, issue of the duplicate) of permission.

The decision on refusal in issue (prolongation of effective period, modification, issue of the duplicate) of permission accepts Gosatomnadzor on the bases provided in article 25 of the Law of the Republic of Belarus "About bases of ministerial procedures".

The executive decision can be appealed according to the procedure, established by the legislation.

6. Effective period of the issued permissions - 5 years.

7. The applicant in case of change of the name and (or) the location addresses to Gosatomnadzor for entering of corresponding changes into permission in a month.

8. Modification of permission and prolongation of term of its action are drawn up by new permission. In case of modification of permission effective period of new permission is established on remaining period of action of earlier issued permission.

9. For prolongation of effective period of permission the applicant not later than one month and not earlier than before three months before the expiration of its action addresses to Gosatomnadzor according to the procedure, provided by this Provision for issue of permission.

The validity of permission can be extended repeatedly.

10. In case of loss (spoil) of permission issue of the duplicate of permission is made.

11. The duplicate of permission is drawn up marked "Duplicate" in the upper right corner of the form.

12. In case of receipt of new permission the applicant hands over the original of earlier issued permission or its duplicate in Gosatomnadzor.

13. Permission is terminated:

after the term for which it is issued;

according to the decision of Gosatomnadzor in case of detection of the doubtful documents and (or) data provided for its obtaining. Gosatomnadzor in writing notifies the applicant on cancellation of permission within three working days from the date of adoption of the relevant decision. Action of permission is considered stopped from the date of, Gosatomnadzor specified in the relevant decision;

in case of liquidation (the activities termination) or reorganization of the applicant.
