Based on subitem 1.17 of Item 1 of Article 12, of Items 5 and 6 of Article 28, of item 4 of Article 29 and Article 30 of the Forest code of the Republic of Belarus the Ministry of forestry of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure for reforestation and afforestation it (is applied).

2. This resolution becomes effective since December 31, 2016.

Regulations on procedure for reforestation and afforestation

Chapter 1. General provisions

1. This Provision establishes procedure for carrying out reforestation and afforestation, inspection of sites of forest fund, the requirement for care of forest plantings, criteria of reference of forest cultures to the dead, procedure for write-off of the died forest cultures, procedure and requirements of input of forest plantings in category of valuable forest plantings.

2. For the purposes of this Provision the terms and determinations established by the Forest code of the Republic of Belarus and also the following terms and determinations are applied:

agrotechnical leaving – complex of the acceptances directed to improvement of conditions for survival and growth of trees and bushes of the cultivated main breeds by loosening of the soil, destruction, delay of growth of weeds and undesirable wood and shrubby vegetation, mandrel of plants from backfilling by the earth and soil, application of fertilizers;

biological age of forest cultures – the amount of age of forest cultures and the landing material of forest plants used for their creation;

trees of minor breed – trees which in certain forest vegetation and economic conditions to a lesser extent answer the purposes of forest management, than trees of the main breed;

density of forest cultures – number of trees and bushes of the cultivated breeds on the unit area;

artificial reforestation – creation of the woods on lands where the wood grew earlier, by crops of seeds and (or) landing of landing material of forest plants;

the combined renewal of the woods – combination of natural renewal of the woods to artificial reforestation;

the cultivated tree species – the breeds of trees and bushes used during creation of forest cultures;

forest sapling – the landing material of forest plants which is grown up from the replaced forest seedling or by rooting of parts of forest plant;

forest seedling – the landing material of forest plants which is grown up from seed of forest plant;

the silvicultural square – the land area intended for creation of forest cultures;

silvicultural fund – set of the silvicultural areas;

processing of the soil under forest cultures – the mechanical or chemical processing of the soil on all silvicultural square or its part providing favorable conditions for growth of trees and bushes of the cultivated breeds;

transfer of sites of forest cultures to the lands covered with the wood – inclusion of the site of the forest cultures which reached the established indicators by quantity and height in the lands covered with the wood;

preparation of the silvicultural area – creation of necessary conditions for processing of the soil under forest cultures and the subsequent agrotechnical acceptances;

undergrowth of the main breeds – the wood forest plants of natural origin growing under canopy of the wood and capable to form forest stand which height does not exceed the one fourth height of trees of the main bed curtains;

landing material of forest plants – the wood forest plants or their parts intended for landing on the silvicultural square in forest nursery and (or) for gardening;

landing material of microclonal reproduction – the landing material of forest plants which is grown up as a result of vegetative reproduction in the conditions of "in vitro";

landing material with the closed root system – landing material of forest plants with the root system which is in lump of the soil, briquette or reservoir with substrate;

landing material with open root system – landing material of forest plants with the root system exempted from the soil or the covering substrate;

the landing (sowing) place – the location of landing material (seeds) of forest plants on the land area of reforestation and afforestation;

podpologovy forest cultures – the forest cultures created under bed curtains of low-half-musical planting for increase in its productivity, stability and decorative properties;

imparted landing material – the landing material of forest plants which is grown up as a result of inoculation of kidneys or escapes of one plant on another;

survival of forest cultures – the indicator expressed as a percentage determined by the relation of number of the cultivated breeds of seats occupied with viable trees and bushes to total number of the seats considered in case of technical acceptance, or the sowing places considered in case of inventory count, to the standard rate of the minimum density of the created forest cultures depending on type of forest vegetation conditions;

selection landing material of forest plants – the landing material of forest plants which is grown up from the improved, genetically improved and high-quality seeds;

method of creation of forest cultures – set of methods of performance of works on creation of forest cultures manually or using means of mechanization;

continuous forest cultures – forest cultures with rather uniform placement of trees and bushes of the cultivated breeds providing their prevailing participation in structure of planting;

standard landing material of forest plants – the landing material of forest plants meeting the requirements established by the technical regulatory legal act obligatory for observance;

degree of smykaniye of trees of the main breed in the ranks of forest cultures – the indicator expressed as a percentage determined by the relation of extent of horizontal projections of crowns of the main breed in ranks (without the extent of their overlapping) to the general extent of ranks;

the scheme of mixing of tree species – procedure for placement of trees and bushes of the cultivated breeds on the silvicultural square;

technology of creation of forest cultures – set of the consecutive acceptances and transactions providing cultivation of the forest cultures corresponding to the established standard rates;

type of forest vegetation conditions (further if other is not established, – TLU) – the lesovodstvenny classification category which is characterized by homogeneous forest vegetation conditions of the lands covered and not covered with the wood;

chemical leaving – the leaving directed to improvement of conditions for survival and growth of trees and bushes of the cultivated main breeds by destruction of weeds and undesirable wood and shrubby vegetation by means of chemical means;

partial forest cultures – the forest cultures placed on the square in the places deprived of the undergrowth of the main breed for increase in completeness or improvement of pedigree structure of planting;

shank – part of plant of one-two-year age for vegetative reproduction.

3. The main objective of reforestation and afforestation is creation of the woods taking into account increase in their productivity, quality and stability with simultaneous preserving biological diversity, the water preserving, protective, sanitary and hygienic, recreational and other useful properties.

4. Treat the main directions of reforestation:

natural renewal of the woods;

the combined renewal of the woods;

artificial reforestation.

5. Methods of natural renewal of the woods are:

preserving viable undergrowth of the main breeds when carrying out clear-cutting cabins of the main use;

ensuring renewal of the woods as a result of application not continuous (gradual and selective) cabins of the main use and cabins of updating;

natural renewal of the woods on the lands which are not covered with the wood without carrying out measures of assistance (further – natural renewal without assistance measures);

carrying out measures of assistance to natural renewal of the woods by machining of the soil (mineralization) and (or) enclosing of cutting areas and cuttings down.

6. Methods of the combined renewal of the woods are:

carrying out measures of assistance to natural renewal of the woods by crops to the processed soil of seeds of trees of the main breeds and (or) landing of the main tree species;

creation of partial forest cultures by crops to the processed soil of seeds of trees of the main breeds and (or) landing of the main tree species.

7. Methods of artificial reforestation for creation of continuous forest cultures are crops of seeds of trees of the main breeds and (or) landing of landing material of forest plants.

Plantings on which the main wood breed is cultivated by crops of seeds to the soil belong to the forest cultures created by crops of seeds.

During creation of forest cultures simultaneous sowing of seeds and landing of landing material of forest plants of the same wood breed are not allowed on one site.

8. The following work types belong to forestry and landscape actions for reforestation, afforestation and care of forest plantings in the course of reproduction of the woods:

inspection of the site of the forest fund suitable for reforestation and afforestation, for the purpose of refining or purpose of method of reforestation or afforestation;

shooting, preparation and otgranicheniye on the area of the site suitable for reforestation and afforestation;

processing of the soil;

enclosing of cutting areas and cuttings down;

crops of seeds and (or) landing of landing material of forest plants;

care of forest plantings;

quality evaluation of reforestation and afforestation.

9. Reforestation and afforestation are carried out according to forest management projects, except as specified, specified in Items 2 and 4 of Article 28 of the Forest code of the Republic of Belarus, in the presence of natural renewal in quantity and height, the woods, sufficient for purpose of natural renewal, without measures of assistance, designing of actions for assistance to natural renewal of the woods, to artificial reforestation and afforestation taking into account requirements of Items 15, of 17, the 19 and 20 this provision. In these cases reforestation methods, types and amounts of works are determined by the legal entity conducting forestry (further, unless otherwise specified, – forestry), based on results of inspection of sites of forest fund according to Item 42 this provision without modification of the forest management project.

10. Reforestation and afforestation on the sites of forest fund which are not designed for their carrying out by the forest management project are performed according to Chapters 2 and 3 of this provision.

11. Financing of reforestation and afforestation is performed at the expense of means of the republican budget, receipt of funds from payments for forest utilization, from realization of the forest products received when implementing forestry and landscape actions, and other sources which are not prohibited by the legislation.

12. In case of reforestation and afforestation to coniferous trees of the main breed carry trees of childbirth pine, fir-tree, fir, larch, to hard-wooded broadleaved – childbirth beech, elm, oak, maple, ash-tree, to soft-wooded broadleaf in radical types of the wood – types alder black, linden small-leaved, birch fluffy.

Use of trees of birch drooping (warty or plakuchy) as trees of the main breed is allowed during creation of forest cultures according to requirements of this provision.

During creation of forest cultures the main wood breed is determined depending on TLU according to standard rates of the minimum density of the created forest cultures according to appendix 1. At the same time share of trees of the main breed shall constitute at least 50% of total quantity of trees and bushes of the cultivated breeds on the site.

13. On the objects of reforestation and afforestation created in the research and educational purposes, action of Chapters 2-5 of this provision does not extend.

On each created object specified in part one of this Item the statement of laying of object of reforestation (afforestation) in the research and educational purposes in form according to appendix 2 is drawn up. Acts of laying of object of reforestation (afforestation) in the research and educational purposes are stored in structural division of the legal entity conducting forestry (forest area) within three years from the moment of input of forest plantings in category of valuable forest plantings.

14. Reforestation and afforestation on the sites of forest fund which are in the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP are carried out according to the Rules of forest management in the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP approved by the resolution of the Ministry of forestry of the Republic of Belarus of December 27, 2016 No. 86.

Chapter 2. Procedure for carrying out reforestation and afforestation, inspection of sites of forest fund

15. The method of natural renewal without measures of assistance is appointed on sites of forest fund:

with availability of viable forest plants of trees of the main breeds more than 4 thousand pieces on hectare at the age of two and more years height are at least m 0,1;

characterized by adverse conditions of the circle, including the excessive moistening expressed by microrelief where it is inexpedient to apply other methods of reforestation;

the paragraphs of the third and fifth of part two of Item 76 of this provision conforming to requirements.
