About approval of Rules of rendering post services
Based on Article 8 and part (4) article 40 of the Law on mail service No. 36 of March 17, 2016 (The official monitor of the Republic of Moldova, 2016, Art. No. 114-122, 255) and for the purpose of regulation of procedure for rendering post services and the relations between users and suppliers of the post services Government DECIDES:
1. Approve Rules of rendering post services according to appendix No. 1.
2. Rules of rendering post services to enact since February 1, 2017.
3. On the date of entry into force of these rules to recognize invalid some orders of the Government according to appendix No. 2.

to the Order of the Government of the Republic of Moldova of December 30, 2016 No. 1457
1. Rules of rendering post services (further – Rules) are developed according to the Law on mail service No. 36 of March 17, 2016, the Convention of Universal Postal Union, the Convention for the standardization of some rules of the international airborne transportations concluded in Montreal on May 28, 1999, the Convention on the Contract for the International Carriage of Goods by Road concluded in Geneva on May 19, 1956 and with other international agreements which party the Republic of Moldova is.
These rules govern the relations between operators of mail service who render post services (further – suppliers of post services), and users of these services (further – users), including their rights and obligation, and establish procedure for rendering post services.
2. In these rules the following concepts are used:
the postal address – specifying on mailings which includes set of the following data: surname of person or name of organization, street, house, apartment or number of subscription mailbox, postal index, name of the settlement, country name;
the aerogram – the special envelope intended for sending correspondence in the air way, consisting of one sheet of paper put and stuck on all parties;
the notice on receipt – the form by means of which the addressee of the mailing is invited in department of mail service for its obtaining;
the regulating body – body to which the state trusts the regulation functions falling under operation of the Law on mail service No. 36 of March 17, 2016;
postcard – the open mailing from thin cardboard or strong paper used for different messages;
subscriber mailbox – the special equipment installed in postal department for receipt of the post correspondence addressed to the user;
sekogramma – the sekografichesky mailings submitted openly, cliche with sekografiya signs, the sound records and records on special paper intended only for use by blind persons if they go the organization for blind persons or are addressed to such organization;
the postal index – the designation consisting of certain number of figures and letters, corresponding to each settlement necessary for simplification of sorting of correspondence and providing opportunities of the automated accomplishment of this transaction. postal parcel – the objects having or not having commercial value, sent by means of post networks;
the international commercial correspondence with the answer (CCRI) – the service allowing authorized senders to prepay previously the response departures given by their correspondents living abroad;
the international response coupon – the security issued by Universal Postal Union which serves for exchange for national stamps of the cost sufficient for the minimum prepayment of one simple priority departure of written correspondence or one simple air-letter sent abroad;
mailbox individual – box in which mail is delivered to the house to the sender;
mailbox for letters – box in which the population lowers written correspondence for transfer; Item of access to post network;
personal data – any information which concerns to the identified or identifiable physical person (the subject of personal data);
the receiver – physical person or legal entity to which address the mailing goes;
the document - the letter, the postal parcel or the EMS mail consisting of any the written, drawn, printing or digital data carrier, except for goods products;
the special drawing right (SDR) – the accounting unit of the International Monetary Fund used by member countries of Universal Postal Union in their relations;
EMS (the reduced name of syntagma in English of "Express Mail Service") – post express service for documents and goods which is as far as it is possible, the most bystry of the post services performed by physical means;
integral objects – the envelopes, aerograms or postcards with the brand printed with typographical method constituting whole;
the sender – physical person or legal entity which enters the mailing into post network personally or through the third party;
commodity-transport delivery note – the post accompanying document for post express departures;
"brittle" ("fragil") – special specifying on mailings which assumes special attention to their conversion, transportation and storage;
prepayment – method of confirmation of advance payment of post rates by means of use of the stamps, self-adhesive labels or prints received by printing or stamping;
the service provider of delivery of postal parcels - the physical person or legal entity registered as the entrepreneur which renders one or several services of delivery of postal parcels except for suppliers who provide only national services of delivery of sending within the sales agreement, and as the party of the relevant agreement of the company carry out personal delivery to the user of the goods which are subject of the relevant agreement
the supplier of post services - the physical person or legal entity registered as the entrepreneur which provides one or several post services, and also other accompanying services;
the supplier of universal post service – the supplier of post services who renders services in the field of universal post service;
the printing edition – the mailing which contents are printed or reproduced by common printing method and which is sent from the moment of giving until delivery in open packaging;
storage – the payment levied by suppliers of post services for the mailing which was not demanded by the receiver in the period provided by these rules;
postal order – postal service which feature consists in filling of the form in physical shape based on which, according to specifying of the sender, the transfer and sending sum of money to the receiver is carried out. Transfer can be sent on paper through post network or in electronic form through network of electronic communication;
stamp – the printed valuable sign issued and introduced into circulation it is exclusive the state as the attribute of its sovereignty which is the proof of prepayment according to nominal value in case of its drawing on the mailing according to acts of Universal Postal Union;
goods - departure of written correspondence, postal parcel or the EMS departure representing any physical subject or material, except for money including products of goods which are not brought in the concept "document";
the franking machine – the device for prepayment of mailings by putting down of stamp (drawing signs of post payment according to applicable fares);
clearing – putting down on mailings of print of the calendar postage stamp specifying postal department and date of giving;
postal department – the object of mail service opened for general public for rendering post services;
small packet – the mailing containing different objects or samples of goods, and also the containing goods;
"par avion" – label or the special mark which is put down on the departures sent in the air way;
post envelope – the squared flat subject from paper or other similar material having glued or not glued valve on length of one of the parties intended for its closing;
"post restant" (poste restante) – the additional service permitted for written correspondence (except for the agenda), sending, postal orders which shall be received by receivers in postal department; the mark applied on departures of written correspondence;
hybrid mail – the system combining electronic messages and postal service in case the message is sent by means of system of electronic communication to Item where it is printed out on paper, invests in envelope and is delivered to addressees;
"predare in mina proprie" (to hand personally in hands) - the special mark applied on the registered departures which shall be handed personally to the addressee;
processing of personal data – any transaction or set of the transactions which are carried out concerning personal data by the automated or non-automated means, such, for example, as collection, record, the organization, storage, recovery, adaptation or change, extraction, consultation, use, disclosure by means of transfer, distribution or provisions of other access, grouping or combination, blocking, deleting or destruction;
post network – system of the organization and any possible resources used by the supplier of post service, in particular for:
1) collection of mailings in access Items;
2) sortings in the sorting center and transportations of mailings;
3) deliveries of mailings to the addresses specified them;
"M sacks" – the special sacks containing newspapers, periodicals, books and similar printing documents delivered to the same receiver and to the same address;
services of delivery of postal parcels - the services including collection, sorting, transportation and delivery of postal parcels;
post services – the services intended for the population in collection, packaging (if necessary), to sorting, transportation of mailings and delivery or delivery to their receivers;
the service of departure with the confirmed delivery – post service which feature consists that in case of departure acceptance the receipt is issued to the sender departure is handed to the receiver under list, but at the same time the guarantee from risks of loss, plunder or damage is not provided;
universal post service – provision on permanent basis of post services of certain quality in all settlements in the territory of the country at the prices, available to all users;
subcontractor - the physical person or legal entity registered as the entrepreneur providing collection, sorting, transportation or delivery of postal parcels for the service provider of delivery of postal parcels;
the letter – the closed mailing in envelope by means of which written messages are transferred;
the information system intended for provision of electronic post services - the set of the interdependent information resources and technologies, methods and personnel which are property of the supplier of universal post service, intended for interaction between the supplier of universal post service and users when rendering electronic post services;
post rate – payment on rendering post service;
"taxa-porto" (shortpaid dachshund) – the collection imposed on not prepaid or not completely prepaid departures; the print put on simple not franked or not completely franked mailings;
normative delivery date – time established for transfer of mailings from the place of acceptance to the destination including implementation of transactions on their processing;
avia-departure – the mailing sent by air transport;
land departure – the mailing sent by vehicles by land, to the river or the sea;
not delivered departure – the mailing which it was for various reasons impossible to deliver (to hand) to the addressee and due to the lack of the address of the sender could not be returned it to the sender;
unclaimed departure – the mailing which was not delivered (is handed) to the receiver because of its non-claiming or refusal of its obtaining;
express departure – the mailing which collection, packaging, transfer and delivery are performed by means of physical means by the most bystry method;
the mailing – subject with the address applied on it to which the supplier of post services shall bring him.
