According to Articles 50, of 56, of 57, of 86, of 87, of 93, of 101, 147 Penitentiary codes of Ukraine, order to subitem 95-8 of Item 3 of the Regulations on the Ministry of Justice of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of July 2, 2014 No. 228, for the purpose of timely determination to the convict to imprisonment of type of colony, the direction for serving sentence of persons condemned to lifelong imprisonment, imprisonment for certain term, to arrest and restriction of freedom from pre-trial detention centers in organizations of execution of punishments, establishment of procedure for their transfer in the cases determined by the law:

1. Approve the Procedure for determination condemned type of organization of execution of punishments, the direction for serving sentence of convicts to imprisonment for certain term, lifelong imprisonment, arrest, restriction of freedom and their transfer which is applied.

2. Approve Regulations on the central and interregional commission on questions of determination to the persons condemned to imprisonment of type of organization of execution of punishments, places of serving sentence condemned to imprisonment for certain term, lifelong imprisonment, arrest and restriction of freedom, their direction and transfer for serving sentence which is applied.

3. To department of the public law (Kravchenko L. M.) submit this order for carrying out state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

4. This order becomes effective from the date of its official publication.

5. To impose control of execution of this order on the deputy minister Chernyshev D. V.

Procedure for determination by the convict of type of organization of execution of punishments, the directions for serving sentence of convicts to imprisonment for certain term, to lifelong imprisonment, arrest, restriction of freedom and their transfer  

I. General provisions

1. This Procedure establishes the determination mechanism to the persons condemned to imprisonment of type of organization of execution of punishments, places of serving sentence condemned to imprisonment for certain term, to lifelong imprisonment, arrest and restriction of freedom, their direction and transfer for serving sentence.

2. Type of colony and/or the place of serving sentence to persons condemned to imprisonment for certain term, to lifelong imprisonment, arrest and restriction of freedom are determined by the convict to imprisonment based on Criminal and Criminal and executive codes of Ukraine.

3. The direction for serving sentence of persons condemned to imprisonment for certain term, to lifelong imprisonment, arrest and restriction of freedom, their transfer from one organization of execution of punishments in another are performed according to the Penitentiary code of Ukraine and this Procedure.

4. In this Procedure terms are accepted in the following values:

Administration of the Public criminal and executive service of Ukraine - interregional territorial authority of the Ministry of Justice of Ukraine concerning execution of criminal penalties;

close relatives and family members - the husband, the wife, the father, mother, the stepfather, the stepmother, the son, the daughter, the stepson, the stepdaughter, the brother, the sister, the grandfather, the woman, the great-grandfather, the great-grandmother, the grandson, the granddaughter, the great-grandson, the great-granddaughter, the adoptive father or adopted, the guardian or the custodian, person which is under guardianship or custody and also persons who jointly live are connected by general life and have the mutual rights and obligations, including persons who jointly live, but are not in scrap;

request for the job specification - the document in which surname, the name, middle name of person (persons), the convict(s) to imprisonment for certain term, to lifelong imprisonment, arrest or restriction of freedom, subject (shchy) to the direction in organizations of execution of punishments, and the other information on the convict necessary for determination of type of organization of execution of punishments and the place of serving sentence are entered;

zone of activities of interregional management - administrative and territorial units to which territory powers of the relevant interregional management concerning execution of criminal penalties and probation of the Ministry of Justice extend;

the interregional commission - collegiate organ which is formed in interregional management which within competence determines to the persons condemned to imprisonment type of organization of execution of punishments, the place of serving sentence condemned to imprisonment for certain term, to lifelong imprisonment, arrest and restriction of freedom performs the direction and transfer for serving sentence of convicts to imprisonment for certain term, to lifelong imprisonment and arrest within zone of activities of interregional management;
