About modification and amendments in some orders of the Minister of Finance of the Republic of Kazakhstan

According to Item 1 and 2 of Article 7, Item 9) of Article 5-1, item 4 of article 31 of the Law of the Republic of Kazakhstan of January 6, 2011 "About law-enforcement service", and also Item 14 of the Program of the President of the Republic of Kazakhstan of May 20, 2015 "The plan of the nation - 100 specific steps" I ORDER:

1. Approve the list of some orders of the Minister of Finance of the Republic of Kazakhstan to which changes and additions are made (further - the List), according to appendix to this order.

2. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its official publication;

2) within ten calendar days from the date of state registration of this order the direction in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan.

3. This order becomes effective from the date of its first official publication.

The list of some orders of the Minister of Finance of the Republic of Kazakhstan to which changes and additions are made

1. In the order of the Minister of Finance of the Republic of Kazakhstan of November 17, 2014 No. 498 "About some questions of service in operational investigative divisions of bodies of state revenues (service of economic investigations)" (it is registered in the Register of state registration of regulatory legal acts at No. 9933, it is published in information system of law of Ad_let on December 10, 2014):

in Rules and conditions of carrying out tender and passing of training for holding the posts in operational investigative divisions of bodies of state revenues (service of the economic investigations) approved by the specified order:

4) of Item 9 to exclude the subitem;

state Item 17 in the following edition:

"17. For ensuring transparency and objectivity of work of tender committee, in coordination with the head of body of state revenues, presence at its meeting of observers is allowed.

As observers at meeting of the konkurny commission there can be deputies of Parliament of the Republic of Kazakhstan and maslikhats of all levels, the representatives of mass media accredited according to the Law of the Republic of Kazakhstan "About mass media", other state bodies, public associations (non-governmental organizations), the commercial organizations and political parties, members of Public council concerning public finances, the staff of authorized body for public service.";

add with Item 17-1 of the following content:

"17-1. For presence at meeting of tender committee as the observer person is registered in personnel service of body of state revenues no later than one working day prior to holding interview. For registration person provides in personnel service of body of state revenues the copy of the identity document, originals or copies of the documents confirming belonging to the organizations specified in Item 17 of these rules.";

to state part one of Item 21 in the following edition:

"21. The citizens wishing to take part in tender give to personnel service of the body of state revenues holding competition, the following documents:

1) the statement in form according to appendix 3 to these rules;

2) the filled personal leaf on registration of personnel (with indication of the address of the actual place of residence and contact telephone numbers) in form, according to appendix 4 to these rules;

3) copy of the identity certificate of the citizen of the Republic of Kazakhstan;

4) copies of education documents (diploma and appendix);

5) the copy of the document confirming passing of military service or military preparation in the specialized organizations of the Ministry of Defence of the Republic of Kazakhstan for preparation of the military trained reserve and also release or draft deferment on conscription military service according to the Law of the Republic of Kazakhstan "About military service and the status of the military personnel";

6) photo of 3*4 in size (4 pieces);

7) the completed autobiography written with own hand and in printed form in format A 4, with indication of close relatives, including the former spouses in form according to appendix 5 to these rules;

8) the copy of the document confirming labor activity;

9) certificates of bodies of legal statistics and special accounting of lack of criminal record, attraction within year to the administrative responsibility judicially for making of intentional offense, disciplinary and administrative responsibility for making of corruption offenses;

10) the documents confirming provision by the candidate and his spouse (spouse) for bodies of state revenues at the place of residence of the declaration on the income and property according to the Law of the Republic of Kazakhstan "About anti-corruption";

11) the certificate on passing in authorized body for public service of testing for knowledge of the legislation with results not below threshold values, valid for the moment of submission of documents;

12) the conclusion about passing of personal evaluation in authorized body for public service, valid for the moment of submission of documents for participation in tender.

At the same time the personnel service verifies copies of documents with originals.";

state Item 24 in the following edition:

"24. Materials of tender committee, documents of the participants of tender who received the positive decision of tender committee, and also the statement and other documents of persons which did not undergo competitive selection are stored in personnel service of bodies of state revenues.

In case of the written address of participants of tender, not taken place competitive selection, originals of documents return.";

exclude Chapter 7;

add with Item 45-1 of the following content:

"45-1. The tender committee creates the list of the questions for each announced vacant position set in equal amount to the candidates applying for the same position.";

exclude Item 47;

add with Item 48-1 of the following content:

"48-1. The materials fixed during the interview by means of technical means of record are stored in personnel service of bodies of state revenues at least three months from the moment of tender completion.";

state Item 50 in the following edition:

"50. The decision of tender committee is made in absence of the candidate by open voting.

The commission accepts one of decisions:

To recommend 1) for appointment to the announced vacant position;

2) to refuse appointment to the announced vacant position.";

exclude Item 53.

2. In the order of the Minister of Finance of the Republic of Kazakhstan of December 29, 2015 No. 724 "About approval of the List of executive positions of operational investigative divisions of bodies of state revenues (service of the economic investigations) which are subject to rotation and Rules of their movement" (it is registered in the Register of state registration of regulatory legal acts at No. 12761, it is published in information system of law of Ad_let on January 20, 2016):

in the Rules of movement of staff of operational investigative divisions of bodies of state revenues (service of the economic investigations) holding executive positions, which are subject to rotation, approved by the specified order:

state Item 10 in the following edition:

"10. Approval of the plan is performed at least in three months before the period of carrying out rotation of employees the SIR.".

3. In the order of the Minister of Finance of the Republic of Kazakhstan of December 29, 2015 No. 725 "About some questions of realization of personnel policy in operational investigative divisions of bodies of state revenues (service of economic investigations)" (it is registered in the Register of state registration of regulatory legal acts at No. 12776, it is published in information system of law of Ad_let on February 29, 2016):
