About approval of Rules of competitive selection of territorial clusters

According to the subitem 23) of Item 2 of article 100 of the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015 I ORDER:

1. Approve the enclosed Rules of competitive selection of territorial clusters.

2. To department of strategic planning of the Ministry for Investments and Development of the Republic of Kazakhstan (Bekenov B. T.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let, and also in the Republican center of legal information for entering into reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective from the date of its first official publication and extends to the legal relationship which arose since January 1, 2016.

Rules of competitive selection of territorial clusters

Chapter 1. General provisions

1. These rules of competitive selection of territorial clusters (further - Rules) are developed according to the subitem 23) of Item 2 of article 100 of the Entrepreneurial code of the Republic of Kazakhstan, and determine procedure for competitive selection of territorial clusters.

2. In these rules the following basic concepts and reducings are used:

1) territorial cluster - geographically concentrated group of the interconnected and complementary companies and the organizations which includes producers of final or intermediate goods and services, suppliers of component parts, specialized services, producers of production and other equipment, suppliers of specialized infrastructure, the scientific and research organizations, the organizations of the higher education, the organizations of technical and professional education and other organizations having certain industry specialization;

2) the organizer of competitive selection of territorial clusters (further - the organizer of selection) - authorized body in the field of the state support of industrial activities;

3) participants of competitive selection of territorial clusters (further - participants of selection) - groups of subjects of entrepreneurship, regional chambers of entrepreneurs, social business corporations, managing companies of special economic zones, business associations;

4) commission of experts on competitive selection of territorial clusters (further - the Commission) - the commission created by the decision of the organizer of selection from number of representatives of state bodies, the national companies, National chamber of entrepreneurs of the Republic of Kazakhstan of Atameken;

5) national institute - national institute of development in the field of development of the industry.

Chapter 2. Procedure for competitive selection of territorial clusters

3. The decision on carrying out competitive selection of territorial clusters is made by the organizer of selection.

4. The organizer of selection places the announcement of carrying out competitive selection of territorial clusters in periodic printing editions, and also on the Internet resource.

5. The announcement of carrying out competitive selection of territorial clusters is published at least in 60 (sixty) calendar days prior to the termination of term of order taking for participation in competitive selection of territorial clusters.

6. For participation in competitive selection of territorial clusters, participants of selection submit to the organizer of selection the application for participation in competitive selection of territorial clusters in form, according to appendix 1 to these rules.

7. The following documents are attached to the application for participation in competitive selection of territorial clusters:

1) consent to participation in competitive selection of territorial clusters in form, according to appendix 2 to these rules;

2) the data represented for participation in competitive selection of territorial clusters according to appendix 3 to these rules.

At the same time, the participant of selection provides completeness and reliability of the provided information specified in the request and the enclosed documents for participation in competitive selection of territorial clusters.

8. The application for participation in competitive selection of territorial clusters is submitted on paper in duplicate - the original in number of one copy and the copy in number of one copy, and on the electronic medium.

9. The participant of selection can make changes to the registered application for participation in competitive selection of territorial clusters or withdraw it by the written notice of the organizer of selection before the expiration established for submission of applications for participation in competitive selection of territorial clusters.

10. The application for participation in competitive selection of territorial clusters shall be stitched in one or several folders (volumes) and is numbered. The first the statement and the list of the documents which are part of the request with indication of pages on which there are relevant documents shall be filed. By provision as a part of the request of several folders (volumes) numbers of folders (volumes) and the number of pages in each folder (volume) respectively are specified.

11. The applications for participation in competitive selection of territorial clusters submitted after the expiration for order taking are not accepted and are not considered within the current competitive selection of territorial clusters.

12. The organizer of selection in time no more than 5 (five) working days from the moment of registration of the application for participation in competitive selection of territorial clusters checks the submitted requests for compliance to requirements of these rules and rejects applications for participation in the current competitive selection of territorial clusters, having notified the participant of selection in writing if they do not meet the requirements of these rules.

13. The organizer of selection within 3 (three) working days after the termination of review period of the submitted requests sends to national institute of the application for participation in competitive selection of territorial clusters.

14. The national institute carries out the analysis of the submitted documents regarding compliance to the criteria of competitive selection of territorial clusters specified in appendix 4 to these rules (further - the analysis), and issues the expert opinion.

15. The expert opinion of national institute contains conclusions regarding compliance to the criteria of competitive selection of territorial clusters specified in appendix 4 to these rules and has advisory nature.

16. The analysis and issue of the expert opinion by national institute is performed no more than 60 (sixty) calendar days after the termination of term for order taking for participation in competitive selection of territorial clusters in time.

17. The expert opinion of national institute according to each application for participation in competitive selection of territorial clusters in time no more than 5 (five) working days after the termination of term for carrying out the analysis and issue of the expert opinion is transferred to the organizer of selection.

18. Materials of applications for participation in competitive selection of territorial clusters and the expert opinion of national institute according to each application for participation in competitive selection of territorial clusters by the organizer of selection in time no more than 3 (three) working days are brought in the Commission.

19. The commission makes the decision by determination of winners of competitive selection of territorial clusters.

20. The decision of the Commission made by results of competitive selection of territorial clusters is drawn up by the protocol.

21. The organizer of selection within 3 (three) working days from the date of receipt of the protocol of the Commission announces results of competitive selection of territorial clusters on the Internet resource.

2) availability of the projects directed to lengthening of technological chain (technological chain - the set of the legal entities performing productive and other activity on development, production and promotion of end product of technological chain within complete production cycle arranged in the course of accomplishment of transactions on joint business);

3) availability of additional sources of financing of activities of territorial cluster (investment, own and/or borrowed funds).

4. Structure and specialization of territorial cluster:

1) structure of territorial cluster and партн? rsky bonds out of territorial cluster, the potential of internationalization of territorial cluster;

2) vision of development of cluster: chains of value creation of products, goods and services to whom participants of territorial cluster are provided.

5. Prospects of development of territorial cluster:

2) offers on necessary support of cluster initiatives, with indication of support measures (financial, non-financial measures), the direction of use of measures of supports with reasons, information on common problems (technological, market, administrative) for cluster.

Provision of the following data is in addition possible:

1. Availability of conditions for further development of territorial cluster:

1) necessary raw materials and natural resources (water and land);

2) availability of human resources with required skill level;

3) production capacities (companies) for creation of technological chain and the necessary accompanying services;

4) development of energy infrastructure;

5) development of transport and engineering and communication infrastructure;

6) development of industrial and innovative infrastructure (industrial zones, design offices, technoparks, centers of transfer of technologies);

7) availability of educational, scientific and research infrastructure;

8) availability of international backgrounds, embedding in the international supply chains;

9) financial resources;

2. Compliance of territorial cluster to priorities of the regional, national development strategy and cluster policy of Kazakhstan:

1) national priorities - assessment of conformity of territorial cluster to set of priority sectors according to the State program of industrial and innovative development of the Republic of Kazakhstan for 2020 - 2025 approved by the order of the Government of the Republic of Kazakhstan of December 31, 2019 No. 1050, of the State program of infrastructure development "Nurla жол" for 2020 - 2025, approved by the order of the Government of the Republic of Kazakhstan of December 31, 2019 No. 1055, of the State program of development of agro-industrial complex of the Republic of Kazakhstan for 2017 - 2021 approved by the order of the Government of the Republic of Kazakhstan of July 12, 2018 No. 423;

2) regional priorities - assessment of conformity of territorial cluster to development programs of the territories;

Criteria of competitive selection of territorial clusters

Participation in competitive selection of territorial clusters requires compliance to the following criteria:

1. Level of development of chain of value added:

1) availability of critical mass of the interconnected and complementary companies and the organizations, and also certain level of specialization of MSB;

2) necessary raw materials and natural resources;

3) availability of human resources;

4) production capacities (companies) for creation of technological chain and the necessary accompanying services;

5) development of industrial and innovative infrastructure;

6) development of educational infrastructure.

2. The favorable circle in the region:

1) development of energy infrastructure;

2) development of transport infrastructure;

3) availability of financial resources.

3. Expected social and economic impact of initiative of development of cluster on the region and on industry in which it functions (on the basis of dynamics this the last 5 years) and compliance to national and regional strategy:

1) for the region in which it is located, from the point of view of number occupied, volumes of production at the companies of territorial cluster and amounts of their export;

2) for industry which it treats, in general from the point of view of number occupied, volumes of production at the companies of territorial cluster and amounts of their export.

4. Perspectives of development of cluster, expected indicators of activities taking into account development of the internal, regional and global markets.
