About application of special measures concerning import to Ukraine

This Law for the purpose of introduction of mechanisms of protection of interests of national producer regulates the principles and procedure for excitement and conducting special investigations of the facts of growth of import to Ukraine irrespective of country of source and the commodity export causing significant damage or menacing with causing significant damage to national producer by results of which special measures can be applied.

Section I General provisions

Article 1. Determination of terms

In this Law terms are used in the following value:

1) directly competing goods - goods which directly compete with the goods which are object of special investigation;

2) the exporter - the subject of economic legal relations who exports goods (goods) from the country of export;

3) threat of causing significant damage - inevitable threat of causing significant damage to national producer.

Determination of significant damage shall be based on the facts, but not on mere allegations, assumptions or improbable opportunity;

4) the party interested - any person which notified the central executive body concerning economic policy (further - the Ministry) about the interest in participation in special investigation according to part two of article 9 of this Law and the taking active part in special investigation by representation in writing proofs or the other information sufficient for the purposes of this investigation. Can be concerned parties:

foreign producer, the exporter or the importer of the goods which are object of investigation or consolidation (association) most of which of members is constituted by foreign producers, exporters or importers of the goods which are object of special investigation;

competent authorities of the country of the commodity export which is object of investigation;

national producer, the producer or the wholesale seller of similar goods in Ukraine;

consolidation (association) most of which of members makes or sells wholesale similar goods in Ukraine;
