RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

About further market development of services in the field of labor protection

For the purpose of implementation of the Law of the Republic of Uzbekistan of September 22, 2016 No. ZRU-410 "About modification and amendments in the Law of the Republic of Uzbekistan "About labor protection"", and also the Cabinet of Ministers of the Republic of Uzbekistan decides creations of conditions for development of professional participants of the market of services in the field of labor protection:

1. Approve:

Regulations on procedure for carrying out audit of management system labor protection in the organizations according to appendix No. 2;

Regulations on procedure for retraining and advanced training in the field of labor protection according to appendix No. 3;

Regulations on procedure for conducting state examination of working conditions according to appendix No. 4.

2. To the ministry of employment and employment relationships of the Republic of Uzbekistan:

in a month to open on the official website the separate Section devoted to questions of activities of professional participants of the market of services in the field of labor protection with placement of the complete list of regulatory legal acts and regulating documents in the field of technical regulation concerning labor protection, with ensuring their regular updating;

together with National news agency of Uzbekistan, National broadcasting company of Uzbekistan, the Uzbek agency on seal and information, Chamber of Commerce and Industry to provide wide explanation of the purposes and tasks of this resolution in mass media.

3. This resolution becomes effective after three months from the date of its official publication.

4. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan R. S. Azimov.

Regulations on procedure for carrying out audit of management system labor protection in the organizations

Chapter 1. General provisions

1. This Provision is developed according to the Law of the Republic of Uzbekistan "About labor protection" and determines procedure for carrying out audit of management system labor protection in the organizations.

2. In this Provision the following basic concepts are used:

labor protection - system of legal, social and economic, organizational, technical, sanitary and hygienic, treatment-and-prophylactic, rehabilitation actions and means on safety, preserving life and health, efficiency of the person in the course of work;

management system labor protection - complex of the elements interconnected and interacting among themselves establishing policy and the purpose in area of labor protection at the specific employer, and procedure for achievement of these purposes;

audit of management system labor protection in the organization (further - labor protection audit) - assessment of system of labor protection which is carried out according to the decision of the employer and includes:

determination of compliance of management system labor protection in the organization to requirements of regulating documents in the field of technical regulation and regulatory legal acts concerning labor protection;

quality evaluation of functioning of management system labor protection, efficiency of the held events directed to the prevention, decrease in level of industrial traumatism and occupational diseases;

development of offers and the recommendations submitted on elimination of the revealed shortcomings, injury prevention and professional incidence;

professional participants of the market of services in the field of labor protection - the legal entities rendering services in the field of labor protection on contractual basis;

criteria of audit of labor protection - help data to which data of audit, the politician and the procedure, labor protection action are compared;

independence when carrying out audit of labor protection - the principle of ensuring services with professional participants of the market in the field of labor protection financial, property, related or any not interest of other in relation to the checked subject.

3. Audit of management system labor protection in the organization is booked according to the decision of the employer according to the scheme according to appendix to this Provision and includes:

determination of compliance of management system labor protection in the organization to requirements of regulatory legal acts and regulating documents in the field of technical regulation concerning labor protection, and also to collective agreements, collective agreements and other local regulations;

quality evaluation of functioning of management system labor protection, efficiency of the held events directed to the prevention, decrease in level of industrial traumatism and occupational diseases;

development of offers and the recommendations submitted on elimination of the revealed shortcomings, injury prevention and professional incidence.

4. Audit of labor protection in the organization is performed on the basis of the agreement by the professional participant of the market of services in the field of labor protection included in the Unified register of professional participants of the market of services in the field of labor protection by the form in the services "carrying out audit of labor protection".

5. The organizations in which audit of labor protection is booked and for its results are eliminated all revealed defects (or shortcomings are not revealed), within three next years do not join in lists of the organizations which are subject to the scheduled inspection performed for the purpose of carrying out the state supervision and control of observance of requirements of labor protection.

6. Audit of labor protection is performed on the basis of the principles of independence, objectivity, independence, professional competence and confidentiality.

7. The checked organization shall:

assist auditing organization in timely and complete carrying out audit of labor protection, provide necessary information and documentation, to make at the request of auditing organization explanations in oral and written form on the questions relating to the audit purposes;

not take the deliberate actions directed to narrowing of circle of the questions which are subject to the analysis and assessment when carrying out audit of labor protection and also to concealment (access restriction) of information and documentation on the questions relating to the labor protection audit purposes.

The auditing organization has the right to refuse carrying out audit in case of non-presentation by the organization in which audit of the labor protection necessary for documentation, information or refusal of the organization of providing necessary conditions for carrying out audit is booked.

8. The auditing organization shall:

provide to the checked organization prior to labor protection audit documentary confirmation of full compliance of auditing organization to the requirements regarding implementation of activities for carrying out audit of labor protection established by the legislation;

reflect the facts of violation of requirements of labor protection and the offer on their elimination in the report of audit of labor protection;

provide storage of reports and conclusions on the booked labor protection audits at least five years;

provide at the request of the Ministry of employment and employment relationships of the Republic of Uzbekistan information for rating assessment of the booked labor protection audit;

at the request of the checked organization to provide information on requirements of regulations of the legislation in the field of labor protection on which the booked audit directed to identification of shortcomings on labor protection condition of the checked organization is based.
