About modification of the Regulations on providing the right of persons to access to public information in the National commission performing state regulation in the field of the markets of financial services

According to article 14 of the Law of Ukraine "About access to public information", to the Presidential decree of Ukraine of May 5, 2011 to No. 547 "Questions of ensuring with executive bodies of access to public information", item 4 of the Regulations on the National commission performing state regulation in the field of the markets of financial services, No. approved by the Presidential decree of Ukraine of November 23, 2011 1070, and for the purpose of enhancement of the organization of access to public information, the National commission performing state regulation in the field of the markets of financial services decided:

1. Bring in Regulations on providing the right of persons to access to public information in the National commission performing the state regulation in the field of the markets of financial services approved by the order of Natskomfinuslug of July 17, 2012 No. 594, registered in the Ministry of Justice of Ukraine on August 8, 2012 at change No. 1349/21661, which are applied.

2. Organizational administrative to provide to department together with department of legal providing and maintaining the register of financial institutions submission of this order on state registration in the Ministry of Justice of Ukraine.

3. Organizational administrative to provide to department promulgation of this order after its state registration.

4. This order becomes effective from the date of its official publication.

5. Control over the implementation of this order to leave for the Chairman Natskomfinuslug.

Changes in Regulations on providing the right of persons to access to public information in the National commission performing state regulation in the field of the markets of financial services

1. In Item 1.6 of the Section I of the word "which competence questions of ensuring clerical work enter (further-service of clerical work)" shall be replaced with words "responsible for ensuring access to public information (further - responsible structural division)".

2. In the Section II:

Subitem 2.1.1 of Item 2.1 after the paragraph of third to add 1) with the new paragraph the fourth the following content:

Promulgation and placement on the official site of Natskomfinuslug of the public information prepared and provided by structural divisions of Natskomfinuslug taking into account requirements of the Law of Ukraine "About access to public information" is provided with the structural division responsible for promulgation of information on activities of Natskomfinuslug.

2.4. Information and documents determined by article 15 of the Law of Ukraine "About access to public information" is subject to promulgation on the official site of Natskomfinuslug:

information on organizational structure, mission, function, powers, tasks, activities and financial resources (structure and amount of budgetary funds, procedure and mechanism of their expenditure, etc.);

regulatory legal acts, acts of individual action (except intra organizational) adopted by Natskomfinuslug, drafts of the decisions which are subject to discussion, information on the normative legal basis of activities;

procedure for creation, giving of request for information, appeals of solutions of Natskomfinuslug, actions or failure to act;

information on system of accounting, types of information which is stored by Natskomfinuslug;

the list of data sets which are published in form of open data;

information on mechanisms or procedures by means of which the public can represent the interests or otherwise influences realization of powers of Natskomfinuslug;

plans of carrying out and agenda of the open sessions;

arrangement of places where are provided necessary for Natskomfinuslug requesting forms and forms;

general rules of work of Natskomfinuslug, employment policies and procedures;

reports, including on satisfaction of requests for information;

information on activities of Natskomfinuslug, namely:

location, postal address, office numbers of means of communication, addresses of the official site of Natskomfinuslug and e-mail;

surname, name and middle name, office numbers of means of communication, e-mail addresses of management of Natskomfinuslug, and also heads of independent structural divisions of Natskomfinuslug and their main functions, except cases when these data belong to information with limited access according to part two of article 6 of the Law of Ukraine "About access to public information";

schedule of work and schedule of reception of citizens;

vacancies, procedure and conditions of passing of tender on substitution of vacant positions;

list and conditions of receipt of services of Natskomfinuslug, form and samples of documents, rules of their filling;

system of accounting, types of information which is owned by the subject of powers of authority;

other information about activities of Natskomfinuslug which procedure for obligatory promulgation is established by the Law of Ukraine "About access to public information.".

3. In the Section III:

1) in Item 3.7 of the word "which can be received in Natskomfinuslug and on the official site of Natskomfinuslug of www.nfp.gov.ua in the Section "Access to Public Information" shall be replaced with words "sample of which it is possible to receive in the structural division responsible for access to public information, or on the official site of Natskomfinuslug";

And figures "by phone 234-68-60 and to the fax 235-77-51, and also on the e-mail address of Natskomfinuslug info@nfp.gov.ua" shall be replaced with words 2) in Item 3.8 of the word also in figures "by mail, by phone 234-68-60, by fax 235-77-51, and also on the e-mail address of Natskomfinuslug info@nfp.gov.ua".

4. In the Section V:

1) in Item 5.1 the word "answer" shall be replaced with words "the draft of the answer", "is given the floor" "is going" to replace with the word;

2) in Item 5.5 of the word of "The head Natskomfinuslug or the member Natskomfinuslug according to distribution of functional obligations" shall be replaced with words "Natskomfinuslug's members, the chief of staff Natskomfinuslug according to distribution of obligations and powers";

3) in Item 5.9:

in paragraph one the word "provision" shall be replaced with words "preparation of the project";

to add paragraph two after the word "documents" with the words "and/or information".

5. In the text of the Provision of the word "service of clerical work" in all cases shall be replaced with words "responsible structural division" in the corresponding cases.
