According to part three of article 10 of the Agreement between the Government of Ukraine and the Government of the Republic of Belarus about guarantees of the rights of citizens in the field of provision of pensions of December 14, 1995 (further - the Agreement) the Pension fund of Ukraine and Social Security Fund of the population of the Ministry of social protection of the Republic of Belarus (further - the Parties) agreed about it:
General provisions
According to part three of article 8 of the Agreement in case of resettlement of the pensioner from the territory of one state on the territory of another where under available conditions pension is not provided by the legislation, the state from where the pensioner moved, till that time continues to pay it until he has pension entitlements according to the legislation of the state on which territory he moved.
Transfer of pensions is made by both Parties.
According to article 9 of the Agreement of disability pension and in case of loss of the supporter owing to labor mutilation are appointed and paid according to the legislation of the state in the territory of which the labor injuries, at the expense of means of the relevant Party were sustained.
Disability pensions and in case of loss of the supporter owing to occupational disease are appointed and paid according to the legislation which extended to workers during implementation of labor activity which led to this disease irrespective of in the territory of what state this disease was for the first time revealed, at the expense of means of the relevant Party.
Transfer of pensions is made by both Parties.
Transfer of pensions, is performed only on condition of resettlement of the pensioner from the territory of one state on the territory of another for permanent residence.
