Rules of subsidizing of the losses of carrier connected with implementation of passenger traffic according to socially important messages

1. General provisions

1. These rules of subsidizing of the losses of carrier connected with implementation of passenger traffic according to socially important messages (further - Rules), are developed according to the Law of the Republic of Kazakhstan "About rail transport" and determine procedure and conditions of subsidizing of the losses of carrier connected with implementation of passenger traffic according to socially important messages (further - subsidizing).

2. Losses of the carrier determined by results of tender by the organization of passenger traffic (further - tender) according to socially important messages are subject to subsidizing (further - messages).

3. Act as organizers of carrying out tender:

1) the authorized body enabling according to the legislation of the Republic of Kazakhstan the realization of state policy in the field of transport, coordination, regulation and control of activities of transport complex of the Republic of Kazakhstan (further - authorized body), according to interregional messages;

2) the executive bodies authorized by akimats of the respective areas on the organization of passenger traffic, financed from the regional budget (further - executive bodies), according to interdistrict (long-distance) messages.

2. Procedure for determination of the size of subsidies

4. Interregional messages are determined by the Government of the Republic of Kazakhstan by representation of authorized body, interdistrict (long-distance) and internal messages - local representative and executive bodies.

5. The losses of carrier connected with implementation of transportations in interregional messages taking into account trailer and through-cars are subsidized within the amount provided by the republican budget for the corresponding year.

The losses of carrier connected with implementation of transportations in interdistrict (long-distance) and internal messages are subsidized within the amounts provided by the corresponding local budgets.

Total amount of subsidies for the organization of passenger traffic for messages is provided by annually relevant budget taking into account the list of socially important messages and price level on services of the high-level railway system on the basis of the production indicators determined by Item 6 of these rules.

The authorized body exercising control and regulation in the field of natural monopoly annually in accordance with the established procedure establishes temporary decreasing coefficient to rates (the prices, rates, charges) for services of the high-level railway system for the carriers performing passenger traffic according to messages taking into account the budgetary funds provided on subsidizing for the corresponding year.

The list of trains, the number of trailer and through-cars, frequency of their running in socially important messages, sostavnost of subsidized part of these trains, trailer and through-cars are determined on the basis of the analysis of passenger traffic in the Republic of Kazakhstan which is annually carried out by the representative and executive bodies.

To the carriers providing according to the legislation running as a part of passenger trains, trailer  and through-cars, dining-cars and luggage cars according to socially important messages, the authorized body exercising control and regulation in the field of natural monopolies annually in accordance with the established procedure establishes on run of these cars temporary decreasing coefficient to rates (the prices, rates, charges) for services of the high-level railway system.

6. Calculation of the sizes of subsidies for inclusion in account part of the relevant budget by the administrator of the budget program is made on each passenger train taking into account trailer and through-  cars on the basis of the following production indicators:

1) passenger turnover:

the number of the transported passengers;

average range of trip;

2) freight cars turnover (run of cars):

range of routes;

sostavnost of subsidized part of the train, number of trailer and through-cars and frequency of running;

3) density of population of cars;

4) cost of one passenger-kilometer;

5) profitable rate of one passenger-kilometer;

6) expenses for route:

operating expenses of carrier;

service fee of the high-level railway system;

service fee of locomotive draft.

7) the income for route.
