About approval of the Procedure of customs control and customs clearance of goods using the cargo customs declaration

According to the Customs code of Ukraine and for the purpose of further enhancement and simplification of procedure for customs control and customs clearance of goods using the cargo customs declaration I ORDER:

1. Approve the Procedure of customs control and customs clearance of goods using the cargo customs declaration (further - the Procedure) which is applied.

2. To chiefs of regional customs, customs:

2.1. Provide informing subjects of foreign economic activity on requirements of this order and the Procedure.

2.2. Take measures concerning acceleration and optimization of implementation of customs control and customs clearance of goods using GTD in the way:

organizations of work of divisions of customs clearance for the principle of "single window";

minimization of number of officials who participate in implementation of customs control and customs clearance, and their rational loading.

2.3. The order of customs authority to determine divisions which officials will carry out customs control and customs clearance of goods in the corresponding customs regime and will bear responsibility for accomplishment of the functions established by Procedure.

2.4. Carry out in case of requirement redistribution of the number of staff and means of the computer equipment and communication between divisions of customs.

3. To management of information support and customs statistics (Koposov S.A.) finish the program and information complex "The Automated System of Customs Clearance of Loads" for ensuring implementation of requirements of the Procedure.

4. To department of the organization of customs control (Syomk S. M.) and Legal department (Bozhenko I. F.):

4.1. Provide reduction of the Procedure for filling and use of the Card of the refusal in the omission on customs area of Ukraine or customs clearance of goods and other objects approved by the order of the State Customs Service of Ukraine of 24.04.99 N 239 and registered in the Ministry of Justice of Ukraine 11.05.99 for N300/3593, in compliance to the Customs code of Ukraine.

4.2. Provide provision of this order on state registration in the Ministry of Justice of Ukraine.

5. To department of declaring and customs regimes (Naumenko V. P.) and Management of information support and customs statistics (Koposov S.A.) in two-month time after state registration of this order in the Ministry of Justice of Ukraine to develop and submit for approval to the Chairman of Service the project of the Procedure for cancellation of cargo customs declarations.

6. Consider invalid the order of State Customs Service of Ukraine of 14.10.2002 N 561 "About approval of the Procedure of customs control and customs clearance of goods and other objects using the cargo customs declaration" (with changes and amendments), registered in the Ministry of Justice of Ukraine 07.11.2002 for N 877/7165; to apply other regulatory legal acts of State Customs Service of Ukraine in part which does not contradict the Procedure.

7. In a month after state registration in the Ministry of Justice of Ukraine of this order to provide to chiefs of departments, managements within the competence introduction of amendments to orders of State Customs Service of Ukraine for the purpose of implementation of requirements of this Procedure.

8. Determine that this order becomes effective from day of its official publication.

Procedure of customs control and customs clearance of goods using the cargo customs declaration

1. General provisions

1.1. This Procedure is developed according to the Customs code of Ukraine, Regulations on the cargo customs declaration approved by the resolution the Cabinet of Ministers of Ukraine of 09.06.97 N 574 (with changes and amendments), and for the purpose of simplification and optimization of procedure for customs control and customs clearance of goods using the cargo customs declaration (further - GTD).

1.2. This Procedure is applied when implementing customs control and customs clearance of the goods declared with use of the customs declarations determined by the Qualifier of types of declarations approved by State Customs Service when placing goods in any customs regime (taking into account the features established for separate customs regimes, methods of movement of goods, types of declarations, and also for the resident companies concerning which customs authorities establish high (entered in "the white list") or sufficient (entered in "the green list") level of credibility).

1.3. In this Procedure terms are used in the values determined by the legislation of Ukraine.
