About introduction of amendments to some acts of the Government of the Russian Federation

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation.

2. This resolution becomes effective since October 1, 2017, except for Items 2 - 4, subitems "v" and "g" of Item of 5 changes approved by this resolution which become effective since July 1, 2018.

3. Determine that till July 1, 2018 when conducting planned inspections concerning the objects referred to the I category according to criteria of reference of the objects making negative impact on the environment, to objects I, II, III and IV of categories, approved by the order of the Government of the Russian Federation of September 28, 2015 No. 1029 "About approval of criteria of reference of the objects making negative impact on the environment to objects I, II, III and IV of categories", requirements of Items 13 (2) - 13(5) Regulations on the state supervision of geological studying, rational use and protection of subsoil, No. 293 approved by the order of the Government of the Russian Federation of May 12, 2005 "About approval of the Regulations on the state supervision of geological studying, rational use and protection of subsoil" are not applied (in edition of this resolution), Items 10 (1) - 10(4) Regulations on the state supervision in the field of protection of the atmospheric air approved by the order of the Government of the Russian Federation of June 5, 2013 No. 476 "About questions of the state control (supervision) and recognition voided some acts of the Government of the Russian Federation" (in edition of this resolution), Items 11 (1) - 11(4) Regulations on the state supervision in the field of use and protection of water objects approved by the order of the Government of the Russian Federation of June 5, 2013 No. 476 "About questions of the state control (supervision) and recognition voided some acts of the Government of the Russian Federation" (in edition of this resolution), Items 9 (1) - 9(4) Regulations on federal state ecological supervision, No. 426 approved by the order of the Government of the Russian Federation of May 8, 2014 "About federal state ecological supervision" (in edition of this resolution), Items 7 (1) - 7(4) Regulations on the state land supervision, No. 1 approved by the order of the Government of the Russian Federation of January 2, 2015 "About approval of the Regulations on the state land supervision" (in edition of this resolution).

4. Determine that till July 1, 2018 Items 9 (1) - 9(4) Regulations on federal state ecological supervision, No. 426 approved by the order of the Government of the Russian Federation of May 8, 2014 "About federal state ecological supervision" (in edition of this resolution), are not applied when implementing the state ecological supervision on the continental shelf of the Russian Federation, the state ecological supervision in internal sea waters and in the territorial sea of the Russian Federation, the state ecological supervision in exclusive economic zone of the Russian Federation, the state ecological supervision in the field of protection of Lake Baikal, federal state control (supervision) in the field of fishery and preserving water biological resources in especially protected natural territories of federal importance.

Changes which are made to acts of the Government of the Russian Federation

1. The regulations on the state supervision of geological studying, rational use and protection of subsoil approved by the order of the Government of the Russian Federation of May 12, 2005 No. 293 "About approval of the Regulations on the state supervision of geological studying, rational use and protection of subsoil" (The Russian Federation Code, 2005, No. 20, Art. 1885; 2010, No. 6, Art. 651; 2013, No. 24, of the Art. 2999) to add with Items 13 (2) - 13(5) following contents:

"13(2). The officials exercising the state geological supervision when conducting planned inspection shall use checking sheets (lists of control questions).

13(3). Use of checking sheets (lists of control questions) is performed when conducting planned inspection of all legal entities and individual entrepreneurs.

13(4). Checking sheets (lists of control questions) used when conducting planned inspection contain the questions mentioning the mandatory requirements shown to the legal entity and the individual entrepreneur which observance is the most significant from the point of view of non-admission of emergence of threat of damnification of life, to health of citizens, harm to animals, plants, the environment, objects of cultural heritage (historical and cultural monuments), safety of the state, and also threat of emergency situations of natural and technogenic nature.

13(5). The subject of scheduled inspection of legal entities and individual entrepreneurs is limited to the list of the questions included in checking sheets (lists of control questions).".

2. The regulations on implementation of federal state forest supervision (forest protection) approved by the order of the Government of the Russian Federation of June 22, 2007 No. 394 "About approval of the Regulations on implementation of federal state forest supervision (forest protection)" (The Russian Federation Code, 2007, No. 27, Art. 3282; 2009, No. 10, Art. 1224; 2010, No. 14, Art. 1653; 2011, No. 7, Art. 981; No. 17, Art. 2417; 2012, No. 24, Art. 3175; No. 46, Art. 6339; 2013, No. 24, Art. 2999; 2015, No. 5, of the Art. 842) to add with Items 12 (1) - 12(4) following contents:

"12(1). The officials exercising federal state forest supervision (forest protection) when conducting planned inspection shall use checking sheets (lists of control questions).

12(2). Use of checking sheets (lists of control questions) is performed when conducting planned inspection of all legal entities and individual entrepreneurs.

12(3). 3. The regulations on the state supervision in the field of protection and use of especially protected natural territories of federal importance approved by the order of the Government of the Russian Federation of December 24, 2012 No. 1391 "About the state supervision in the field of protection and use of especially protected natural territories of federal importance" (The Russian Federation Code, 2012, No. 53, Art. 7946; 2015, No. 30, of the Art. 4595) to add with Items 8 (1) - 8(4) following contents:

"8(1). The officials specified in items 4 and the 5th this provision when conducting planned inspection shall use checking sheets (lists of control questions).

8(2). Use of checking sheets (lists of control questions) is performed when conducting planned inspection of all legal entities and individual entrepreneurs.

8(3). Checking sheets (lists of control questions) used when conducting planned inspection contain the questions mentioning the mandatory requirements shown to the legal entity and the individual entrepreneur which observance is the most significant from the point of view of non-admission of emergence of threat of damnification of life, to health of citizens, harm to animals, plants, the environment, objects of cultural heritage (historical and cultural monuments), safety of the state, and also threat of emergency situations of natural and technogenic nature.

4. The regulations on federal state hunting supervision approved by the order of the Government of the Russian Federation of January 25, 2013 No. 29 "About federal state hunting supervision" (The Russian Federation Code, 2013, No. 5, Art. 374; 2015, No. 28, of the Art. 4238) to add with Items 9 (1) - 9(4) following contents:

"9(1). Officials of state supervision bodies (the state inspectors in the field of environmental protection) when conducting planned inspection shall use checking sheets (lists of control questions).

9(2). Use of checking sheets (lists of control questions) is performed when conducting planned inspections of all legal entities and individual entrepreneurs.

9(3). Checking sheets (lists of control questions) used when conducting planned inspection contain the questions mentioning the mandatory requirements shown to the legal entity and the individual entrepreneur which observance is the most significant from the point of view of non-admission of emergence of threat of damnification of life, to health of citizens, harm to animals, plants, the environment, objects of cultural heritage (historical and cultural monuments), safety of the state, and also threat of emergency situations of natural and technogenic nature.

5. In the order of the Government of the Russian Federation of June 5, 2013 No. 476 "About questions of the state control (supervision) and recognition voided some acts of the Government of the Russian Federation" (The Russian Federation Code, 2013, No. 24, Art. 2999; 2014, No. 13, Art. 1484):

a) To add the regulations on the state supervision in the field of protection of atmospheric air approved by the specified resolution with Items 10 (1) - 10(4) following contents:

13(2). Use of checking sheets (lists of control questions) is performed when conducting planned inspection of all legal entities and individual entrepreneurs.

13(3). 11(2). Use of checking sheets (lists of control questions) is performed when conducting planned inspection of all legal entities and individual entrepreneurs.

11(3). The regulations on federal state ecological supervision approved by the order of the Government of the Russian Federation of May 8, 2014 No. 426 "About federal state ecological supervision" (The Russian Federation Code, 2014, No. 20, Art. 2535; 2016, No. 45, of the Art. 6267) to add with Items 9 (1) - 9(4) following contents:

"9(1). When conducting planned inspection the officials specified in Item 6 of this provision shall use checking sheets (lists of control questions).

The regulations on the state land supervision approved by the order of the Government of the Russian Federation of January 2, 2015 No. 1 "About approval of the Regulations on the state land supervision" (The Russian Federation Code, 2015, No. 2, Art. 514; 2016, No. 12, Art. 1666; 52, the Art. 7638) to add No. with Items 7 (1) - 7(4) following contents:

"7(1). Officials of Federal Registration Service, Federal Service for Veterinary and Phytosanitary Surveillance and Federal Nature Management Supervision Service when conducting planned inspection shall use checking sheets (lists of control questions).
