About approval of the Procedure for issue of certificates of the salary for purpose of pensions to separate categories of persons in case of liquidation of state bodies in which persons worked, and also renaming (absence) of their positions
According to Items 10 and 12 of the Section XI "Final and transitional provisions" of the Law of Ukraine of December 10, 2015 to No. 889-VIII "About public service", to Item 6 of the Procedure for the purpose of pensions to some categories of persons approved by the resolution of the Cabinet of Ministers of Ukraine of September 14, 2016 No. 622 "Some questions of provision of pensions of separate categories of persons" I order:
1. Approve the Procedure for issue of certificates of the salary for purpose of pensions to separate categories of persons in case of liquidation of state bodies in which persons worked and also renaming (absence) of their positions which is applied.
2. To department of provision of pensions (Kudin V. A.) provide submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.
3. This order becomes effective from the date of its official publication.
4. To impose control of execution of this order on the deputy minister of social policy of Ukraine according to distribution of obligations.

1. This Procedure No. 889-VIII "About public service" is developed according to Items 10 and 12 of the Section XI "Final and transitional provisions" of the Law of Ukraine of December 10, 2015 (further - the Law No. 889) and in pursuance of Item 6 of the Procedure for the purpose of pensions to some categories of persons approved by the resolution of the Cabinet of Ministers of Ukraine of September 14, 2016 No. 622 "Some questions of provision of pensions of separate categories of persons" (further the Procedure for No. 622).
2. The certificate of the salary for award of pension (further - the reference for award of pension) according to article 37 of the Law of Ukraine of December 16, 1993 No. 3723-XII "About public service" is issued to persons who have the right to award of pension according to Item 3 of the Procedure No. 622.
3. In case of liquidation of state body without legal successor or if place of employment of person as public service, in body which at the time of appointment to person of pension is absent or in which at the time of award of pension are renamed there (are) no positions, including there are no corresponding positions of public service, references for award of pension issue:
The ministry of social policy of Ukraine - to persons taking place of employment as public service in state bodies which jurisdiction extended to all territory of Ukraine (except the National Bank of Ukraine);
The National Bank of Ukraine - to persons who have the last place of employment to positions of public service in organizations, branches and representative offices of the National Bank of Ukraine;
structural divisions concerning social protection of the population of regional, district, district public administrations in the city of Kiev, executive bodies city, district in the cities (in case of education) councils - to persons who have the last place of employment to positions of public service in the relevant state bodies which jurisdiction extended to the territory of one or several areas, Kiev or Sevastopol, one or several areas, cities of regional value, and local government bodies.
4. For provision of references for award of pension are considered:
1) official pay rate and the allowance for rank - in the sizes operating on the date of the request for award of pension of the working government employee of the corresponding position and rank on the last place of employment and post in public service to which positions of employees of the liquidated state bodies, according to lists are equated:
positions and to resolutions of the Cabinet of Ministers of Ukraine according to which official pay rates of employees of state bodies which are given in appendix 1 to this Procedure affirmed;
positions and regulatory legal acts according to which official pay rates of employees of organizations and organizations before entry into force of the Law No. 889, which are given in appendix 2 to this Procedure affirmed;
positions and resolutions of the Cabinet of Ministers of Ukraine according to which official pay rates of employees of state bodies which positions in connection with entry into force of the Law No. 889 do not belong to positions of public service affirmed are given in appendix 3 to this Procedure;
positions and resolutions of the Cabinet of Ministers of Ukraine and resolutions of board of the National Bank of Ukraine according to which official pay rates of employees of the National Bank of Ukraine which have years of service of 20 years are given on the positions carried to positions of public service which positions after entry into force of the Law No. 889 do not belong to positions of public service referred to category of positions of public service in appendix 4 to this Procedure;
2) length-of-service allowance - at the level of 3 percent of official pay rate on the equated position of public service for each calendar year of years of service of public service for the period of award of pension, but no more than 50 percent of official pay rate;
3) award - in the amount of 10 percent of official pay rate on the equated position of public service;
4) the monetary assistance which is provided to annual main paid leave to government employees, - in the amount of 1/12 amounts of the sizes of official pay rate, allowances for rank and length of service, awards determined according to subitems 1 - 3 presents of Item;
5) the allowance to official pay rate for work in the conditions of regime restrictions depending on degree of privacy of information - in the sizes determined by the legislation (in case of establishment).
5. References for award of pension are issued in forms of certificates of the salary for award of pension by the government employee approved by the resolution of board of the Pension fund of Ukraine of January 17, 2017 No. 1-3, registered in the Ministry of Justice of Ukraine on February 8, 2017 at No. 180/30048.
6. If person worked for positions of public service after May 1, 2016 in state body which is liquidated without legal successor, or in body which at the time of appointment to person of pension is absent or in which at the time of award of pension there are no positions of public service, the reference for award of pension is issued by the bodies provided by paragraphs the second - the fourth Item 3 presents of the Procedure, according to Items 4, 5 Procedures No. 622.
7. In case of absence or renaming (absence) in state body of position which was the last which person occupied in public service its position is determined by this body according to appendix 1 to this Procedure or in the corresponding category, subcategory taking into account jurisdiction of state body.
In case of absence or renaming in state body of position of public service which was the last which person occupied in public service after May 1, 2016 its position is determined by this body according to appendix 1 to this Procedure.
The reference for award of pension is issued by state body in which person, according to Items 4, 5 Procedures No. 622 worked.
8. For receipt of the reference the following documents are submitted:
statement;
the document confirming absence in state body of position of public service, liquidation of state body;
references from archive organization in which documents of the liquidated state bodies are stored or other body (the organization, organization) in which, (which) stores documents on the salary, on the sizes of official pay rate, allowances for rank and length of service on the date of dismissal from position of public service (the termination of public service), allowances to official pay rate for work in the conditions of regime restrictions depending on degree of privacy of information, and also other payments in case of their availability - in case, the stipulated in Item 6 presents About.
9. If the state body which for person was the last place of employment in public service is in temporarily occupied territory or in the settlement in the territory of which public authorities temporarily do not perform the powers, or is registered on the under control Ukrainian power of the territory within Ukraine, but actually did not begin the activities, references for award of pension issue structural divisions concerning social protection of the population of regional, district, district public administrations in the city of Kiev, executive bodies city, district in the city (in case of education) councils on the place of the actual accommodation on the under control Ukrainian power of the territory within Ukraine.
The salary size for purpose of pensions to such persons is determined according to subitems 1 - the 5th item 4 of this Procedure.
10. If the state body is in liquidation stage, the reference is issued by liquidation commission.
