About questions of prevention of neglect and offenses of minors

Based on Article part ten 20, of parts one and the seventeenth article 22 of the Law of the Republic of Belarus of May 31, 2003 No. 200-Z "About bases of system of prevention of neglect and offenses of minors" and subitem 9.4 of Item 9 of the Regulations on the Ministry of Internal Affairs of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 4, 2007 No. 611, the Ministry of Internal Affairs of the Republic of Belarus DECIDES:

1. Establish the list of the objects and substances prohibited to storage and use by the minors which are in receivers distributors for minors according to appendix.

2. Approve:

The instruction about procedure for the organization of activities of law-enforcement bodies for prevention of neglect and offenses of minors (is attached);

The instruction about procedure for the organization of activities of receivers distributors for minors (is attached).

3. Recognize invalid:

the resolution of the Ministry of Internal Affairs of the Republic of Belarus of November 19, 2012 No. 407 "About approval of the Instruction about procedure for the organization of activities of law-enforcement bodies for prevention of neglect and offenses of minors" (The national legal Internet portal of the Republic of Belarus, 27.02.2013, 8/26930);

the resolution of the Ministry of Internal Affairs of the Republic of Belarus of March 3, 2014 No. 62 "About modification of the Instruction about procedure for the organization of activities of law-enforcement bodies for prevention of neglect and offenses of minors" (The national legal Internet portal of the Republic of Belarus, 01.04. 2014, 8/28494).

4. This resolution becomes effective since July 1, 2017.

The list of the objects and substances prohibited to storage and use by the minors which are in receivers distributors for minors

1. The food requiring heat treatment (packaged soups, porridges, grain, meat, fish and another), the products which are subject to storage at low temperatures (no more than +6 °C), and foodstuff with the limited term of realization (less than 7 hours), the products packed into iron or glass container, and also all products expired or with date of production which cannot be determined products of house preparation.

2. Alcoholic, low alcohol beverages or beer, tobacco products, electronic cigarettes.

3. Firearms of any kind, gas weapon, ammunition of any kind or explosives (or their simulators or models).

4. Flammable substances.

5. Aerosol barrels with irritant action substances.

6. Cold weapon, the pricking, cutting, cutting objects (or their simulators or models).

7. Chemical and toxic agents.

8. Drugs, psychotropic substances, their precursors and analogs, the toxic or other stupefying substances.

9. Sound recording devices.

10. Photo and video recorders.

11. Means of mobile and other communication.

12. Any data carriers (stores on hard magnetic drives, floppy-disk stores, USB, compact disks and so forth).

13. Electronic equipment of the hidden carrying.

14. Personal computers, including portable, electronic tablets, electronic notebooks.

15. Copy and multiplying equipment.

16. Scanners.

17. The devices used for transfer and acceptance of data on wire and wireless channels of communication.

18. Any tools capable to do harm (hammers, mounts and so forth).

The instruction about procedure for the organization of activities of law-enforcement bodies for prevention of neglect and offenses of minors

Chapter 1. General provisions

1. This Instruction determines procedure for the organization of activities of law-enforcement bodies (further, unless otherwise specified, – Department of Internal Affairs) by prevention of neglect and offenses of minors, procedure for carrying out personal inspection of minors and examination of their things, procedure for transfer to parents (adoptive parents, adopters) (further – parents), to guardians or custodians of minors or representatives of the state organizations of health care, the social and pedagogical organizations, special teaching and educational facilities, special medical and educational facilities withdrawn from minor objects and substances.

2. Department of Internal Affairs perform activities for prevention of neglect and offenses of minors according to the Law of the Republic of Belarus "About bases of system of prevention of neglect and offenses of minors", the Law of the Republic of Belarus of July 17, 2007 No. 263-Z "About law-enforcement bodies of the Republic of Belarus", other acts of the legislation.

3. In this Instruction terms in the values established by the Law of the Republic of Belarus "About bases of system of prevention of neglect and offenses of minors" are used.

Chapter 2. Carrying out individual scheduled maintenance concerning minors and their parents who do not perform or inadequate image fulfill duties on education and content of minors

4. Individual scheduled maintenance concerning the minors specified in paragraph nine of article 21 of the Law of the Republic of Belarus "About bases of system of prevention of neglect and offenses of minors" (further, unless otherwise specified, - minors), their parents who do not perform or inadequate image fulfill duties on education and content of minors, carry out inspectorates for cases of minors (further, unless otherwise specified, - inspections) in interaction with other divisions of Department of Internal Affairs.

5. Individual scheduled maintenance concerning the minors containing in special teaching and educational facilities and special medical and educational facilities is carried out by inspectorates for the location of these organizations.

6. During individual scheduled maintenance with minors of inspection in interaction with other divisions of Department of Internal Affairs:

6.1. find out conduct of life and behavior of the minor;

6.2. explain to minors and their parents, guardians or custodians of effect of making of offenses;

6.3. establish no more than ten days of circumstance connected with acquisition or consumption by minors of drugs, psychotropic substances, their analogs, the toxic or other stupefying substances, the use of alcoholic, low alcohol beverages or beer in time;

6.4. reveal within competence of the minors needing the state protection or left without care of parents, guardians or custodians. If necessary constitute:

the act of detection of the thrown child in form according to appendix 1 in triplicate. The first copy of the act of detection of the thrown child is transferred together with the child. The second copy – within three days goes to guardianship and custody body in the place of the actual finding of the child. The third copy – is stored in inspection within two years then it is destroyed in accordance with the established procedure;

the direction in the social and pedagogical center for form according to appendix 2.

7. During individual scheduled maintenance concerning parents who do not perform or inadequate image fulfill duties on education and content of minors, inspections in interaction with other divisions of Department of Internal Affairs perform the actions directed to the termination of their negative impact on minors.

8. Concerning minors, their parents who do not perform or inadequate image the stipulated in Article 6 Laws of the Republic of Belarus "About bases of system of prevention of neglect and offenses of minors" fulfill duties on education and content of minors, within five days from the date of receipt of documents, the control card in form according to appendix 3 is started.

9. One control card is started in the relation:

9.1. the minor and his parents who do not perform or inadequate image fulfill duties on education and content of the minor;

9.2. the minors containing in special teaching and educational facilities or special medical and educational facilities.

10. In the control card in chronological procedure are located:

10.1. the documents which formed the basis for carrying out individual scheduled maintenance, the stipulated in Article 6 Laws of the Republic of Belarus "About bases of system of prevention of neglect and offenses of minors";

10.2. the certificate of adjusting data of the minor in form according to appendix 4;

10.3. information on persons with whom the minor maintains the friendly relations, in form according to appendix 5. Concerning the minors containing in special teaching and educational facilities or special medical and educational facilities, the specified information is not located;

10.4. leaf of control of individual scheduled maintenance on form according to appendix 6, in which at least once a month data on the held events of individual scheduled maintenance with the minor and his parents who do not perform are entered or in an inadequate way fulfill duties on education and content of minors. The leaf of control of individual scheduled maintenance is not located on the minors containing in special teaching and educational facilities or special medical and educational facilities, results of the specified work are drawn up monthly in the form of the generalized reference;

10.5. other documents specified in this Instruction and connected with carrying out individual scheduled maintenance concerning the minor of his parents who do not perform or fulfill inadequate image duties on education and content of minors.

11. Parents, guardians or custodians of minors with whom inspectorates carry out individual scheduled maintenance have the right:

11.1. participate in carrying out the individual scheduled maintenance which is carried out by inspection concerning their minor children;

11.2. perform statements from the control cards started concerning their minor children, get acquainted with the materials which are in them if it does not affect the right, freedoms and (or) legitimate interests of other persons and do not contain in materials the data constituting the state secrets, the commercial and (or) protected by the law other secret.

12. Before carrying out individual scheduled maintenance of inspection:

12.1. within five days after receipt of the documents specified in article 6 of the Law of the Republic of Belarus "About bases of system of prevention of neglect and offenses of minors":

register minors and their parents who do not perform or in an inadequate way fulfill duties on education and content of minors, in the magazine of persons concerning whom the inspectorate for cases of minors carries out individual scheduled maintenance, in form according to appendix 7. At the same time the sequence number of the log entry of persons concerning whom the inspectorate for cases of minors carries out individual scheduled maintenance shall correspond to number of the control card;

inform the interested divisions of Department of Internal Affairs on the beginning of carrying out individual scheduled maintenance;
