For the purpose of execution of Item 3.5 of the Presidential decree of the Azerbaijan Republic of December 27, 2016 No. 1180 "About application of the Law of the Azerbaijan Republic "About the government budget of the Azerbaijan Republic for 2017", the Cabinet of Ministers of the Azerbaijan Republic decides:
Make the following changes to "The rule of management, accounting and use of the fund of debt collateral received under the state guarantee", approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of April 10, 2008 No. 84 (Collection of the legislation of the Azerbaijan Republic, 2008, No. 4, Article 306; 2009, No. 11, Article 936; 2017, No. 3, Article 503):
1. In Item 2.3 after words of "the amount of general guarantee" to add with the words "less 0,5 (zero whole five tenth) percent and".
2. In Item 3.2 of the word "Powers on Use according to These Rules" shall be replaced with words "Powers on use according to requirements of Rules".
3. Give Item 3.3 in the following edition:
"3.3. If the main borrower of the debt obligation provided with the state guarantee cannot fulfill fully or partially debt obligation or perform it in accordance with the established procedure and in case of threat of approach of default and the requirement of accomplishment of obligation fulfillment by the guarantor, according to provisions of the provided state guarantee accomplishment of the obligation is provided with observance of requirements of Items 3.2 and 3.5 of these rules at the expense of the means which are saved up in Fund within one fiscal year.".
