About approval of the Regulations on passing of military service (training) by the military personnel of Public service of special communication and information security of Ukraine

According to part two of article 11 of the Law of Ukraine "About Public service of special communication and information security of Ukraine" I decide:

1. Approve Regulations on passing of military service (training) by the military personnel of Public service of special communication and information security of Ukraine it (is applied).

2. Ceased to be valid according to the Presidential decree of Ukraine of 27.09.2021 No. 486/2021

3. This Decree becomes effective from the date of its publication.

Regulations on passing of military service (training) by the military personnel of Public service of special communication and information security of Ukraine

I. General provisions

1. This Provision determines procedure for passing by citizens of Ukraine (further - citizens) military service (training) in Public service of special communication and information security of Ukraine (further - Gosspetssvyaz).

2. Citizens pass military service (training) in the contract in Gosspetssvyaz in voluntary procedure.

Citizens who pass military service in Gosspetssvyaz are military personnel of Gosspetssvyaz (further - the military personnel).

3. Citizens pass in Gosspetssvyaz:

military service (training) of cadets organization of formation of Gosspetssvyaz;

military service under the contract of faces of ordinary structure;

military service under the contract of faces of sergeant and foreman structure;

military service under the contract of faces of officers;

military service on mobilization, for the special period.

4. Citizens who voluntarily enlist (training) in the contract in Gosspetssvyaz have obligatory medical examination and professional and psychological selection according to the procedure which affirms Administration of Gosspetssvyaz in coordination with the central executive body in the field of health protection.

Concerning candidates for occupation of military positions special inspection according to the procedure, established by the law is carried out.

For Gosspetssvyaz fitting with the military personnel candidates for occupation of the military positions connected with accomplishment organizational and administrative or administrative type duties, are accepted to such positions in case:

emergence of the crisis situation menacing to homeland security of Ukraine - before receipt of results of special check;

announcements of the decision on carrying out mobilization and (or) introduction of legal regime of warlike situation - without conducting special check.

5. The citizens for the first time enlisting take Military oath of allegiance to the Ukrainian people.

6. The beginning of suspension and the end of passing of military service, terms of military service, age limit of stay on it are determined by the Law of Ukraine "About conscription and military service".

7. Day of transfer of the serviceman in lists of staff of Gosspetssvyaz day of position assignment is considered.

The end of passing of military service day of exception of the serviceman of lists of staff of Gosspetssvyaz in connection with its dismissal from military service in inventory or in resignation, death (death) is considered, recognition by court it is unknown absent or the announcement the dead.

8. Aggregate term of military service is established in calendar calculation, and in the cases determined by the legislation - in preferential calculation.

9. The military personnel elected People's Deputies of Ukraine, deputies of the Verkhovna Rada of the Autonomous Republic of Crimea or elected to elective offices in local councils on which they work at permanent basis (further - the military personnel elected to elective offices), in the procedure established by the legislation will be attached to the Verkhovna Rada of Ukraine, the Verkhovna Rada of the Autonomous Republic of Crimea or in the relevant local councils with their leaving on military service.

10. The military personnel can be directed for further passing of military service to other military forming with their exception of lists of staff of Gosspetssvyaz, and the military personnel of other military forming can be accepted on military service under the contract to Gosspetssvyaz with their inclusion in lists of staff of Gosspetssvyaz after their exception of lists of staff of other military forming.

The direction of the military personnel from Gosspetssvyaz for further passing of military service to other military forming or from other military forming to Gosspetssvyaz is performed in coordination with the Chairman of Gosspetssvyaz and the corresponding heads of other military forming with the consent of the military personnel.

11. On the military personnel personal records according to the procedure and in form, established by Administration of Gosspetssvyaz are created.

12. Establishment, change or the termination of legal relations of the military personnel with the state, in particular their transfer in lists of staff of Gosspetssvyaz or exception of such lists, the conclusion and the termination (termination) of the contract, prolongation of its term, assignment of military ranks and lowering in military ranks, application of encouragement, imposing of authority punishments, appointment to positions and release from positions, movement on service, acceptance and dismissals from military service, leaving on military service over age limit of stay on military service, provision of leaves, the direction in official journeys, are drawn up by orders based on documents which types and form are established by Administration of Gosspetssvyaz.

13. The Chairman of Gosspetssvyaz, chiefs of territorial authorities of Administration of Gosspetssvyaz, territorial subdivisions, Head department and divisions of government courier communication, organizations and organizations of Gosspetssvyaz have the right to issue orders on staff (further - divisions of Gosspetssvyaz).

14. The status of the serviceman is confirmed by the official ID.

The form and procedure for issue of official IDs are established by Administration of Gosspetssvyaz.

II. Acceptance on military service (training) in the contract

15. On military service under the contract citizens according to articles 19 and 20 of the Law of Ukraine "About conscription and military service" are accepted.

The procedure for completing of Gosspetssvyaz by staff is established by Administration of Gosspetssvyaz.

16. The contract - the written agreement between the citizen and the state on behalf of which acts Gosspetssvyaz, establishing legal relations between the specified parties is signed with the citizen who enlists.

Such contract types can be concluded with the citizen who enlists:

the contract on passing by citizens of Ukraine of military service in Public service of special communication and information security of Ukraine on positions of faces of ordinary structure (appendix 1);

the contract on passing by citizens of Ukraine of military service in Public service of special communication and information security of Ukraine on positions of faces of sergeant and foreman structure (appendix 2);

the contract on passing by citizens of Ukraine of military service in Public service of special communication and information security of Ukraine on positions of faces of officers (appendix 3);

contract on passing of military service (training) by cadets of organization of formation of Public service of special communication and information security of Ukraine (appendix 4).

17. The right to the conclusion of contracts on passing of military service and the contract on training is provided:

1) to the Chairman of Gosspetssvyaz - with all military personnel, and also with citizens who are accepted on military service under the contract for positions of faces of ordinary structure, sergeant and foreman structure, officers;

2) to vice-chairmen of Gosspetssvyaz - with cadets about passing of military service on positions of faces of officers after the termination organization of formation of Gosspetssvyaz;

3) to chiefs of divisions of Gosspetssvyaz - with the military personnel passing military service under the contract in these divisions on positions of faces of ordinary structure, sergeant and foreman structure, officers, on which the state (staff list) the provided limiting military ranks to the lieutenant colonel inclusive, and also with the citizens accepted on military service to the specified positions under the contract;

4) to the chief organization of formation of Gosspetssvyaz - with the cadets accepted on training.

18. The body in which the citizen stays on the military registry is in accordance with the established procedure informed on acceptance of the citizen who stays on the military registry as the recruit or the person liable for call-up on military service under the contract.

19. For citizens of Ukraine who are accepted on military service under the contract and are appointed to positions, the following terms of military service in calendar calculation are established:

1) for faces of ordinary structure - 3 years;

2) for faces of sergeant and foreman structure - from 3 to 5 years;

3) for cadets of organization of formation of Gosspetssvyaz - training time in organization of formation of Gosspetssvyaz;

3-1) for the military personnel who graduated from organizations of professional prehigher military education, the highest military educational institutions, military educational units of higher educational institutions and received the level of professional prehigher military education according to the program of preparation for passing of military service on positions of faces of sergeant and foreman structure - 5 years;

4) for faces of officers from number:

citizens to whom primary military rank is given after passing of full course of military preparation according to the program of training of reserve officers or according to the procedure of certification of persons before assignment of primary military ranks of officers of inventory, - from 2 to 5 years;

the military personnel who finished the highest military educational institutions and military educational units of institutions of higher education according to the program of preparation for passing of military service on positions of faces of officers and seized the corresponding specialties (except specialties of aircrew of aircraft), - 5 years;

other citizens - from 1 to 5 years.

For persons who are accepted on military service under the contract during the special period and are appointed to positions, except persons specified in the paragraph the second to part three of article 23 of the Law of Ukraine "About conscription and military service", terms of military service in calendar calculation are established according to part two of article 23 of the Law of Ukraine "About conscription and military service".

19-1. In case of acceptance of citizens of Ukraine for the first time on military service under the contract testing from one to six months for the purpose of establishment of compliance of the serviceman to requirements of passing of military service under the contract is established.

The immediate superior in coordination with the chief of division of Gosspetssvyaz (in Administration of Gosspetssvyaz - in coordination with the chief of independent structural division) determine tasks to the serviceman for the term of testing, content and which amount shall correspond to its job responsibilities determined in the job description.

Terms of accomplishment of these tasks shall be determined taking into account fixed term of testing.
