1. Approve the enclosed Rules of payment of cash allowance, benefits and other payments to the military personnel of Armed Forces of the Republic of Kazakhstan.

2. To provide to department of economy and finance of the Ministry of Defence of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in the Republican state company on the right of economic maintaining "The republican center of legal information" for inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan in paper and electronic types within ten calendar days from the date of state registration;

3) placement of the order on Internet resource of the Ministry of Defence of the Republic of Kazakhstan;

4) the direction of data in Legal department of the Ministry of Defence of the Republic on execution of the actions provided by subitems 1), 2) and 3) of this Item within ten calendar days from the date of state registration.

3. To impose control of execution of this order on the supervising deputy defense secretary of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

5. Bring the order to officials in the part concerning them.

Rules of payment of cash allowance, benefits and other payments to the military personnel of Armed Forces of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of payment of cash allowance, benefits and other payments to the military personnel of Armed Forces of the Republic of Kazakhstan (further - Rules) determine procedure for providing with cash allowance, benefits and other payments of the military personnel of Armed Forces of the Republic of Kazakhstan.

1-1. The basic concepts used in these rules:

1) monetary pay - official pay rate of the serviceman (salary on military position) according to the held military position and salary according to the given military rank (salary on military rank);

2) cash allowance - monthly paid allowance type which is fixed asset of material security of the military personnel. The cash allowance consists of monetary pay, the allowance for special conditions of service and other allowances and surcharges, stipulated by the legislation the Republic of Kazakhstan;

3) the allowance - the monthly payment for special conditions of service estimated in percentage ratio from official or basic official pay rate or in the fixed size;

4) benefit for improvement - the annual payment to the serviceman directed to improvement of physical and mental health, paid in case of departure in annual labor leave;

5) dismissal wage - payment in case of dismissal from military service on reaching age limit of condition on military service, for health reasons or in connection with staff reduction of military unit (organization);

6) new start allowance - the monetary compensation of one-time nature directed to creation of social conditions and arrangement of the serviceman and his family members (in the presence) on the new duty station.

2. For determination of the sizes of official pay rate the service length is considered in calendar calculation.

The size of the cash allowance which is due to the serviceman who served incomplete month is determined in proportion proceeding from the actual number of the calendar days served in this month.

3. To the serviceman in case of absence on military service without valid excuse, passings of military service not on military positions in the cases provided by subitems 6), 8) and 9) of Item 5 of article 21 of the Law of the Republic of Kazakhstan "About military service and the status of the military personnel" under arrest the cash allowance is paid to the condemned serviceman for the time spent in proportion to days of the actual fulfillment of duties of military service based on the order of the commander. In the order days of the actual absence on military service are specified. Calendar days in month are applied to pro rata calculation of cash allowance.

4. Payment of cash allowance to the serviceman for current month to make the 25th of current month.

In case of coincidence of day of payment of cash allowance to days off or holidays payment is made on the eve of them.

In case of payment of cash allowance the serviceman monthly in written or electronic form is informed on components of the cash allowance which is due to it for the corresponding period, the sizes and the bases of the made deduction and also on the general sum of money which is subject to payment.

5. Payment of cash allowance to the serviceman of earlier fixed terms is allowed based on its official report in cases:

1) departure in leaves (except for pregnancy-related absences and the birth of the child and on child care before achievement of age by it three years), for study, in official journey – for current month;

2) moving to the new duty station - for current month.

6. The cash allowance which is due to the serviceman and timely not paid to it or paid in smaller than followed the size, is paid for the entire period during which the serviceman had the right to it, within the term of limitation period.

6-1. For determination of the sizes of official pay rate of the military personnel passing military service under the contract (further - contract servicemen) in military unit (organization) the commissions on calculation of the service length granting the right to establishment of official pay rate are created. The commissions of military unit (organization) are included officials financial, legal, divisions on work with personnel (in case of absence - faces to which obligations on accounting of staff are assigned).

7-1. To the affiliated serviceman to state body, the organization and the international organization payment of cash allowance, benefits and other payments is made according to Item 74 of Rules of passing of military service in the Armed Forces, other troops and military forming of the Republic of Kazakhstan approved by the Presidential decree of the Republic of Kazakhstan of May 25, 2006 No. 124.
