About modification of the order of the Minister of Health of the Republic of Kazakhstan of February 7, 2017 No. 12 "About approval of Rules of provision of high-technology medical services"

According to Item 2 of article 42 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" I ORDER:

1. Bring in the order of the Minister of Health of the Republic of Kazakhstan of February 7, 2017 No. 12 "About approval of Rules of provision of high-technology medical services" (it is registered in the Register of state registration of regulatory legal acts for No. 14868, it is published in Reference control bank of regulatory legal acts of the Republic of Kazakhstan on March 27, 2017) the following changes:

The rules of provision of high-technology medical services approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to department of the organization of medical care of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order its direction in periodic printing editions, and also in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan provision in Department of legal service of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of Health of the Republic of Kazakhstan Aktayeva L. M.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of provision of high-technology medical services

Chapter 1. General provisions

1. These rules determine procedure for provision of high-technology medical services.

2. Provision of high-technology medical services is performed according to the types of high-technology medical services approved by the order of the Minister of health and social development of the Republic of Kazakhstan of December 28, 2016 No. 1112 "About approval of types of high-technology medical services" (it is registered in the Register of state registration of regulatory legal acts for No. 14630).

3. In these rules the following concepts are used:

1) authorized body in the field of health care (further - authorized body) - the state body performing management in the field of protection of public health, medical and pharmaceutical science, medical and pharmaceutical education, drug circulation, products of medical appointment and medical equipment, control of quality of medical services;

2) the portal of Bureau of hospitalization (further - the Portal) - single system of electronic registration, accounting, processing and storage of the directions of patients for hospitalization in hospital within the guaranteed amount of free medical care (further - GOBMP);

3) high-technology medical services (further - VTMU) - the services rendered by profile specialists in case of the diseases requiring use of innovative, resource-intensive and (or) unique methods of diagnostics and treatment;

4) medical equipment - the devices, devices and the equipment used separately in complexes or systems in the medical purposes for prevention, diagnostics, treatment of diseases, rehabilitation, scientific research of medical nature;

5) the republican organization of health care - the organizations of health care which are under authority of authorized body, organization of health care of the autonomous organization of education, clinic of the organizations of medical education;

6) technology - combination of the qualification skills, the equipment, infrastructure, tools and the corresponding technical knowledge necessary for implementation of desirable transformations in materials, information or people.

Chapter 2. Procedure for provision of high-technology medical services

4. VTMU in the form of the stationary and hospital-replacing help is provided in the organizations of health care, both local, and republican levels. VTMU in the form of the consulting and diagnostic help (further - KDP) is provided at the republican level.

5. Determination of need of the population for VTMU by regions and approval of the planned VTMU amounts on separate diseases, is performed based on the decision which is drawn up in the form of the protocol of advisory advisory body under authorized body.

6. For provision of VTMU in the conditions of hospital in the organizations of health care of local level the specialist of primary health care (further - PHC) or the profile specialist of the organization of health care, registers the direction in the Portal of bureau of hospitalization and issues it to the patient. In case of lack of possibility of provision of VTMU in the organizations of health care of local level, the specialist of PHC or the profile specialist of the organization of health care sends document package of the patient for consideration of the commission of VTMU of local authorities of public administration by health care of areas, the cities of republican value and the capital (further - the commission of VTMU) for the solution of question of hospitalization in the republican organization of health care.

7. In the absence of positive medical effect in treatment of the patient who is on hospitalization concerning which all available treatment methods in the organizations of health care of local level providing VTMU were used the patient the attending physician together with the manager of department goes to the republican organizations of health care where high-technology methods of diagnostics and treatment are applied, at the same time or with the deputy chief physician for medical work sends the statement from the medical record of the inpatient for consideration in the commission of VTMU.

8. The following documents are submitted for consideration of the commission of VTMU:

1) copy of the identity document of the patient;

2) the direction on hospitalization in hospital, in day hospital, in the form 001-3/y approved by the order of the acting minister of health care of the Republic of Kazakhstan of November 23, 2010 No. 907 "About approval of forms of primary medical documentation of the organizations of health care" (it is registered in the Register of state registration of regulatory legal acts for No. 6697);

3) results of necessary minimum amount of inspection of the patient (general blood test, general analysis of urine (prescriptive limit no more than 14 days), fluorography of bodies of thorax (prescriptive limit no more than 1 year), electrocardiogram (prescriptive limit no more than 1 month) and HBsAg availability (prescriptive limit no more than 3 months));

4) the statement from the out-patient card or the clinical record with indication of the clinical diagnosis, results of researches;

5) results of the laboratory and tool researches confirming the clinical diagnosis of the patient.

The commission of VTMU considers document package of the patient in absentia.

9. The commission of VTMU considers the submitted documents and determines justification of the direction of the patient in the republican organizations of health care for provision of VTMU.

10. Within two working days from the moment of receipt of documents of the patient, the commission of VTMU makes the decision which is drawn up in the form of the protocol.

11. The basis for hospitalization of citizens in the republican organizations of health care for provision of VTMU in the form of the stationary and hospital-replacing help and the direction on VTMU in the form of KDP is the decision of the commission of VTMU.

12. In case of adoption of the positive decision on provision to the patient of VTMU in the republican organizations of health care, the specialist of PHC registers the direction in the Portal of bureau of hospitalization and gives document package with the unpacked direction to the directed organization of health care. The organization of health care after receipt of the direction on hospitalization informs the patient on date of hospitalization by issue to the patient of the coupon of planned hospitalization in form, according to appendix 2 to the Rules of rendering the stationary help approved by the order of the Minister of health and social development of the Republic of Kazakhstan of September 29, 2015 No. 761 (it is registered in the Register of state registration of regulatory legal acts for No. 12204) (further - the Order No. 761).

After carrying out VTMU in the form of organ transplantation and (or) fabrics local executive bodies realize actions for providing patients with medicines after organ transplantation and (or) fabrics according to the approved order of the acting minister of health care of the Republic of Kazakhstan of November 4, 2011 No. 786 "About approval of the List of medicines and products of medical appointment within the guaranteed amount of free medical care, including separate categories of citizens with certain diseases (conditions) of free or preferential medicines and specialized medical products at the out-patient level" (registered in the Register of state registration of regulatory legal acts for No. 7306) (further - the List of medicines).

13. In case of decision making about refusal in provision to the patient of VTMU the commission of VTMU registers refusal in the Portal of bureau of hospitalization and returns document package with appendix of motivated refusal in the directed organization of health care.

14. In the presence of the indication for provision of VTMU in the form of KDP at the republican level the specialist of PHC or the profile specialist of the organization of health care sends document package of the patient for consideration in the commission of VTMU.

15. In case of adoption of the positive decision on provision to the patient of VTMU in the form of KDP in the republican organization of health care, the commission of VTMU registers the direction in the information system "Out-patient and Polyclinic Help" (further - IS "APP") by filling of the respective fields of electronic form of the direction and issues the unpacked direction with automatically the created code in the directed organization of health care. The organization of health care after receipt of the direction informs the patient on date of the direction.

16. In case of decision making about refusal in provision to the patient of VTMU in the form of KDP in the republican organization of health care the commission of VTMU registers refusal in IS "APP", and returns document package with appendix of motivated refusal in the directed organization of health care.

17. Upon termination of hospitalization, the medical organization which provided VTMU sends to the organizations of health care rendering PHC vypisny the patient's epicrisis with recommendations of further maintaining, including with the plan of joint monitoring of efficiency.

18. Within year the medical organization which is carrying out VTMU carries out monitoring of condition of the patient (improvement indicators) together with the doctor of PHC. All medical organizations providing VTMU publish the report on the website of the organization for quantity and resulting effects in the end of the year (survival after carrying out VTMU and within year, death rate, achievement of resulting effects depending on profile of services).

19. The republican organization of health care within 15% of the planned VTMU amount in the form of the stationary, hospital-replacing help and in the form of KDP at the republican level in the presence of medical indications provides VTMU according to the subitem 2) of Item 35 of the Order No. 761.

20. VTMU is performed by the organizations of health care based on the conclusion about compliance of the organization of health care to provision of VTMU issued by territorial Department of Committee of protection of public health of authorized body (further - KOOZ TD), in form according to appendix 1 to these rules (further - the Conclusion).

21. For receipt of the Conclusion of KOOZ the organization of health care, VTMU applying for provision next year, no later than October 15 of the current year, sends the request for compliance of the organization of health care to provision of VTMU (further - the request) in form according to appendix 2 to these rules to TD of KOOZ and registers the request in the information system "Resource management system" (further - IS "RMS").

The organizations of health care for the first time declaring on certain type of VTMU provide information according to the Description of the organization of health care, the providing VTMU, according to appendix 3 to these rules.

22. KOOZ is issued to the organization of health care after application by the responsible specialist of TD:

the receipt on documents acceptance in form according to appendix 4 to these rules;

the receipt on refusal in documents acceptance in form according to appendix 5 to these rules in cases:

1) execution of the request and the documents attached to it, inadequate image;

2) appendices to the request of incomplete document package according to the list, stipulated in Item 19 these rules.

23. KOOZ TD within 30 calendar days from the moment of registration of the request holds events for assessment of conformity of personnel and equipment of the organization of health care applying for provision of VTMU to the data specified in the Description of the organization of health care of VTMU based on the submitted documentation and issues the organizations of health care the conclusion of KOOZ, with effective period for one year and registers the conclusion in IS "RMS".

24. The organization of health care sends the positive conclusion of KOOZ to territorial Department of Committee of payment of medical services of authorized body (further - TD to WHOM) *.

25. The TD to WHOM sends the list of the organizations of health care providing VTMU in Committee of payment of medical services of authorized body (further - to WHOM) for forming of the list of the organizations of health care allowed to provision of VTMU before holding procedure of the choice of the supplier **.

26. The local state body of health care of area, city of republican value and the capital till November 15 of the current year sends the request for provision of VTMU by the organizations of health care allowed to provision of VTMU to Department of the organization of medical care of authorized body (further - DOMP) in form according to appendix 6 to these rules.

27. DOMP together with WHOM create amount of specialized medical care using VTMU within GOBMP by VTMU types no later than December 10 of the current year ***.

28. Placement of amount of specialized medical care using VTMU within GOBMP is performed according to subitem 122-3) of Item 1 of article 7 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system".

29. The medical organization without fail notifies in writing KOOZ TD on dismissal of the specialist allowed to rendering VTMU and staticizes data in IS "RMS".

* Note. Since January 1, 2018 the positive conclusion of KOOZ goes the organization of health care to branches of Non-commercial joint-stock company "Fund of Social Medical Insurance".

** Note. Since January 1, 2018 branches of Nekomerchesky joint-stock company "Fund of Social Medical Insurance" in areas, the cities of Astana and Almaty, direct the list of the organizations of health care providing VTMU in Non-commercial joint-stock company "Fund of Social Medical Insurance".

*** Note. Since January 1, 2018 the amount of specialized medical care using VTMU is created by DOMP together with Non-commercial joint-stock company "Fund of Social Medical Insurance".
