About approval of regulations of the state services in the field of industrial safety

According to the subitem 2) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Approve:

1) regulations of the state service "Certification of Legal Entities on the Work Right in the field of Industrial Safety" according to appendix 1 to this order;

2) regulations of the state service "Registration of Declarations of Industrial Safety of Hazardous Production Facility" according to appendix 2 to this order;

3) regulations of the state service "Issue of Permissions to Use of the Technologies, Technical Devices, Materials Applied on Hazardous Production Facilities, Dangerous Technical Devices" according to appendix 3 to this order;

4) regulations of the state service "Issue of Permission to Permanent Use of Explosives and Products on Their Basis" according to appendix 4 to this order;

5) regulations of the state service "Issue of Permissions to Production of Explosive Works" according to appendix 5 to this order;

6) regulations of the state service "Approval of the Project Documentation on Construction, Expansion, Reconstruction, Upgrade, Preservation and Liquidation of Hazardous Production Facilities" according to appendix 6 to this order.

2. Declare invalid the order of the Minister of Emergency Situations of the Republic of Kazakhstan of June 25, 2014 No. 315 "About approval of regulations of the state services in the field of civil protection" (registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan for No. 9622, published in information system of law of Ad_let on August 6, 2014, in the Kazakhstanskaya Pravda newspaper on February 5, 2015 No. 23 (27899).

3. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (Erzhanov A. K.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 3 of this order.

4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

5. This order becomes effective after twenty one calendar days after day of its first official publication.

Regulations of the state service "Certification of Legal Entities on the Work Right in the field of Industrial Safety"

Chapter 1. General provisions

1. The state service "Certification of Legal Entities on the Work Right in the field of Industrial Safety" (further - the state service) is developed based on the Standard of the state service "Certification of Legal Entities on the Work Right in the field of Industrial Safety" approved by the order of the Minister of investments and development of the Republic of Kazakhstan of April 28, 2015 No. 511 (it is registered in the Register of state registration of regulatory legal acts for No. 11363) (further - the standard) and it appears Committee of industrial development and industrial safety of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan (further - the service provider).

5. Contents of each procedure (action), being part of process of rendering the state service:

in case of issue of the certificate:

1) the head of the service provider within 2 (two) hours, considers the application of uslugopoluchatel and writes to the deputy manager of the service provider;

2) the deputy manager of the service provider within 2 (two) hours, considers the application of uslugopoluchatel and writes to the head of branch management;

3) the head of branch management within 2 (two) hours, considers the application of uslugopoluchatel on compliance to qualifying standards and writes to the contractor;

4) the executive in charge within 1 (one) working day checks completeness of the submitted documents, in case of factual determination of incompleteness of the submitted documents within the specified terms prepares written motivated refusal in further review of the statement, in case of completeness of the submitted documents the current of 17 (seventeen) working days checks documents for compliance to requirements and draws up the decision on issue of the certificate;

5) approval by the head of branch management of the decision on issue of permission or the motivated answer on refusal in rendering the state service within 2 (two) hours;

6) approval by the deputy manager of the service provider of the decision on issue of permission or the motivated answer on refusal in rendering the state service within 2 (two) hours;

7) signing by the head (or replacement his face) the service provider of the decision on issue of permission or the motivated answer on refusal in rendering the state service within 2 (two) hours.

in case of issue of the duplicate of the certificate:

1) the head of the service provider within 2 (two) hours, considers the application of uslugopoluchatel and writes to the deputy manager of the service provider;

2) the deputy manager of the service provider within 2 (two) hours, considers the application of uslugopoluchatel and writes to the head of branch management;

3) the head of branch management within 2 (two) hours, considers the application of uslugopoluchatel on compliance to qualifying standards and writes to the contractor;

5) approval by the head of branch management of the decision on issue of permission or the motivated answer on refusal in rendering the state service within 2 (two) hours;

6) approval by the deputy manager of the service provider of the decision on issue of permission or the motivated answer on refusal in rendering the state service within 2 (two) hours;

7) signing by the head (or replacement his face) the service provider of the decision on issue of permission or the motivated answer on refusal in rendering the state service within 2 (two) hours.

6. Result of the procedure (action) for rendering the state service which forms the basis for accomplishment of the following procedure (action):

1) registration of the document;

2) resolution of the head;

3) appointment of the executive in charge;

4) acceptance to consideration or refusal in consideration;

5) execution of the decision on rendering the state service;

6) signing of result of rendering the state service.
