About approval of the Regulations on the commissions on fire safety under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas, the city of Tashkent, cities and areas

In pursuance of the resolution of the President of the Republic of Uzbekistan of May 23, 2017 "About measures for radical enhancement of activities of divisions of fire safety of law-enforcement bodies" and for the purpose of strengthening of measures of fire safety on places the Cabinet of Ministers decides No. PP-2992:

1. Approve:

Regulations on the commissions on fire safety under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas, the city of Tashkent, cities and areas according to appendix No. 1;

Standard structure of the Commission on fire safety under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent according to appendix No. 2;

Standard structure of the Commission on fire safety under khokimiyats of the cities and areas according to appendix No. 3.

2. To the chairman of the board of Ministers of the Republic of Karakalpakstan, to hokima of areas, the city of Tashkent, cities and areas in ten-day time to provide creation and the organization of activities of the commissions on fire safety according to the approved Provision.

3. To the ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

4. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzbekiston temir yullari A. Zh. Ramatov and the Minister of Internal Affairs of the Republic of Uzbekistan P. R. Bobozhonov.

Regulations on the commissions on fire safety under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas, the city of Tashkent, cities and areas

Chapter 1. General provisions

1. This Provision determines the status, the main objectives, functions, the rights and responsibility, and also procedure for the organization of activities of the commissions on fire safety under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas, the city of Tashkent, cities and areas (further - the commissions).

2. The commissions are the bodies coordinating activities of state bodies, subjects of entrepreneurship and self-government institutions of citizens for implementation of the necessary measures aimed at providing fire safety of administrative and territorial units.

3. The commissions in the activities are guided by the Constitution and the laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, this Provision and other acts of the legislation.

4. The commissions under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent in the activities are accountable to the Cabinet of Ministers of the Republic of Uzbekistan.

The commissions under khokimiyats of the cities and areas are accountable, respectively, to the commissions under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent.

5. Obligations according to the solution of the questions connected with material logistics of the commissions are assigned, respectively, to Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas, the city of Tashkent, cities and areas.

Chapter 2. Main objectives, functions and rights of the commissions

6. The main objectives of the commissions are:

implementation of package of measures for ensuring fire safety, to identification and elimination of the reasons and conditions promoting emergence of the fires;

carrying out on system basis according to the approved schedules of fire-proof doctrines in the territories makhally, with studying of road condition, drives and water sources, with obligatory participation in these actions of chairmen (aksakals) of descents of citizens;

coordination of activities of state bodies, subjects of entrepreneurship and self-government institutions of citizens in the field of prevention of the fires;

assessment and monitoring of the performed measures in the field of the prevention of the fires, and also development of offers on increase in their efficiency;

assistance in creation of voluntary fire divisions in the rural zone and remote settlements, and also their material and social stimulation;

providing together with Institute of fire safety of the Ministry of Internal Affairs of the Republic of Uzbekistan of implementation of actions on the organization of complex educational and practical charges of heads of objects and carrying out evident propaganda among the population.

7. The commissions for the purpose of accomplishment of the tasks assigned to them perform the following functions:

a) in the field of implementation of package of measures for ensuring fire safety, to identification and elimination of the reasons and conditions promoting emergence of the fires:

develop offers on realization of state policy in the field of ensuring fire safety;

organize, in case of complication of fire situation of measure for the prevention and suppression of the fires, with introduction of the particular (seasonal) fire-proof treatments in the corresponding territory;

study and extend the best domestic and foreign practices in area of fire safety;

develop with participation of the ministries and departments, organizations and public associations drafts of territorial programs and actions for fire safety, with determination of sources and the amounts of financing, and also material resources for their realization;

b) in the field of carrying out on system basis according to the approved schedules of fire-proof doctrines in the territories makhally, with studying of road condition, drives and water sources, with obligatory participation in these actions of chairmen (aksakals) of descents of citizens:

will organize conducting fire tactical maneuvers on objects, in the places of residence of the population and mass accumulation of people, and also in anhydrous areas, with involvement of the interacting structures and departments;

organize carrying out at least once in half-year of practical trainings on evacuation on objects with mass stay of people and in buildings of the increased number of storeys;

participate in the solution of tasks on increase in the professional training level and qualification of employees of the companies in the field of prevention and fire-fighting, to training of the population in measures of fire safety;

hear heads of state bodies and self-government institutions of citizens on the available problems and shortcomings of system of ensuring fire-water supply and of anhydrous areas for adoption of relevant decisions;

c) in the field of coordination of activities of state bodies, subjects of entrepreneurship and self-government institutions of citizens in the field of prevention of the fires:

coordinate activities of bodies of the public and economic board, the organizations, subjects of entrepreneurship and self-government institutions of citizens concerning fire safety, give them information, methodical and other help;

organize the actions directed to strengthening of interaction of bodies of the public and economic board of the cities and areas, and also the organizations and subjects of entrepreneurship concerning the prevention of the fires;

consider offers of bodies of the public and economic board, self-government institutions of citizens, heads of territorial administrations (departments, departments) of fire safety, and also physical persons and legal entities on the organization and strengthening of divisions of fire protection, prepare relevant proposals in the Cabinet of Ministers of the Republic of Uzbekistan;

d) in the field of assessment and monitoring of the performed measures in the field of the prevention of the fires, and also development of offers on increase in their efficiency:

consider questions on the happened fires in the territories of the Republic of Karakalpakstan, areas, the city of Tashkent, cities and areas, and also condition of work on their prevention;

consider and make offers in specially authorized body in the field of town planning about suspension of work of the objects which are operated without the acts of the state inspections which are drawn up in accordance with the established procedure;

develop suggestions for improvement of regulatory legal acts and other regulating documents in the field of the prevention of the fires and their liquidation;

e) in the field of assistance in creation of voluntary fire divisions in the rural zone and the remote settlements, and also their material and social stimulation:

consider questions of construction of new fire stations in settlements according to requirements of regulating documents and on the basis of the analysis of the happened fires;

make offers in self-government institutions of citizens and render assistance in creation of voluntary fire divisions in the rural zone and the remote settlements;

provide development, approval and execution of local budgets regarding expenses on fire safety, including on content of the created voluntary fire divisions, and also determination and taking measures to their material and social stimulation;

e) in the field of providing together with Institute of fire safety of the Ministry of Internal Affairs of the Republic of Uzbekistan of implementation of actions on the organization of complex educational and practical charges of heads of objects and carrying out evident propaganda among the population:

organize annual complex educational and practical charges of heads of objects for training in measures of fire safety in the region;

together with the Creative combining "Tasviry of Oyn" and other interested organizations quarterly perform distribution in public places, shops, at stops of the evident propaganda materials (instructions, instruction sheets, flyers, posters with infographics) showing operations procedure in case of the fires and measures for non-admission of their origin.

Chapter 3. Rights and responsibility of the commission

8. The commissions within the competence have the right:

request and receive from bodies of the public and economic board, the organizations and self-government institutions of citizens of the data, necessary for implementation of the tasks assigned to the commissions;

charge to bodies of the public and economic board, the organizations and self-government institutions of citizens preparation of the required materials submitted for consideration of the commissions;

involve specialists to studying of questions of fire safety and representatives of the interested organizations for participation in work of the commissions;

control development on a centralized basis of the financial resources and material resources aimed at providing fire safety allocated to state bodies;

assist in organization of training of children at schools and other educational institutions to application of measures of fire safety on the basis of special programs;

hear heads of bodies of the public and economic board, the organizations and self-government institutions of citizens concerning ensuring fire safety;

bring in the relevant controlling and judicial authorities of the offer on accountability of the officials and citizens who are not fulfilling requirements of fire safety and suspension of operation of the objects which are in pozharougrozhayemy condition.

The commissions can have also other rights according to the legislation.

9. The commissions bear responsibility for effective implementation of the tasks and functions assigned to it.

Chapter 4. Organization of work of the Commissions

10. The main forms of work of the commissions are meetings at which the issues carried to their competence are discussed and resolved.

Meetings of the commissions can be held in the next and extraordinary procedure.

Meetings of the commissions are held at least once a quarter, and also proceeding from the developing situation in the field of fire safety. Emergency meetings are held at the initiative of chairmen of the commissions or their deputies.

11. Meetings of the commissions are competent if at them there are more than a half from total number of members of the commissions.

12. Meetings of the commissions are drawn up by protocols in which nature of cases in point is specified. Protocols affirm chairmen and are signed by responsible secretaries.

13. The decision on the question considered at meeting is deemed accepted if more than a half of the members of the commission participating at meeting voted for it. In case of equality of votes the chairman's voice is decisive.

14. The decisions made by the commissions are led up to bodies of the public and economic board, the organizations, subjects of entrepreneurship and self-government institutions of citizens responsible secretaries of the commissions.

Decisions of the commissions of the cities and areas can be appealed by bodies of the public and economic board, the organizations, subjects of entrepreneurship, self-government institutions of citizens in the higher commission, law enforcement agencies or in court.

Decisions of the commissions under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent can be appealed in the Cabinet of Ministers of the Republic of Uzbekistan, law enforcement agencies or in court.

On the questions requiring the solution of the Government of the Republic of Uzbekistan, the commissions make in accordance with the established procedure relevant proposals.

15. The commissions are headed by chairmen into whose power is included:

ensuring overall performance of the commissions;

convocation of meetings of the commissions;

approval of regulations of work and conducting meetings of the commissions;

distribution of obligations among members of the commissions;

the organization of control over the implementation of the decisions made by the commissions.

Chairmen of the commissions bear the personal responsibility for accomplishment of the tasks assigned to the commissions.

Chairmen can perform and other powers according to the legislation.

16. Deputy chairmen of the commissions carry out orders of chairmen of the commissions, and in case of their absence fulfill their duties.

17. Responsible secretaries provide:

direct record keeping of the commissions;

development of annual plans of work, control of their accomplishment, the organization of the current work of the commissions according to the approved work plans, and also preparation of required materials for meetings of the commissions;

bringing to members of the commissions and the interested organizations information on time and the venue of commission sessions;

registration and the direction of the approved protocols to members of the commissions, to relevant organs of the public and economic board, self-government institutions of citizens and the organizations;

control of execution of the made decisions of the commissions, and also introduction of the corresponding information and offers on their realization to chairmen of the commissions;

the organization of timely collection of information for preparation of required materials for meetings of the commissions;

preparation of reporting materials about activities of the commissions;

implementation of other functions according to decisions of the commissions.

18. The commissions under khokimiyats of the cities and areas represent reporting materials to the commissions under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent quarterly, to the 10th day of the next month.

The commissions under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent represent reporting materials of times a half-year to Head department of fire safety of the Ministry of Internal Affairs of the Republic of Uzbekistan which performs preparation, generalization and entering into the Cabinet of Ministers of the Republic of Uzbekistan of information and analytical and other materials.

19. The head department of fire safety of the Ministry of Internal Affairs of the Republic of Uzbekistan provides:

timely preparation of required materials following the results of action research of the commissions and situation with ensuring fire safety on places;

obtaining from bodies of the public and economic board, the organizations, self-government institutions of citizens of required materials in the field of ensuring fire safety;

submission to the Cabinet of Ministers of the Republic of Uzbekistan of information and analytical and other materials on the developing situation and ensuring fire safety on objects of the social sphere and industries of economy, and also monitoring of activities of the commissions;

studying with departure on places of activities of the commissions and the course of accomplishment of the made decisions of the Cabinet of Ministers of the Republic of Uzbekistan by them on the questions carried to activities of the commissions.
