About introduction of amendments to the order of the Minister of Transport and Communications of the Republic of Kazakhstan of September 26, 2013 No. 750 "About approval of Rules of issue and prolongation of effective period of certificates of aviation personnel"
According to Item 2 of article 50 of the Law of the Republic of Kazakhstan of April 6, 2016 "About legal acts" I ORDER:
1. Bring in the order of the Minister of Transport and Communications of the Republic of Kazakhstan of September 26, 2013 No. 750 "About approval of Rules of issue and prolongation of effective period of certificates of aviation personnel" (it is registered in the Register of state registration of regulatory legal acts for No. 8782, it is published of February 1, 2014 in the Kazakhstanskaya Pravda newspaper No. 22 (27643) the following changes:
change in Kazakh is made to heading, the text in Russian does not change;
change in Kazakh is made to Item 1, the text in Russian does not change;
The rules of issue and prolongation of effective period of certificates of aviation personnel approved by the specified order to state in edition according to appendix to this order.
2. To provide to committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;
4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;
5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.
3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.
4. This order becomes effective after twenty one calendar days after day of its first official publication.

to the Order of the Minister of investments and development of the Republic of Kazakhstan of July 19, 2017 No. 484

1. These rules of issue and prolongation of effective period of certificates of aviation personnel (further - Rules) are developed according to Item 3 of article 54 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law) and determine procedure for issue and prolongation of effective period of the certificate of aviation personnel.
2. In these rules the following terms and determinations are used:
1) aviation personnel - the physical persons having special and (or) professional training, performing activities for accomplishment and ensuring flights of aircrafts, airborne transportations and aviation works, maintenance of aircrafts, the organization and servicing of air traffic, air traffic control;
2) the certificate of aviation personnel - the document confirming qualification and powers of aviation personnel;
3) the applicant - the physical person or legal entity (the organization of civil aviation) which addressed to authorized body in the field of civil aviation for receipt of the certificate of aviation personnel;
4) the register of issue of certificates of aviation personnel (further - the Register) - the document in which record about issue of certificates of aviation personnel is made;
5) qualification mark - the record made in the certificate or having relation to it, which is its part in which the special conditions, the rights or restrictions relating to this certificate are specified;
6) authorized body in the field of civil aviation (further - authorized body) - the central executive body performing management in the field of use of airspace and activities of civil and experimental aviation;
7) the organization of civil aviation (further - the HECTARE organization) - the legal entity performing activities in the field of civil aviation;
8) the commander of the aircraft under observation - the second pilot who is carrying out under observation of the commander of the air vessel / instructor of obligation and function of the commander of the aircraft (further - KVS) according to standard procedures of the operator and the technique of observation acceptable for authorized body;
9) the member of flight crew - the person belonging to aviation personnel, having the existing certificate of aviation personnel to whom the obligations connected with control of the aircraft during flight time are assigned.
3. Certificates are granted to the following aviation personnel:
1) members of flight crew:
pilot of the extralight aircraft (glider, motor-hang-glider, autogyro, free aerostat, airship);
pilot of the light aircraft (airplane)
the private pilot (the airplane, the helicopter, the airship or the aircraft with system of increase in carrying power);
the pilot of commercial aircraft (the airplane, the airship, the helicopter or the aircraft with system of increase in carrying power);
pilot of polynomial crew (airplane);
the linear pilot of airline (the airplane, the helicopter or the aircraft with system of increase in carrying power);
2) members of flight crew other than pilots:
navigator;
flight engineer;
3) other aviation personnel:
dispatcher of air traffic;
personnel on maintenance of aircrafts;
personnel on maintenance of light and extralight aircrafts;
the employee on ensuring flights / the flight dispatcher;
operator of the aviation station.
4. The certificate of aviation personnel represents the document of book type the size 8, x 12 centimeters (further - cm) in form, according to appendix 1 to the presents Rules, and also in the form of the plastic card the 85,72 x 54,03 size of millimeters (further - mm) in form, according to appendix 2 to these rules.
5. Certificates of aviation personnel differ on color scale and the serial and alphabetic coding depending on their belonging to categories of aviation personnel.
The table of serial alphabetic codes and flowers of Certificates of aviation personnel is given in appendix 3 to these rules.
6. The certificate of aviation personnel is valid from the date of its issue, in case of prolongation, from the date of date of its prolongation by authorized body during the period which is not exceeding five years.
Effective period of the Certificate of aviation personnel is determined by reality of the qualification marks containing in it and the medical certificate, limiting effective period of the Certificate of aviation personnel.
Effective period of qualification mark is counted of date of qualification check, and for personnel on maintenance of aircrafts of date of introduction of qualification mark in the Certificate of aviation personnel.
Effective period of the Certificate of aviation personnel is not interrupted if documents for prolongation are submitted in twenty two working days prior to end date of term of its action. In this case the authorized body prolongs the Certificate of aviation personnel of date of its issue (in case of the first prolongation) or end dates of its action (in case of the second and the subsequent prolongation).
If conditions of this Item are not satisfied, then effective period of the Certificate of aviation personnel is determined new date of prolongation of the Certificate of aviation personnel.
7. The aviation personnel which do not have in case of itself the existing Certificate of aviation personnel are not allowed to accomplishment of functions of the member of flight crew of the aircraft.
8. Certificates of aviation personnel are granted to the owner certificates, to the first head of the organization of civil aviation or his authorized representatives.
9. Issue of Certificates of aviation personnel is registered in the Register.
10. Issue of the Certificates of aviation personnel specified in Item 3 of these rules is performed by authorized body.
11. For all aviation personnel, except for personnel on maintenance of aircrafts, issue or prolongation of effective period of the Certificate of aviation personnel is possible in the presence of the medical certificate issued according to Item 3 of article 54 of the Law.
12. The term of issue or prolongation of effective period of the Certificate of aviation personnel constitutes twenty two working days.
13. In issue or prolongation of effective period of the Certificate of aviation personnel refuses in the following cases:
1) establishment of unauthenticity of the documents submitted by the applicant for obtaining or the prolongation of effective period of the Certificate of aviation personnel, and (or) these (data) containing in them;
2) discrepancy of the applicant and (or) the provided materials, objects, supplied and the information necessary for issue or prolongation of effective period of the Certificate of aviation personnel, to the requirements established by these rules;
3) concerning the applicant there is decision (sentence) of court on prohibition of activities or the separate types of activity requiring obtaining or prolongation of effective period of the Certificate of aviation personnel which took legal effect;
4) concerning the applicant there is judgment which took legal effect based on which the applicant is deprived of the special right connected with obtaining or prolongation of effective period of the Certificate of aviation personnel.
14. In case of issue or prolongation of effective period of the Certificate of aviation personnel the authorized body does not require documents which can be received from information systems.
Copies of the submitted documents provided by these rules are certified notarially or seal (in the presence) the applicant.
15. For personnel on maintenance of aircrafts all records made to the section "Ratings" of the old Certificate of aviation personnel are subject to transfer. The records made in the Section "Special Remarks" to transfer in the new Certificate of aviation personnel are not subject, except for data on issue of appendix to the Certificate of personnel on maintenance of aircrafts (Item XV).
16. For receipt of the Certificate of members of flight crew the applicant provides the following documents in authorized body:
1) statement:
for the pilot - the private pilot (the airplane, the helicopter, the airship or the aircraft with system of increase in carrying power), the pilot of commercial aircraft (the airplane, the airship, the helicopter or the aircraft with system of increase in carrying power), the pilot of polynomial crew (airplane), the linear pilot of airline (the airplane, the helicopter or the aircraft with system of increase in carrying power), the statement for issue, prolongation of effective period of the certificate of the pilot or qualification in form, according to appendix 4 to these rules;
for pilots of light and extralight aircrafts, the statement is constituted in any form with indication of individual identification number (further - IIN), and also consent to use of the data which are the secret protected by the law, containing in information systems;
for the navigator the statement for issue, prolongation of effective period of the certificate of the navigator or qualification mark in form, according to appendix 5 to these rules;
for the flight engineer the statement for issue, prolongation of effective period of the certificate of the flight engineer or qualification mark in form, according to appendix 6 to these rules;
2) copies of documents on the termination of aviation training center (further - AUTs) or aviation educational institution;
3) the copy of the act (form) of results of the last check on the complex exercise machine (LPC) the act of flight check for pilots of the airplane or the helicopter in form, according to appendix 7 to these rules or the copy of the act of flight check in form, according to appendix 8 to these rules;
4) representation (on members of flight crew), the HECTARES organizations for form certified by the sign and seal (in the presence), according to appendix 9 to these rules;
5) for foreign citizens, the notarized copy of the document, the proving identity;
6) two photos (color, opaque, the size 3, x 4,5 of cm with angle-piece on the right a detached view taking of photo);
7) copies of the corresponding medical certificate;
8) the copy of the certificate confirming passing of testing for knowledge of the English used in radiotelephone communication (for members of the flight crew which is carrying out the international flights);
9) the copies of the document confirming passing of rate "To possibility of the person including the principles of control of factors of threat and mistakes";
10) copies of statements from the flight book (for arrived from the state aircraft);
11) the filled Liszt of compliance, offsetting of military accounting in form, according to appendix 10 to these rules (for arrived from the state aircraft);
12) the original certificate of members of flight crew (in case of spoil of the Certificate of members of flight crew).
17. Issue of the Certificate of members of flight crew to the foreign citizen is made if the foreign citizen had special or professional training in AUTs of the Republic of Kazakhstan.
18. Issue of the Certificate of members of flight crew, employed in civil aviation from the state aircraft, is performed by authorized body only after passing of retraining by it in AUTs.
Certificates of members of flight crew are granted taking into account knowledge, ability and skills on earlier mastered types of aircrafts.
19. The applicant provides in authorized body for prolongation of effective period of the Certificate of members of flight crew, the following documents:
1) statement:
for the pilot - the private pilot (the airplane, the helicopter, the airship or the aircraft with system of increase in carrying power), the pilot of commercial aircraft (the airplane, the airship, the helicopter or the aircraft with system of increase in carrying power), the pilot of polynomial crew (airplane), the linear pilot of airline (the airplane, the helicopter or the aircraft with system of increase in carrying power), the statement for issue, prolongation of effective period of the certificate of the pilot or qualification in form, according to appendix 4 to these rules;
for pilots of light and extralight aircrafts, the statement is constituted in any form with indication of individual identification number (further - IIN), and also consent to use of the data which are the secret protected by the law, containing in information systems;
for the navigator the statement for issue, prolongation of effective period of the certificate of the navigator or qualification mark in form, according to appendix 5 to these rules;
for the flight engineer the statement for issue, prolongation of effective period of the certificate of the flight engineer or qualification mark in form, according to appendix 6 to these rules;
2) copy of the act (form) of results of the last check
on the complex exercise machine (LPC) the act of flight check for pilots of the airplane or the helicopter in form, according to appendix 7 to these rules or the copy of the act of flight check in form, according to appendix 8 to these rules;
3) copy of the form (form) of results of check of theoretical knowledge;
4) the copy of the certificate confirming passing of testing for knowledge of the English used in radiotelephone communication (for members of the flight crew which is carrying out the international flights);
5) copy of the corresponding medical certificate;
6) the copies of the document confirming passing of rate "To possibility of the person including the principles of control of factors of threat and mistakes";
7) the original certificate of members of flight crew (the copy of the Certificate if the insert in the Certificate of members of flight crew is issued).
If skills on the complex exercise machine were performed by rules of the European agency on safety of flights of Part-FCL, then in this case, prolongation of effective period of qualification marks of the Certificate of members of flight crew is made by their rules (for members of flight crew).
20. For receipt of the Certificate of the dispatcher of air traffic the applicant provides the following documents in authorized body:
1) the statement in any form, with indication of IIN, and also consent to use of the data which are the secret protected by the law, containing in information systems;
2) copies of documents on the termination AUTs or aviation educational institution and the copy of the Protocol of holding qualification examination in form, according to appendix 11 to these rules;
3) representation (for other aviation personnel, except personnel on THAT AF), the HECTARES organizations for form certified by the sign and seal (in the presence), according to appendix 12 to these rules;
4) two photos (color, opaque, the size 3, x 4,5 of cm with angle-piece on the right a detached view taking of photo);
5) copies of the corresponding medical certificate;
6) the copies of the document confirming passing of rate "To possibility of the person including the principles of control of factors of threat and mistakes".
7) the original certificate (in case of spoil of the Certificate).
21. The applicant provides in authorized body for prolongation of effective period of the Certificate of the dispatcher of air traffic, the following documents:
1) the statement in any form;
2) the copy of the Protocol of holding qualification examination in form, according to appendix 11 to these rules;
3) original certificate;
4) copy of the corresponding medical certificate;
5) copies of documents on passing of the last on time of rates on qualification maintenance in the specialty;
6) the copies of the document confirming passing of rate "To possibility of the person including the principles of control of factors of threat and mistakes".
22. For receipt of the Certificate of personnel on maintenance of aircrafts the applicant provides the following documents in authorized body:
1) the statement for the certificate of personnel on maintenance of aircrafts in form, according to appendix 13 to these rules;
2) copies of the documents confirming examination on one or more than one programs of initial preparation in the form of modules which term of passing does not exceed 10 years of date of issue of the certificate or the diploma, and for personnel in the field of maintenance of the aircrafts of the state aircraft applying on receipt of the certificate of personnel on maintenance of aircrafts in civil aviation after the termination of service in the state aircraft - 15 years of end date of educational institution of the state aircraft on condition of uninterrupted length of service in the field of maintenance of aircrafts;
3) the copy of the individual magazine of personnel on maintenance of aircrafts in form, according to appendix 14 to these rules;
4) personal data on personnel on maintenance of aircrafts in form, according to appendix 15 to these rules;
5) two photos (color, opaque, the size 3, x 4,5 of cm with angle-piece on the right a detached view taking of photo);
6) copies of documents on examination after independent development of the program of initial preparation, or on the termination of training center of civil aviation, aviation institute, aviation school, aviation technical school or aviation college on one or more than one programs of initial preparation in the form of modules (category "A", "B1" or "B2") which term of passing cannot exceed 10 years of the date of issue of the certificate or the diploma confirming examination or of date of issue of the diploma;
7) the copy of documents, about passing of rate by opportunities of the person, including the principles of control of factors of threats and mistakes in volume of the module 9A or 9B "Possibilities of the person in relation to maintenance of AF";
8) the copy of documents, about passing of rate "The Kazakhstan and international aviation legislation" in volume of the module 10 RK;
9) the original certificate of personnel on maintenance of aircrafts (in case of spoil of the Certificate).
23. The applicant provides in authorized body for prolongation of effective period of the Certificate of personnel on maintenance of aircrafts, the following documents:
1) the statement for the Certificate of personnel on maintenance of aircrafts in form, according to Appendix 13 to these rules;
2) original certificate and appendix to it (Item XV).
24. Issue or prolongation of effective period of the Certificate of personnel on maintenance of light and extralight aircrafts, is performed by authorized body based on representation and the decision of the permanent qualification commission of the non-profit organizations combining operators of aircrafts (further - non-profit organization).
25. In case of issue or prolongation of effective period of the Certificate of personnel on maintenance of light and extralight aircrafts, the authorized body does not bring in this Certificate qualification and special marks in Items XII (Ratings) and XIII (Special Remarks).
26. For receipt of the Certificate of the employee on ensuring flights / the flight dispatcher, the operator of the aviation station the applicant provides the following documents in authorized body:
1) the statement in any form with indication of IIN, and also consent to use of the data which are the secret protected by the law, containing in information systems;
