About modification of some regulatory legal acts and recognition voided the order concerning the treatment of radioactive waste

According to part five of article 6 of the Law of Ukraine "About allowing activities in the field of use of nuclear energy", 7, of the 16th item 4 of the Regulations on the State inspection of the nuclear regulation of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 363, and for the purpose of reduction of regulatory legal acts in compliance with the current legislation I order to subitems:

1. Approve Changes in Conditions and safety requirements (licensed conditions) of implementation of activities in the field of the treatment of radioactive waste approved by the order of the State committee of nuclear regulation of Ukraine of October 22, 2002 No. 110, registered in the Ministry of Justice of Ukraine on November 6, 2002 for No. 874/7162 (in edition of the order of the State inspection of nuclear regulation of Ukraine of August 20, 2014 No. 118) which are applied.

2. In appendix 2 to the Regulations on the list and requirements concerning form and content of the documents submitted for receipt of the license for implementation of separate types of activity in the field of use of nuclear energy, to No. approved by the order of the State inspection of nuclear regulation of Ukraine of August 06, 2012 153, registered in the Ministry of Justice of Ukraine on August 29, 2012 for No. 1453/21765 (with changes) to exclude Sections IV, V.

With respect thereto to consider the Sections VI-VIII respectively the Sections IV-VI.

3. Declare invalid the order of the Ministry of Ecology and Natural Resources of Ukraine of August 15, 2000 No. 109 "About approval of the Regulations on the list and requirements concerning form and content of the documents provided by the operating organization for receipt of licenses for activities at specific stage of lifecycle of storage for burial of radioactive waste", No. 601/4822 registered in the Ministry of Justice of Ukraine on September 12, 2000.

4. To management to ensure safety of the treatment of radioactive waste (N.V.'s Rybalko) submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

5. This order becomes effective in two months from the date of its official publication.

6. I reserve control of execution of this order.

Changes in Conditions and safety requirements (licensed conditions) of implementation of activities in the field of the treatment of radioactive waste

1. In the Section I:

the fourth Item 1.2 to state the paragraph in the following edition:

"The subject of activities in the field of the address with Russian joint stock company - the subject of activities in the field of use of nuclear energy, including the operating organization (operator) of storage for burial of Russian joint stock company, or declared specialized enterprise according to the address from Russian joint stock company which performs intention to perform activities in the field of the address with Russian joint stock companies which are transferred from producers of Russian joint stock company to the possession of the state, and/or with the Russian joint stock companies formed owing to the Chernobyl catastrophic crash and accomplishment of military programs of the USSR in the territory of Ukraine.";

the statement in the form established in appendix 1 to these Conditions and requirements;

the copy certified of the procedure for regulations on the operating organization (operator) established by the legislation;

the certificate of qualification of personnel of the subject of activities in the field of use of nuclear energy in the form established in appendix 2 to these Conditions and requirements;

the documents certifying the level of safety of storage for burial of Russian joint stock company, the documents confirming capability of the operating organization (operator) to comply with conditions of implementation of activities at separate stage of lifecycle of storage for burial of Russian joint stock company, and also the confirming compliance of financial, material and other resources, organizational structure and personnel of the operating organization (operator) to the requirements established by regulations and rules on nuclear and radiation safety in the amount necessary for its providing. The list of documents taking into account separate stage of lifecycle of storage for burial of Russian joint stock company are given in appendices 3 - 5 to these Conditions and requirements.";
