About provision of special permission to medical activities in the field of traditional and nonconventional medicine

I ORDER:

1. Assign obligations on issue of special permission to implementation of medical activities in the field of traditional and nonconventional medicine to Committee on questions of traditional and nonconventional medicine under the Ministry of Health of Ukraine.

2. Approve:

2.1. The instruction about procedure for provision by Committee on questions of traditional and nonconventional medicine under the Ministry of Health of Ukraine of special permission for implementation of medical activities in the field of traditional and nonconventional medicine (is attached).

2.2. The procedure for carrying out certification and examination of tselitelsky capabilities of persons who showed willingness to be engaged in medical activities in the field of traditional and nonconventional medicine (is applied).

2.3. To committee on questions of traditional and nonconventional medicine under the Ministry of Health of Ukraine, to the Ministry of Health of the Autonomous Republic of Crimea, chiefs of managements of health care of the regional, Kiev and Sevastopol city public administrations to provide control of work of persons practicing in the field of traditional and nonconventional medicine according to the requirements determined by the legislation.

3. Of 25.06.93 of N 146, N2/211, "About Provision of Special Permission of the Ministry of Health of Ukraine to Medical Activities in the field of Traditional and Nonconventional Medicine" registered in the Ministry of Justice 10.01.94 to consider the order of the Ministry of Health of Ukraine invalid.

4. Under the Ministry of Health of Ukraine Garnik T. P. to provide to the chairman of Committee on questions of traditional and nonconventional medicine in accordance with the established procedure state registration of this order in the Ministry of Justice of Ukraine.

1. General provisions

1.1. The instruction determines procedure for provision by Committee on questions of traditional and nonconventional medicine under the Ministry of Health of Ukraine of special permission for implementation of medical activities in the field of traditional and nonconventional medicine (further - Special permission).

1.2. The terms which are stated below in the Instruction are used in such value:

1.2.1. Medical activities are regulated by Bases of the legislation of Ukraine on health care, other acts of the health law, regulatory legal acts of the Ministry of Health of Ukraine (further - MZ of Ukraine) activities for provision to citizens of the treatment-and-prophylactic help.

1.2.2. Traditional and nonconventional medicine (further - NINM):

Traditional medicine is the amount of all knowledge and practical methods which are applied to diagnostics, prevention and liquidation of violations of physical and mental balance which rely only on practical experience and observation, passing from father to son as in oral, and in writing.

The nonconventional medicine is the knowledge and practical methods of traditional medicine having certain author.

1.2.3. Special permission - the document confirming compliance of the particular person without vocational medical education (further - Person) to qualification requirements for implementation of medical activities in the field of NINM on condition of control from the doctor.

1.3. For receipt of Special permission person intending to perform medical activities in the field of NINM gives to Committee on questions of traditional and nonconventional medicine in case of MZ of Ukraine (daleekomitt) the statement of the established sample (appendix 1).

1.4. Are enclosed to the application the copy of the certification expert opinion of private company of the Ukrainian association of traditional medicine (Kiev) or other organizations determined by MZ of Ukraine about opportunity to perform medical activities in the field of NINM.

1.5. For consideration of the applications and permission of question concerning provision of Special permission the Committee creates the commission in number of at least five persons (further - the Commission) which is headed by the chairman of Committee.

In structure of the Commission leading experts of MZ of Ukraine and bodies of health care are attracted. The structure of the Commission affirms the order MZ of Ukraine. Commission sessions are held at least once a month. The decision of the Commission is made at least 2/3 voices from total quantity of attendees, are drawn up by protocols of meetings and affirm orders on Committee.

1.6. The decision on provision of Special permission is made on commission session within ten working days from the date of provision of the statement.
