About approval of forms of the trade patent and procedure for filling of the trade patent

According to the Law of Ukraine of March 23, 1996 I ORDER to N98/96-BP "About Patenting of Some Types of Business Activity":

1. Approve form of the standard patent for implementation of activities in retail trade, activities for exchange of cash currency values and activities for provision of services in the field of gaming, form of the trade patent for implementation of activities in retail trade which is granted free of charge and the Procedure for filling of the trade patent (are applied).

2. To the head of department of project development of the laws and instructions on the direct taxes Radyuk V. V. and chief of legal management Lonyuk I. I. provide forms of the trade patent and the Procedure for filling of the trade patent to the Ministry of Justice of Ukraine for state registration.

3. To the head of department Kovalenko V. V. cases in five-day time after state registration to order the necessary number of forms of the trade patent for implementation of activities in retail trade, activities for exchange of cash currency values and activities for provision of services in the field of gaming and the trade patent for implementation of activities in retail trade which is granted free of charge and to provide delivery of forms to the state tax authorities in the Autonomous Republic of Crimea, areas, till to Kiev and Sevastopol.

4. To impose control for execution of this order on the first deputy chief of the Main state tax authorities of Ukraine to A. I. Shitr.

Procedure for filling of the trade patent

1. Filling of details of the trade patent for the right of implementation of trading activity, activities for provision of household services, activities for exchange of cash currency values, and also activities for provision of services in the field of gaming is carried out based on article 2 of the Law of Ukraine which is drawn up according to part four "About patenting of some types of business activity" requests for acquisition of the trade patent.

2. The trade patent is filled in with the official of the state tax authority authorized on that on the location of subjects or the location of their structural (isolated) divisions. Or provide to subjects of business activity which perform trading activity household services (except portable retail chain stores), the trade patent is filled in on the location of Item of sales of goods or Item on provision of household services, and subjects of business activity which perform trade through portable retail chain stores, - in place of registration of these subjects. Trade patents are signed by the head of the state tax authority, and in case of its absence - the deputy manager of the state tax authority.

3. Entries in the trade patent are performed by ball pen paste of dark color in Ukrainian or in other language according to article 11 of the Law of Ukraine "About languages in Ukraine".

4. In the text of the trade patent of erasure and unreasonable corrections are not allowed.

5. Based on the written application of the subject of business activity concerning change of the location of registration the corresponding changes certified by the signature of the official and seal of the state tax authority are made to the trade patent.

In case of loss of the trade patent by the state tax authority the duplicate of the trade patent based on the written application of the subject of business activity and the reference of bodies of the Ministry of Internal Affairs of Ukraine, bodies of the state fire supervision or other authorized state bodies is free of charge issued.
