1. Approve Licensed conditions of implementation of activities for provision of financial loans at the expense of the raised funds by credit institutes (are applied).

2. (Mosiychuk T. K.) and to legal department (Chursin O. V.) to provide to department of state regulation and market development of financial services provision of this order in the Ministry of Justice of Ukraine for state registration.

3. Control over the implementation of the order to assign to the Member of the commission - the director of the department of supervision of credit institutes.

Licensed conditions of implementation of activities for provision of financial loans at the expense of the raised funds credit institutes

These Licensed conditions Regulations on the National commission performing state regulation in the field of the markets of financial services, No. 1070 approved by the Presidential decree of Ukraine of November 23, 2011 are developed according to the Law of Ukraine "About financial services and state regulation of the markets of financial services".

1. General provisions

1.1. In these Licensed conditions the following concepts are used in such value:

the separate division of credit institute (daleeobosoblenny division) - department or branch of credit institute which is out of its location and performs activities for provision of financial loans at the expense of the raised funds in the single closed engineering procedure with credit institute;

the raised funds - the means directly or indirectly received on returnable basis from physical persons and/or legal entities, the received remaining balance of financial assets which resulted from implementation of regular economic activity for the benefit of these persons.

The means received in the form of fees to the capital of credit institute, including the subordinated capital, received from credit institutes according to credit agreements and also the means received from local and government budgets by financial institutions - legal entities of the public law do not belong to the raised funds;

the applicant - the financial institution entered in the State register of financial institutions (further - the Register) also submits the application for receipt of license for activities on provision of financial loans at the expense of the raised funds and the having intention at the expense of the raised funds to grant financial loans on own risk (including to perform mortgage lending) according to the law;

the licensee - credit institute which obtained license for activities on provision of financial loans at the expense of the raised funds;

licensing - issue, renewal, temporary stop and cancellation of licenses, issue of duplicates and copies of the license, conducting licensed cases, control of observance by licensees of licensed conditions, issue of orders about elimination of violations of licensed conditions;

the license - the document of the established sample which certifies the right of the licensee to perform activities for provision of financial loans at the expense of the raised funds during certain term on condition of accomplishment of these Licensed conditions by it.

Other concepts are used in these Licensed conditions according to the legislation of Ukraine.

1.2. These Licensed conditions establish the requirements obligatory for accomplishment by credit institutes both at the time of receipt of the license, and during all term of its action.

Action of these Licensed conditions does not extend to credit unions and the joint credit unions.
