About approval of Rules of assignment of the next military ranks by the person liable for call-up

According to Items 102, of 103 Rules of passing of military service in the Armed Forces, other troops and military forming of the Republic of Kazakhstan approved by the Presidential decree of the Republic of Kazakhstan of May 25, 2006 No. 124 I ORDER:

1. Approve the enclosed Rules of assignment of the next military ranks as the person liable for call-up.

2. And military education of the Ministry of Defence of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan to provide to personnel department:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Defence of the Republic of Kazakhstan after its first official publication;

4) the direction of data in Legal department of the Ministry of Defence of the Republic of Kazakhstan on execution of the actions provided by subitems 1), 2) and 3) of this Item within ten calendar days from the date of state registration.

3. To impose control of execution of this order on the head of the department of personnel of the Ministry of Defence of the Republic of Kazakhstan.

4. Bring this order to officials in the part concerning them.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of assignment of the next military ranks by the person liable for call-up

Chapter 1. General provisions

1. These rules of assignment of the next military ranks by the person liable for call-up (further - Rules) 103 Rules of passing of military service in the Armed Forces, other troops and military forming of the Republic of Kazakhstan approved by the Presidential decree of the Republic of Kazakhstan of May 25, 2006 No. 124, are developed according to Items 102, and determine procedure for assignment of the next military ranks by the person liable for call-up.

2. Assignment by the person liable for call-up of the next military ranks does not involve changes in the rights and privileges on provision of pensions and medical attendance provided to them in case of dismissal from military service from Armed Forces, other troops and military forming of the Republic of Kazakhstan.

Chapter 2. Procedure for assignment of the next military ranks by the person liable for call-up

3. Assignment of the next military ranks by the person liable for call-up is made according to the terms determined by article 20 of the Law of the Republic of Kazakhstan "About military service and the status of the military personnel".

4. Military ranks and military rank of the highest sergeant structure "master sergeant" are appropriated to persons liable for call-up of officers by orders of the Minister of Defence of the Republic of Kazakhstan, military rank of the highest sergeant structure "headquarters sergeant" and the senior sergeant structure – orders of the First Deputy Minister of Defence – the chief of the General Staff of Armed Forces of the Republic of Kazakhstan, ordinary and younger sergeant structures – orders of commanders (chiefs) of military units and organizations based on which military charges are carried out.

5. In orders on assignment of the next military ranks by the person liable for call-up are reflected - military rank, surname, name and middle name (in case of its availability), year of birth, education, the name of local body of military management where the person liable for call-up stays on the military registry, personal number (for reserve officers).

6. For decision making about assignment of the next military ranks by the person liable for call-up, two copies of the appraisal sheet constituted by departments (managements) for defense in form, according to appendix to these rules, the copy of the document of the person liable for call-up proving the identity and statements from orders of officials on carrying out and on the end of training military sessions are represented to relevant organs of military management.

7. Statements from orders of officials on assignment of the next military ranks by the person liable for call-up go to the relevant departments (managements, departments) for defense for further accounting. Together with statements the second copies of appraisal sheets marked about assignment of the next military rank on inventory for familiarizing go to personal records of persons liable for call-up.

8. To reserve officers with high preparation and wide experience of occupational work and holding the leading state positions in state bodies of the Republic of Kazakhstan, the elected (appointed) to representative bodies of the Republic of Kazakhstan for which booking on mobilization from conscription is provided the next military rank on inventory is given regardless of passing of military charges.

9. For decision making about assignment of the next military ranks of officers by the person liable for call-up and the first military rank of officers "lieutenant" documents according to Item 6 of these rules go to personnel body of the Ministry of Defence of the Republic of Kazakhstan.

10. For decision making about assignment of the next military ranks by the person liable for call-up of the highest and senior sergeant structures documents according to Item 6 of these rules go to personnel body of the Ministry of Defence of the Republic of Kazakhstan.

11. No. 4 is excluded according to the Order of the Minister of Defence of the Republic of Kazakhstan of 08.01.2021

12. Materials on assignment of the next military ranks by the person liable for call-up go no later than three months from the date of the end of passing of military charges by persons liable for call-up and are implemented in the body issuing the order within a month.
