About approval of rules of the organization of work of posts of transport control in the territory of the Republic of Kazakhstan

According to the subitem 13) of article 13 of the Law of the Republic of Kazakhstan "About road transport" I ORDER:

1. Approve the enclosed Rules of the organization of work of posts of transport control in the territory of the Republic of Kazakhstan.

2. To committee of road transport and transport control of the Ministry of transport of the Republic of Kazakhstan to organize work of posts of transport control of territorial inspections of Committee of road transport and transport control of the Ministry of transport of the Republic of Kazakhstan.

3. To provide to committee of transport control of the Ministry of Transport and Communications of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan state registration of this order in the Ministry of Justice of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-Minister of Transport of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after its first official publication.

Rules of the organization of work of posts of transport control in the territory of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of the organization of work of posts of transport control in the territory of the Republic of Kazakhstan (further – Rules) are developed according to the subitem 13) of article 13 of the Law of the Republic of Kazakhstan "About road transport".

2. Rules determine procedure for the organization of work of posts of transport control of territorial authorities of Committee of road transport and transport control of the Ministry of transport of the Republic of Kazakhstan (further - Committee) in the territory of the Republic of Kazakhstan.

3. The main objectives of post of transport control of territorial authorities of Committee is ensuring compliance with the legislation of the Republic of Kazakhstan on road transport, the international treaties ratified by the Republic of Kazakhstan, safety of highways, road constructions and safe driving through them.

4. The activities of employees of post of transport control of territorial authorities of Committee connected with carrying out the state control of driving of vehicles through the territory of the Republic of Kazakhstan are regulated by international treaties in the field of motor transportations, the transport and tax legislation of the Republic of Kazakhstan, the Code of the Republic of Kazakhstan "About administrative offenses" (further – the Administrative Code), the laws of the Republic of Kazakhstan "About public service of the Republic of Kazakhstan", "About anti-corruption", the Ethical code of the government employees of the Republic of Kazakhstan approved by the Presidential decree of the Republic of Kazakhstan of December 29, 2015 No. 153 "About measures for further enhancement of ethical standards and rules of conduct of government employees of the Republic of Kazakhstan", regulatory legal acts of the Ministry of transport of the Republic of Kazakhstan, and also these rules.

5. The basic concepts and terms applied in Rules:

1) the automated station of measurement – the complex of the certified special control and measuring technical means, devices and oborudovaniye which underwent metrological checking performing photo and video filming working in the automatic mode fixing type, brand, the state registration sign, weight and dimensional parameters, axial loadings and speed of movement of automotive vehicles integrated with intelligent transportation system;

2) portable post of transport control – the post of transport control organized based on special motor transport which is equipped with technical means of control, communication and the equipment;

3) post of transport control (further – PTK) – the stationary or portable check-point equipped with technical means of control, equipped with the capital building or special motor transport;

4) measurement of weight and dimensional parameters of the vehicle – process of determination of dimensional parameters, lump and loads of axes of vehicles by means of the measuring tool and dimensional framework, and also the weight measuring equipment of stationary type or figurative mobile scales which underwent metrological checking and having the appropriate certificate;

5) change of post of transport control - the change consisting of the staff of territorial authorities of transport control, appointed according to the approved schedule for service on stationary and portable posts of transport control;

6) model – the part of the weight measuring equipment of figurative mobile scales intended for uniform load distribution on vehicle axes in case of measurement of weight parameters;

7) the portable wearable video recorder (further – video counter) – the technical device intended for implementation of audiovideo by employees of PTK;

8) the equipment of satellite navigation – the hardware-software device established on the vehicle for determination of its current location, the direction and speed of movement on signals at least two operating global navigation satellite systems, data exchange with the additional onboard equipment and also for exchange of information on networks of mobile radiotelephone communication;

9) stationary post of transport control – the post of transport control equipped with the capital building and equipped with technical means of control, communication and the equipment;

10) television system of video surveillance – set jointly the operating technical means having technical, information, program and operational compatibility intended for receipt of images about object condition.

11) the wheel lock – the special interlock established on the vehicle wheel excluding possibility of its further movement.

Chapter 2. Procedure for the organization of work of posts of transport control

6. Stationary and portable PTK are located on highways public, highways within borders of the cities or other settlements. The list of stationary PTK is approved the Governments of the Republic of Kazakhstan of July 9, 2013 No. 697 "About approval of the list of check points through Frontier of the Republic of Kazakhstan and stationary posts of transport control in the territory of the Republic of Kazakhstan".
