About approval of the Procedure for carrying out certification of production of the companies performing conversion, utilization or destruction of the low-quality and dangerous products withdrawn from circulation

For the purpose of realization of provisions of the Law of Ukraine of 14.01.2000 No. 1393 "About retirement, conversion, utilization, destruction or further use of low-quality and dangerous products" and in execution of the order of the Cabinet of Ministers of Ukraine of 11.05.2000 to No. 2249/1

I ORDER:

1. Approve the Procedure for carrying out certification of production of the companies performing conversion, utilization or destruction of the low-quality and dangerous products withdrawn from circulation it (is applied).

2. - to provide to the head of department of the state supervision and confirmation of conformity Babyak O. M. provision on state registration in the Ministry of Justice of Ukraine of the order "About Approval of the Procedure for Carrying Out Certification of Production of the Companies Performing Conversion, Utilization or Destruction of the Low-quality and Dangerous Products Withdrawn from Circulation" according to the current legislation.

3. To provide to directors of the state centers of standardization, metrology and certification of Gosstandart of Ukraine unconditional execution of the order "About Approval of the Procedure for Carrying Out Certification of Production of the Companies Performing Conversion, Utilization or Destruction of the Low-quality and Dangerous Products Withdrawn from Circulation".

4. To impose control of execution of this order on the vice-chairman Gosstandart of Ukraine Sidorenko G. S.

Procedure for carrying out certification of production of the companies performing conversion, utilization or destruction of the low-quality and dangerous products withdrawn from circulation

1. General provisions

1.1. This Procedure is developed according to article 15 of the Law of Ukraine "About retirement, conversion, utilization, destruction or further use of low-quality and dangerous products" and Minekoresursov of Ukraine, MZ of Ukraine, Gosprompolitiki of Ukraine is approved with Ministry of Economics of Ukraine, Gospredprinimatelstva of Ukraine, establishes requirements concerning work for certification of production of the companies performing conversion, utilization or destruction of the low-quality and dangerous products withdrawn from circulation (further production certification) in Ukraine.

1.2. Requirements of this Procedure obligatory for accomplishment by the companies irrespective of patterns of ownership during preparation for certification of production and its carrying out.

1.3. Production certification - official confirmation of availability of the necessary and sufficient conditions of production of certain products providing stability of accomplishment of the requirements set in regulating documents.

Certification of production is performed for the purpose of assessment of opportunities of the company to provide conversion, utilization or destruction of the low-quality and dangerous products withdrawn from circulation according to the requirements established by regulatory legal acts and regulating documents concerning the address with separate types of substances, materials and objects, protection of the surrounding environment and also of compliance to the operating sanitary and fire standards, rules and standard rates of ecological safety.

1.4 Certification of production will be organized and carried out by territorial authorities of the State committee of standardization, metrology and certification of Ukraine - the state centers of standardization, metrology and certification (further - GTsSMS). Representatives of organizations and institutions of the public sanitary and epidemiologic service of Ukraine and bodies of protection of the surrounding environment and nuclear safety enter into structure of the commission on certification (further - the commission) surely. The structure of the commission affirms the head of GTsSMS.

1.5 Works on certification of production are performed based on economic agreements.

2. General requirements to documentation of production which is certified

2.1. The company at which production certification shall be carried out shall have technical documentation set (including regulating, technological, design documentation), regulatory legal acts on protection of the surrounding environment, the sanitary and fire standards, rules and standard rates of ecological safety establishing mandatory requirements concerning the address with separate types of substances, materials and objects, including procedure and conditions of conversion, utilization or destruction of the low-quality and dangerous products withdrawn from circulation. The structure of technical documentation is determined by features of products which are subject to conversion, utilization or destruction, and engineering procedures.

The company shall have technical and organizational and administrative documentation in which data relatively are provided:

- systems of providing proper safe for health of the person and the environment of conditions of conversion, utilization or destruction of the low-quality and dangerous products withdrawn from circulation;

- accounting treatment for receipt, and also the conversion, utilization or destruction withdrawn from the product circulation;

- systems of the prevention of unauthorized use of the low-quality and dangerous products withdrawn from circulation and storage of such products in unexpected places;

- organizations of control of conversion, utilization or destruction of low-quality and dangerous products;

- responsibility of personnel for observance of requirements of technological documentation on conversion, utilization or destruction of low-quality and dangerous products;

- control systems of engineering procedure of conversion, organization or destruction of low-quality and dangerous products;

- control systems behind modification of technical documentation;

- the availability of means of the measuring equipment and control and the test equipment which are used on production;

- systems of checking of means of the measuring equipment and certification of the test equipment;

- procedure for forming and designation of lots of products, procedure for forming and designation of selections from them for testing or control;

- order of registration of results of testing and control, creation, approval and storage of test reports;

- systems of the prevention and timely accident elimination and extreme situations in the company.

3. Procedure for certification of production

3.1. Implementation of works on certification of production provides accomplishment of such stages:

- provision of the request;

- preliminary estimation;

- production check.

3.2. Provision of the request

3.2.1. GTsSMS which is carrying out production certification shall provide from day of the address to the applicant samples of the request and questionnaire.

3.2.2. The main objective of certification of production is assessment of conformity of information containing in the questionnaire and the submitted documents, to actual state is direct at the company.

3.2.3. For carrying out certification the company submits to GTsSMS in duplicate the application (appendix 1) and the questionnaire on production certification (appendix 2), and also in one copy the documents specified in the questionnaire.

3.2.4. The questionnaire is filled in with the company applicant (daleepredpriyaty).

3.2.5. In the questionnaire the reference to standards of the company, technological and other documents of rather engineering procedures of conversion of specific type of products and for regulating documents of rather compound components, output materials, substances and so forth is allowed.

3.3. Preliminary estimation

3.3.1. Preliminary estimation of the questionnaire and documents is carried out by certifying commission to the terms approved by the applicant and the contractor, but no more than 10 days from day of provision of the questionnaire.

3.3.2. The provisional estimate of the questionnaire and documents shall provide:

1) check of compliance of the indicators and product characteristics established by technical documentation, to requirements of standards and other regulating documents which extend to products and engineering procedures of its conversion, utilization or destruction;

2) assessment of all control transactions and testing provided by technological documentation and requirements of standards, on them extending;

3) verification of presence of the control system in technological documentation of process of the conversion, utilization or destruction withdrawn from the product circulation;

4) verification of presence of system of metrological support of means of the measuring equipment, control and testing which are applied.

3.3.3. The commission can request, in case of the need, from the company other data of rather technical capabilities of production.

3.3.4. By results of preliminary estimation by the commission the conclusion about readiness of the company for certification and feasibility of carrying out further works is constituted. The conclusion is signed by the head of commission.

3.4. Production check

3.4.1. Objects of check of production are:

1) availability in enough production personnel for ensuring compliance with the engineering procedures and performance of works connected with the conversion, utilization or destruction withdrawn from the product circulation;

2) organization and functioning of system of engineering supervision;

3) condition of control of the conversion, utilization or destruction withdrawn from the product circulation;

4) control of observance of engineering procedures;

5) condition of metrological support;

6) equipment of test laboratory (in case of its availability). The company can perform testing of products for compliance to requirements of regulating documents in own or third-party (under the agreement) the test (measuring) laboratory accredited according to requirements of article 32 of the Law of Ukraine "About metrology and metrological activities";

7) condition of the equipment of production rooms;

8) providing conditions of packaging, storage, marking and transportation;

9) availability of test reports of products which are made as a result of conversion, utilization or destruction withdrawn from the product circulation.

3.4.2. Before work of the commission directly at the company distribution of obligations between members of the commission is performed and responsible persons of the company for the directions of check are fixed.

3.4.3. By results of production check the commission draws up the statement containing the analysis of results of check and the reasonable conclusion. The act is signed by members of the commission, from organizations and institutions of the public sanitary and epidemiologic service - the chief health officer of the territory also claims the head of GTsSMS.

The director gets acquainted with the act under list.

3.4.4. Based on the positive conclusions of the commission of GTsSMS draws up the certificate of production (appendix 3), registers it in the Register of the state system of UKRSEPRO and issues to the company together with the inspection statement.

3.4.5. The certificate of production issued on this Procedure is acting within three years.

3.4.6. Repeated certification of production is carried out in connection therewith by Procedure.

4. Consideration of matters of argument

4.1. In case of disagreement with the conclusions of the commission for which it is impossible to certify production the company has the right in a month to send the statement to GTsSMS. Depending on justification of this statement repeated certification of production by other structure of the commission can be appointed. GTsSMS reports to the applicant within 10 days from day of receipt of the statement about the decision. In case of disagreement with the conclusions of the commission after repeated check, the company has the right to address to the State committee of standardization, metrology and certification of Ukraine for final permission of question of production certification.
