According to article 8 of the Law of Ukraine "About licensing of certain types of economic activity" and resolutions of the Cabinet of Ministers of Ukraine of November 14, 2000 No. 1698 "About approval of the list of bodies of licensing"

WE ORDER:

1. Approve Licensed conditions of implementation of the economic activity connected with trade catch of fish on industrial sites of fishery reservoirs except internal reservoirs (ponds) of farms which are applied.

2. To management of licensing of types of economic activity of Department of registration and licensing Gospredprinimatelstva of Ukraine (Efremov O. V.), to State department of fishery of Minagropolitiki of Ukraine (Shvedenko M. M.) in accordance with the established procedure to provide provision of this order on state registration in the Ministry of Justice of Ukraine.

3. To provide to State department of fishery of Minagropolitiki of Ukraine the publication of this order.

4. To impose control of execution of the order on the vice-chairman Gospredprinimatelstva of Ukraine Tretyakov S. I. and Chairman Ukrgosrybkhoz Minagropolitiki of Ukraine of Shvedenko M. M.

Licensed conditions of implementation of the economic activity connected with trade catch of fish on industrial sites of fishery reservoirs except internal reservoirs (ponds) of farms

1. General provisions

1.1. Licensed conditions of implementation of the economic activity connected with trade catch of fish on industrial sites of fishery reservoirs except internal reservoirs (ponds) of farms (further in the text - Licensed conditions), it is developed according to the Laws of Ukraine "About entrepreneurship", "About licensing of certain types of economic activity", resolutions of the Cabinet of Ministers of Ukraine of November 14, 2000 No. 1698 "About approval of the list of bodies of licensing", the basic principles of state policy providing accomplishment in the field of licensing.

1.2. Licensed conditions establish qualification, organizational, production and other requirements to implementation of the economic activity connected with trade catch of fish on industrial sites of fishery reservoirs except internal reservoirs (ponds) of farms (further in the text - industrial fishing).

1.3. Action of these Licensed conditions extends to all subjects of housekeeping - registered in the procedure for legal entities established by the legislation irrespective of their form of business and pattern of ownership which perform or intend to perform trade fishing, and also on physical persons - the subjects of business activity performing or intending to perform activities in the specified area.

1.4. Adoption of documents which go for receipt of the license issue, renewal and cancellation of licenses, issue of copies and duplicates of licenses, conducting licensed cases and licensed registers, control within the competence of observance by business entities (further in the text - licensees) licensed conditions, issue of orders about elimination of violations of licensed conditions, and also orders about elimination of violations of the law in the field of licensing of the activities connected with trade catch of fish on industrial sites of fishery reservoirs except internal reservoirs (ponds) of farms, is carried out by State department of fishery of the Ministry of agrarian policy of Ukraine (further in the text - Ukrgosrybkhoz).

1.5. Licenses for trade fishing are drawn up on forms of the single sample approved by the resolution of the Cabinet of Ministers of Ukraine of November 20, 2000 No. 1719 "About introduction of the license of single sample for certain types of economic activity" and issued by Ukrgosrybkhoz signed by the head or his deputy who is sealed Ukrgosrybkhoza.

1.6. The license is granted to the applicant personally not later than in three working days after receipt of the document confirming introduction of payment for licensing. Licensing is registered in the numbered, stitched and sealed register of statements and the granted licenses.

2. Terms and determinations

2.1. The terms determined in these Licensed conditions are used in such value:

2.1.1. The fishing tool - grids, seine, trawls, traps which perform trade fishing.

2.1.2. Quota - limit share which is allocated to the licensee.

2.1.3. Limit - the allowed volume of withdrawal of fish from the environment.

2.1.4. Place of acceptance, the reception vessel - the room (vessel) adapted (according to sanitary, technological standards) for acceptance of the withdrawn fish, posortirovanny by types, for its further storage.

2.1.5. The fisher - person who is directly performing withdrawal of fish from the environment.

2.1.6. Fishery water object - water object (its part) which is used or can be used for fishery requirements.

3. Qualification requirements

3.1. Qualification requirements to fishers who perform trade fishing as a part of production divisions of the licensee, such: complete or basic general secondary education, without requirements to length of service.

3.2. Qualification requirements to the fishers responsible for implementation of trade fishing of the licensee by production division, such: complete general secondary education or vocational training. Advanced training. Length of service by profession fisher at least 3 years. Shall know requirements of these Licensed conditions.

4. Organizational requirements

4.1. For receipt of the license for implementation of trade fishing the subject of housekeeping submits the application for licensing to Ukrgosrybkhoz (appendix 1). Documents according to article 10 of the Law of Ukraine "About licensing of certain types of economic activity" shall be enclosed to the application.

4.2. The statement for licensing and documents which are attached to it are accepted in the folder by description (appendix 2) which copy is issued to the applicant with Ukrgosrybkhoz's mark about acceptance date of documents and the signature of the responsible person.

4.3. All documents filed by the applicant are created in separate licensed case.

4.4. Ukrgosrybkhoz for implementation of the procedure of licensing creates the licensed commission. Regulations on the licensed commission and its structure affirm the order of the Ministry of agrarian policy of Ukraine.

4.5. The decision of the licensed commission is drawn up by the protocol of its meeting, affirms Ukrgosrybkhoz's order and is the basis for licensing, refusal in licensing, renewals of the license, recognition of the invalid license, cancellation of the license, cancellation of the decision on licensing.

4.6. In case of loss or damage of the license the licensee shall file in Ukrgosrybkhoz petition for issue of the duplicate of the license (appendix 3).

4.7. The licensee who submitted the application and the relevant documents for issue of the duplicate of the license instead of lost or damaged, can perform the activities based on Ukrgosrybkhoz's certificate of provision of the statement for issue of the duplicate of the license for the period before date of issue of the duplicate of the license.

4.8. In case of the bases for renewal of the license the licensee shall submit within ten working days to Ukrgosrybkhoz the application for renewal of the license (appendix 4) together with the license which is subject to renewal, but the relevant documents or their notarially attested copies confirming the specified changes.

4.9. The licensee who submitted the application and the relevant documents on renewal of the license can perform the activities based on the certificate of adoption of the specified documents in consideration which is issued by Ukrgosrybkhoz for the period before date of issue of the renewed license.

4.10. The licensee shall:

provide storage, transportation, and also delivery of the withdrawn fish on places of acceptance in accordance with the established procedure;

issue to the fishers responsible for fishing in its production divisions, all necessary documents granting the right to perform trade fishing;

in case of implementation of trade of certain species of fish which catch is subject to quoting to receive their catch quotas.

5. Normative requirements

5.1. The licensee when implementing trade fishing shall observe requirements:

5.1.1. The Maritime Code of Ukraine in the part concerning fishing, acceptance, storage, transportation of fish.

5.1.2. Laws of Ukraine:

"About licensing of certain types of economic activity";

"About protection of the surrounding environment" and "About fauna".

5.1.3. Resolutions of the Cabinet of Ministers of Ukraine:

of September 28, 1996 No. 1192 "About approval of the Temporary procedure for maintaining fishery and implementation of fishery";

of August 27, 1999 No. 1583 "About technical supervision of courts of fishery of Ukraine which are not subject to supervision of classification society".

5.1.4. Other regulatory legal acts, in particular:

The instruction about procedure for special use of water live resources approved by the general order of the Ministry of protection of the surrounding environment and nuclear safety of Ukraine and the State committee of fishery of Ukraine of February 10, 2000 No. 34/13 (it is registered in the Ministry of Justice of Ukraine on February 25, 2000 for No. 106/4327);

The instruction about procedure for calculation and introduction of payments for special use of fish and other water live resources approved by the general order of Goskomrybkhoz, Ministry of Economics, Ministry of Finance, Minekobezopasnosti and State Tax Administration of Ukraine of December 24, 1999 No. 167/156/299/300/650 (it is registered in the Ministry of Justice of Ukraine on January 14, 2000 for No. 17/4238);

Instructions for carrying out technical supervision of courts of fishery of Ukraine which are not subject to supervision of classification society the agrarian policy of Ukraine approved by the order of the Ministry of November 13, 2000 No. 226 (it is registered in the Ministry of Justice of Ukraine on December 26, 2000 for No. 949/5170);

Regulations on system of remote monitoring of vessels of the fishery fleet approved by the order of the Ministry of agrarian policy of Ukraine of the December 25, 2003 No. 466 and registered in the Ministry of Justice of Ukraine on December 30, 2003 for No. 1258/8579;

Regulations on preparation and advanced training of helmsmen-mechanics of small size vessels of Goskomrybkhoz of Ukraine approved by the order of the State committee of fishery of Ukraine of 23.09.98 No. 129 and registered in the Ministry of Justice of Ukraine on January 5, 1999 for No. 6/3299.

6. Production requirements

6.1. Depending on the location of fishery water object the licensee shall perform trade fishing on industrial sites in terms, fishing tools, the technical and industrial equipment which are determined:

The rules of trade fishery in the basin of the Black Sea approved by the order of the State committee of fishery of Ukraine of December 8, 1998 No. 164 (it is registered in the Ministry of Justice of Ukraine on March 9, 1999 for No. 147/3440);

The provisional rules of trade fishery in the basin of the Sea of Azov approved by the order of the State committee of fishery of Ukraine of December 31, 1999 No. 172 (it is registered in the Ministry of Justice on January 25, 2000 for No. 43/4264);

The rules of trade fishery in fishery water objects of Ukraine approved by the order of the State committee of fishery of Ukraine of March 18, 1999 No. 33 (it is registered in the Ministry of Justice of Ukraine on May 25, 1999 for No. 326/3619).
