About approval of the Regulations on conditions and procedure for provision of advance subsidies for startapovsky projects from National fund of development of agricultural industry and the rural zone

Based on part (6) article 23 of the Law No. 276 of December 16, 2016 on the principles of subsidizing of agricultural producers (The official monitor of the Republic of Moldova, 2017, Art. No. 67-71, 93) DECIDES: the Government

1. Approve Regulations on conditions and procedure for provision of advance subsidies for startapovsky projects from National fund of development of agricultural industry and the rural zone it (is applied).

2. The subsidies provided based on this Resolution are not government assistance and do not fall under action of provisions of the Law No. 139 of June 15, 2012 on government assistance and the Regulations on the little significant help approved by the Resolution of plenum of Competition council No. 2 of August 30, 2013.

3. Annual assignments from National fund of development of agricultural industry and the rural zone for financing of startapovsky projects will constitute, according to part (3) article 23 of the Law No. 276 of December 16, 2016 on the principles of subsidizing of agricultural producers, at least 5% of the general size of fund.

4. To impose control of execution of this resolution on the Ministry of Agriculture and the food industry.

Regulations on conditions and procedure for provision of advance subsidies for startapovsky projects from National fund of development of agricultural industry and the rural zone

Chapter I General provisions

1. In sense of the Regulations on conditions and procedure for provision of advance subsidies for startapovsky projects from National fund of development of agricultural industry and the rural zone (further - the Provision) the concepts determined in the Law No. 276 of December 16, 2016 on the principles of subsidizing of agricultural producers and in Regulations on conditions, the procedure and the procedure of provision of means of National fund of development of agricultural industry and the rural zone approved by the Order of the Government No. 455 of June 21, 2017 are used.

Also for the purpose of these Regulations the following concepts are used:

1) the account of conditional deposition - the bank account opened in one of commercial banks of the Republic of Moldova in Moldovan lei, opened as a result of signing of the tripartite contract between bank, intervention and payments Agency in the field of agricultural industry (further - the Agency) and the receiver by means of whom all financial resources connected with the investment project after its approval will be administered;

2) joint financing - providing own sources with the applicant (acceptable and unacceptable expenses) necessary for implementation of the startapovsky project and receipt of access to advance subsidies. Joint financing can be provided for the account: own money, bank loans, loans, bank guarantees, technical credits, guarantee agreements;

3) the technical credit - the security agreement of joint financing of expenses offered the agricultural manufacturing debutant by the contractor/supplier of the goods/services which are subject of the startapovsky project of agreements of delivery/accomplishment which shall be paid by the beginning agricultural producer at the scheduled time;

4) acceptable investment - set of the acceptable expenses performed in case of realization of investments into construction materials, landing material, the equipment and stock, according to appendix No. 1 to this Provision, put since current year subsidizings;

5) submeasures compatible - support submeasures which belong to the same sphere of activity or by means of combination of which can develop the integrated investment projects with high value added;

6) the agricultural manufacturing debutant - the microcompany or small enterprise which is recently registered in accordance with the established procedure, created and headed by young farmers, female farmers and the come-back migrants who for the first time perform economic activity;

7) the new registered agricultural producer - agricultural producer from the moment of which registration as the subject of business activity until filing of application on receipt of advance subsidy there passed less than one year;

8) the investment project - set of the investments acceptable and unacceptable which realization is necessary to bring the business idea to the level of the business making profit;
