About modification of the Regulations on the admission of the Russian carriers to implementation of the international motor transportations

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to the Regulations on the admission of the Russian carriers to implementation of the international motor transportations approved by the order of the Government of the Russian Federation of October 16, 2001 No. 730 "About approval of the Regulations on the admission of the Russian carriers to implementation of the international motor transportations" (The Russian Federation Code, 2001, No. 43, Art. 4109; 2002, No. 41, Art. 3983; 2006, No. 52, Art. 5587; 2007, No. 17, Art. 2048; 2009, No. 48, Art. 5830; 2012, No. 22, Art. 2877).

2. Recognize to invalid:

items 4 and 6 changes which are made to the Regulations on the admission of the Russian carriers to implementation of the international motor transportations approved by the order of the Government of the Russian Federation of October 16, 2001 No. 730, approved by the order of the Government of the Russian Federation of April 14, 2007 No. 232 "About modification of the order of the Government of the Russian Federation of October 16, 2001 No. 730" (The Russian Federation Code, 2007, No. 17, the Art. 2048);

Item of 8 changes which are made to Regulations on the admission of the Russian carriers to implementation of the international motor transportations approved by the order of the Government of the Russian Federation of May 24, 2012 No. 505 "About modification of the Regulations on the admission of the Russian carriers to implementation of the international motor transportations" regarding the changes made to the paragraph the fifth Item 21 of the specified Provision (The Russian Federation Code, 2012, No. 22, the Art. 2877).

Changes which are made to Regulations on the admission of the Russian carriers to implementation of the international motor transportations

1. Declare item 4 invalid.

2. To add paragraph two of Item 5 with the words "according to the procedure, established by the paragraph third Item 22 (1) this provision".

3. In Item 7:

a) in paragraph one of the word "in place of registration" to exclude;

b) in subitem 1:

"the documents confirming compliance of financial position of the Russian carrier to requirements of the subitem 4 Items 3 this provision (the balance sheet and the report on financial results for the last accounting period on the date of filing of application or data on the cadastral cost of real estate objects and (or) market value of the property which is in the property of carrier determined according to the legislation on estimative activities).".

4. In Item 9:

a) the paragraph one to state in the following edition:

"9. Effective period of the certificate specified in paragraph three of Item 8 of this provision according to the application of its owner submitted in body of transport control and supervision not later than 30 calendar days before the termination of effective period of this certificate is prolonged for the term specified in the statement, but no more than for 5 years. Such prolongation is performed no more than 2 times.";

b) add with the paragraph of the following content:

"The admission of the Russian carrier to implementation of the international motor transportations in case of expiration of the certificate issued to it is drawn up according to the procedure, provided by Items 5 - 7(1) this provision, with certification, the Item 8 of this provision specified in paragraph three.".

5. In Item 10:

a) the paragraph one after words of "vehicle park" to add with words ", assumed to use for the international motor transportations,";

b) in the paragraph the second to exclude the words "in place of registration";

c) the fourth to state the paragraph in the following edition:

"data about everyone again acquired and assumed to use for the international motor transportations the vehicle provided by paragraphs the second - the fourth the subitem 2 of Item 7 of this provision.";

d) add with the paragraph of the following content:

"Issue of card of the admission on the vehicle which is again acquired and assumed to use for implementation of the international motor transportations is performed by body of transport control and supervision within 5 working days from the date of filing of application about issue of card of the admission.".

6. To state the paragraph of the sixth of Item 15 in the following edition:

"The body of transport control and supervision makes the decision on refusal in issue or refusal in prolongation of effective period of the certificate which is drawn up by the order, and notifies on it the Russian carrier with the corresponding reasons according to the procedure, established by the paragraph third Item 22 (1) this provision.".

7. In Item 16:

a) add subitem 2 with words ", and also the certificate of professional competence of the international automobile carrier granted according to the Agreement on harmonization of requirements to additional training and professional competence of the international automobile carriers of the State Parties of the CIS of November 24, 2006";

b) add with the subitem 5 of the following content:

"5) within one working day from the date of transfer of right of possession by the vehicle on which the admission card is issued, to other person to notify on it body of transport control and supervision according to the procedure, established by paragraph one of Item 22 (1) this provision.".

8. Add Item 17 with paragraphs of the following content:

"If the owner of the certificate transferred right of possession the vehicle on which the admission card is issued, to other person, such card of the admission the decision of body of the transport control and supervision which is drawn up by the order is recognized invalid from the date of receipt of the notification provided by the subitem 5 of Item 16 of this provision or from the date of identification by the owner of the certificate of obligation specified by body of the fact of non-execution on submission of the specified notification. The body of transport control and supervision informs on the made decision of the owner of the certificate within 3 working days from the date of its acceptance.

Issue of admission card to carrier on the vehicle concerning which the card of the admission is issued to other carrier is not performed before expiration of card of the admission or before recognition its invalid in the case provided by the paragraph the second this Item.".

9. Add Item 20 with the paragraph of the following content:

"The body of transport control and supervision makes the decision on pronouncement of the prevention or on suspension or cancellation of the certificate which is drawn up by the order, and informs on it the owner of the certificate with the corresponding reasons within 3 working days from the date of its acceptance according to the procedure, established by the paragraph third Item 22 (1) this provision. According to the decision on suspension or cancellation of the certificate of the certificate it is suspended or cancelled in 10 working days from the date of adoption of such decision.".

10. Add with Items 20 (1) - 20(4) following contents:

"20(1). The body of transport control and supervision makes the decision on pronouncement of the prevention in the following cases:

1) involvement of the owner of the certificate to the administrative responsibility for violation of the procedure of the international motor transportations established by the legislation of the Russian Federation before the expiration of one year from the date of the end of execution of the resolution on purpose of administrative punishment for earlier made violation of the specified procedure;

2) factual determination of non-execution by the owner of the certificate of the obligation provided by the subitem 5 of Item 16 of this provision, and (or) violation by it of the prohibition provided by paragraph one of Item 17 of this provision, and (or) the fact of transfer to other carrier of foreign permission of competent authority of the foreign state issued to the Russian carrier according to Rules of issue of the Russian permissions and special one-time permissions to implementation of the international motor transportation from the territory or on the territory of the third state to foreign carriers and also foreign permissions and multilateral permissions to the Russian carriers approved by the order of the Government of the Russian Federation of February 16, 2008 No. 89 "About approval of Rules of issue of the Russian permissions and special one-time permissions to implementation of the international motor transportation from the territory or on the territory of the third state to foreign carriers, and also foreign permissions and multilateral permissions to the Russian carriers";

3) numerous (2 and more times) within calendar year from the date of receipt of the certificate the receipt from competent authorities of foreign states of copies of decisions on involvement of the Russian carrier to responsibility for violation of provisions of international treaties of the Russian Federation in the field of the international automobile communication made in the territories of the corresponding foreign states.

20(2). The body of transport control and supervision makes the decision on suspension of action of the certificate for the term of no more than 6 months in case of availability of the basis for removal by body of transport control, repeated within year, and supervision of the warning to carrier on the bases provided by subitems 1 and (or) 2 of Item 20 (1) this provision.

20(3). The body of transport control and supervision makes the decision on cancellation of the certificate in the following cases:

1) availability of the bases for repeated suspension of action of the certificate within calendar year from the date of decision making about suspension of action of the certificate, stipulated in Item 20(2) this provision;

2) non-compliance by the owner of the certificate with any of conditions, stipulated in Item 3 this provision;

3) implementation concerning the owner of the certificate of liquidation of the legal entity or the termination of its activities as a result of reorganization, except for transformations, or cancellation of its certificate on state registration of the citizen as the individual entrepreneur.

20(4). Information on suspension of action or cancellation of the certificate, and also on recognition invalid cards of the admission is posted on the Internet on the official site of Federal Service for the Oversight of Transport within 3 working days from the date of adoption of the relevant decision.".

11. In Item 21:

a) state paragraph two in the following edition:

"After receipt of the adequate notice the body of transport control and supervision performs check of elimination by the owner of the certificate of the violations which entailed suspension of action of the certificate, makes the decision on renewal of its action and return of the certificate and cards of the admission and notifies on it the owner of the certificate according to the procedure, established by the paragraph third Item 22 (1) this provision, and also places the specified information on the Internet on the official site of Federal Service for the Oversight of Transport within 5 working days from the date of adoption of this decision.";

b) paragraphs the fourth and fifth to recognize invalid.

12. Declare Item 22 invalid.

13. In Item 22 (1):

a) word in paragraph one", and the documents attached to them" shall be replaced with words "and the documents attached to them, the transfer notice of right of possession the vehicle on which the admission card is issued, to other person";

b) third after the words "about cancellation of the certificate" to add the paragraph with words ", about return of the certificate and cards of the admission";

c) in paragraph four:

after the words "in case of the personal address of the applicant" to add with the words "or his legal representative";

exclude the words "in the place of its registration".

14. Add Item 23 with the subitem 7 of the following content:

"7) the state registration sign of the vehicle on which the admission card is issued.".

15. Declare Item 24 invalid.
