About the Procedure for issue of licenses by sight economic activity - export, import of the equipment and disks for laser systems of reading
According to the Laws of Ukraine "About features of state regulation of the activities of subjects of housekeeping connected with production, export, import of disks for laser systems of reading", "About licensing of certain types of economic activity", resolutions of the Cabinet of Ministers of Ukraine of November 14, 2000 N1698 "About Approval of the List of Bodies of Licensing" of July 4, 2001 No. 756 "About approval of the list of documents which are enclosed to the application for licensing for separate type of economic activity"
I ORDER:
1. Approve the Procedure for issue of licenses by sight of economic activity - export, import of the equipment and disks for laser systems of reading which is applied.
2. Assign functions on registration and issue of licenses by sight of economic activity - export, import of the equipment and disks for laser systems of reading to department of non-tariff regulation of department of regulation of foreign economic activity.
3. To impose control of execution of this order on the Deputy State secretary Stetsenko V. O.

This Procedure is developed according to article 5 of the Law of Ukraine "About features of state regulation of the activities of subjects of housekeeping connected with production, export, import of disks for laser systems of reading" and determines the mechanism of consideration and issue of licenses by sight of economic activity - export, import of the equipment and disks for laser systems of reading (further - licenses) in the Ministry of Economic Development and Trade of Ukraine and concerning the European integration of Ukraine.
1.1. Licenses by sight of economic activity - export, import of the equipment and disks for laser systems of reading are issued to the business entities registered in the territory of Ukraine, all patterns of ownership and irrespective of the place of state registration.
1.2. In the license the type of economic activity on export, import of the equipment and disks for laser systems of reading is specified (in full or partially).
1.3. Licenses are drawn up on forms of the single sample approved by the resolution of the Cabinet of Ministers of Ukraine of November 20, 2000 No. 1719 "About implementation of the license of single sample for certain types of economic activity" with appendix to the license.
2.1. For receipt of export licenses, import of the equipment and disks for laser systems of reading go such documents:
the statement of the established sample for licensing (appendix 1);
the list of administrative board of business entity (the head, his deputies, the chief accountant) with indication of surname, name and middle name, post, number of office number signed by the head both under seal and the reference on founders signed by the head of the subject of housekeeping, under seal;
the copies of the documents confirming the property right or leases to storage facilities certified in accordance with the established procedure;
the copies of the documents confirming data on the room in which wholesale and/or retail trade by disks for laser systems of reading will be performed certified in accordance with the established procedure (for the import license of disks);
the list of the main nodes for the specialized equipment on production of disks for laser systems of reading, export or import of which is subject to licensing according to the legislation (for export licenses, import of the equipment).
2.2. Business entities of Ukraine bear responsibility for unauthenticity of data in the documents filed to the Ministry of Economic Development and Trade of Ukraine and concerning the European integration.
2.3. Documents for receipt of licenses (further - documents) go to the Ministry of Economic Development and Trade of Ukraine and concerning the European integration of Ukraine and are accepted according to the inventory (appendix 2) which copy is issued to the applicant with mark about date of documents acceptance by body of licensing and the signature of the responsible person (the specialist of department of non-tariff regulation of department of regulation of foreign economic activity).
2.4. During documents acceptance their check on completeness and registration is performed. On documents the print of special number seal "For registration" with indication of date of documents acceptance and entrance number becomes and the corresponding logging of accounting of statements and the granted licenses of subjects of housekeeping by sight of economic activity - export, import of the equipment and disks for laser systems of reading is made (appendix 3).
2.5. The statement remains without consideration if:
the application is submitted (signed) by person which does not have on it powers;
documents are processed with violation of requirements, the stipulated in Clause 10 Laws of Ukraine "About licensing of certain types of economic activity";
there are no physical persons in the Unified State Register of Legal Entities and - entrepreneurs of information about the applicant or the available data on finding of the legal entity in termination condition by liquidation (stay of the physical person - the entrepreneur in condition of the termination of business activity) or about state registration of its termination (state registration of the termination of business activity of the physical person - the entrepreneur).
2.6. Without consideration of the applicant no later than ten working days from registration date of documents report about leaving of documents in writing with indication of the bases. After elimination of the reasons which caused leaving of documents without consideration, the applicant can repeatedly submit the application which is considered in accordance with the established procedure.
2.7. Consideration of documents for issue of licenses performs department of non-tariff regulation of department of regulation of foreign economic activity with the assistance of department of state regulation of foreign economic activity of department of regulation of foreign economic activity of department of legal support of foreign economic activity of legal department. The specified departments according to this Procedure and within the competence perform consideration of documents on the following questions:
the department of non-tariff regulation performs documents acceptance, accompanies their passing, generalizes the conclusions of the relevant departments, prepares the draft decision about issue or refusal in licensing, performs registration and issue of licenses;
the department of legal support of foreign economic activity of legal department performs consideration of documents regarding their compliance to the legislation of Ukraine;
the department of state regulation of the external economic transactions performs consideration of documents regarding application of special sanctions against the subject of housekeeping.
2.8. The term of consideration of documents in each department shall not exceed two working days.
2.9. Based on the conclusions of departments the decision on issue or refusal in licensing in time no later than ten working days from registration date of the statement for licensing and the documents enclosed to the application is made. The applicant is informed on the made decision in writing on the official form of the Ministry of Economic Development and Trade of Ukraine and concerning the European integration of Ukraine. The decision is sent or issued to the applicant within three working days from the date of its acceptance.
In the decision on refusal in licensing the bases of such refusal are specified.
2.10. The bases for decision making about refusal in licensing are:
unauthenticity of data in the documents filed by the applicant;
discrepancy of the applicant according to the filed documents to the Licensed conditions established for the sake of appearances economic activity - export, import of the equipment and disks for laser systems of reading.
2.11. In case of refusal in licensing based on detection of doubtful data in the filed documents the new statement for licensing can be accepted not earlier than in three months from decision date about refusal in licensing.
In case of refusal in licensing based on discrepancy of the applicant to the established licensed conditions the new statement for licensing can be accepted after elimination of the reasons which became the basis for refusal in licensing.
The decision on refusal in licensing can be appealed judicially.
2.12. For licensing the payment in the government budget in the amount of, established by the Cabinet of Ministers of Ukraine is collected.
In case of adoption of the document confirming introduction of payment for licensing the purpose of payment on account number is controlled. About acceptance date of the payment order the mark in the copy of the description of the accepted documents becomes.
2.13. The license is drawn up no later than three working days from receipt date of the document confirming introduction of payment for licensing (with mark of bank about payment) about money transfer in the government budget.
If the applicant within thirty calendar days from the date of the direction to him of the message on decision making on licensing did not file the document confirming introduction of payment for licensing or did not address for receipt of the drawn-up license, the Ministry of Economic Development and Trade of Ukraine and concerning the European integration of Ukraine has the right to abolish the decision on licensing or to make the decision on recognition of invalid such license.
2.14. Licenses are signed by the First Deputy Minister, the deputy minister - the chief of staff or the deputy minister according to distribution of obligations.
2.15. The license is granted to the physical person - the entrepreneur, the head of the subject of housekeeping in the presence of the document proving their identity or to the authorized representative of the subject of housekeeping on condition of provision in the Ministry of Economic Development of Ukraine of the original of the power of attorney certifying the right to the license, and identity document of the representative.
About licensing the corresponding entry in numbered, strung together and register of statements under seal and the licenses granted to subjects of housekeeping by sight of economic activity - export, import of disks for laser systems of reading, matrixes in the established form is made (appendix 3).
2.16. For each branch, each separate division of the applicant which will perform economic activity based on the obtained license and which location is specified in the submitted application attested copies of licenses are issued.
2.17. For issue of the copy of the license the payment in the government budget in the amount of one tax-free minimum of the income of citizens is collected.
2.18. In case of creation at the licensee of new branch, other new separate division which will perform type of economic activity according to the obtained license the licensee shall submit the application for issue of the copy of the license, and also documents according to Items 2.1 of this Procedure.
3.1. Licenses are granted for a period of 3 years and are the basis for implementation of the economic activity connected with export, import of the equipment and disks for laser systems of reading in all territory of Ukraine. The licensee cannot transfer the license or its copy to other legal entity or physical person for implementation of economic activity.
3.2. In case of cessation of production of the type of economic activity by branch, separate division specified in the license on which the copy of the license was issued the licensee shall within ten working days from the date of the termination report about it in the Ministry of Economic Development and Trade of Ukraine in writing. The Ministry of economic development and trade of Ukraine enters corresponding changes in the licensed register no later than the next working day from receipt date of such notification.
3.3. In case the licensee intends to perform the type of economic activity specified in the license after the termination of term of its action, he shall obtain the new license in accordance with the established procedure. The new license is granted by body of licensing not earlier than in the last working day of action of previously granted license.
3.4. The bases for renewal of the license are:
change of the name of the legal entity (if change of the name is not connected with reorganization of the legal entity) or surname, name, middle name of the physical person - the entrepreneur;
change of the location of the legal entity or residence of the physical person - the entrepreneur;
the changes connected with implementation by the licensee of the certain type of economic activity specified in article 9 of the Law of Ukraine "About licensing of certain types of economic activity".
3.5. In case of the bases for renewal of the license the licensee shall give within ten working days to the Ministry of Economic Development and Trade of Ukraine and concerning the European integration of Ukraine:
statement for renewal of the license (appendix 4);
the license which is subject to renewal;
the relevant documents or their notarially attested copies confirming the specified changes.
3.6. The license renewed on the new form taking into account the changes specified in the statement for renewal of the license is issued within three working days from receipt date of the statement for renewal of the license and documents which are attached to it.
Along with the licensee renewed on the new form by the license based on data of the licensed register attested copies licenses according to the submitted application free of charge are granted.
In case of renewal of the license in connection with the changes connected with implementation by the licensee of the certain type of economic activity specified in part three of article 9 of the Law of Ukraine "About licensing of certain types of economic activity" if this change is connected with intentions of the licensee to expand the activities the license it is renewed according to the procedure and the terms provided for licensing.
3.7. In case of renewal of the license the decision on recognition of the invalid license which was renewed, with entering of corresponding changes into the licensed register no later than the next working day is made.
3.8. Effective period of the renewed license cannot exceed the effective period specified in the license which was renewed.
For renewal of the license the payment in the government budget in the amount of five tax-free minima of the income of citizens is collected.
3.9. The licensee which submitted the application and the relevant documents on renewal of the license can perform the activities based on the certificate of reception of an application of renewal of the license for implementation of economic activity which is granted by the Ministry of Economic Development and Trade of Ukraine and concerning the European integration of Ukraine in case of provision of the statement for renewal of the license.
3.10. The license which is not renewed at the scheduled time is invalid.
3.11. The basis for decision making about cancellation of the license is:
statement of the licensee for cancellation of the license;
act of further violation by the licensee of licensed conditions;
availability in the Unified State Register of Legal Entities and physical persons - entrepreneurs of data on finding of the legal entity in termination condition by liquidation (stay of the physical person - the entrepreneur in condition of the termination of business activity) or about state registration of its termination (state registration of the termination of business activity of the physical person - the entrepreneur);
notarially attested copy of the death certificate of the physical person - the entrepreneur;
the act of detection of false information in the documents filed by the subject of housekeeping for receipt of the license;
the act of factual determination of transfer of the license or its copy to other legal entity or physical person for implementation of economic activity;
act of failure to carry out of the order of elimination of violations of licensed conditions;
the act of impossibility of the licensee to provide accomplishment of the licensed conditions established for certain type of economic activity;
the act of refusal of the licensee in conducting check by body of licensing or specially authorized body concerning licensing.
3.12. The bases for issue of the duplicate of the license are:
loss of the license;
damage of the license.
3.13. In case of loss of the license the licensee shall file in the Ministry petition for issue of the duplicate of the license to which the document certifying introduction of payment for issue of the duplicate of the license is attached.
3.14. In case the form of the license is unsuitable for use owing to its damage, the licensee gives to the Ministry of Economic Development and Trade of Ukraine and concerning the European integration of Ukraine:
statement for issue of the duplicate of the license (appendix 5);
license, unsuitable for use;
the document confirming introduction of payment for issue of the duplicate of the license.
3.15. Effective period of the duplicate of the license cannot exceed effective period which was specified in the lost or damaged license.
3.16. The licensee who submitted the application and the relevant documents for issue of the duplicate of the license instead of lost or damaged, can perform the activities based on the certificate of provision of the statement for issue of the duplicate of the license for implementation of certain type of economic activity which is granted by the Ministry in case of provision of the statement for issue of the duplicate of the license.
3.17. The duplicate of the license is issued within three working days from the date of receipt of the statement for its issue, the damaged license and the document confirming introduction of payment for issue of the duplicate.
3.18. After issue of the duplicate of the license instead of lost or damaged the decision on recognition of the invalid license which was lost or damaged, with entering of corresponding changes into the licensed register no later than the next working day is made.
3.19. For issue of the duplicate of the license instead of the lost or damaged license the payment in the government budget in the amount of five tax-free minima of the income of citizens is collected.
3.20. The department of non-tariff regulation of department of regulation of foreign economic activity creates and keeps the licensed register of the granted export licenses, import of the equipment and disks for laser systems of reading and provides the information in Single licensed to the register to specially authorized body concerning licensing according to the procedure, determined by the Law of Ukraine "About licensing of certain types of economic activity".
