About measures for implementation of the Law of the Republic of Uzbekistan "About protection of children from information doing harm to their health"

In pursuance of the Law of the Republic of Uzbekistan "About protection of children from information doing harm to their health" the Cabinet of Ministers decides:

1. Approve:

Regulations on criteria and procedure of age classification and examination of information products according to appendix No. 1;

Regulations on procedure for accreditation of experts by specially authorized state body in the field of protection of children from information doing harm to their health according to appendix No. 2;

Regulations on determination of requirements to administrative and organizational measures, hardware-software and technical means of ensuring protection of children from information doing harm to their health according to appendix No. 3.

2. Determine that the Agency of information and mass communications is specially authorized state body on conducting examination of information products and implementation of age classification of information products.

3. To the agency of information and mass communications:

together with the Ministry of Finance of the Republic of Uzbekistan to approve procedure for expense recovery, connected with conducting examination of information products in a month;

together with the Ministry of the higher and secondary vocational education, the Ministry of national education of the Republic of Uzbekistan, Republican council on coordination of activities of self-government institutions of citizens, Committee of women of Uzbekistan, the Union of youth of Uzbekistan in two weeks to develop the comprehensive program directed to training, organizers of high-quality work on realization of the tasks designated in the Law of the Republic of Uzbekistan "About protection of children from information doing harm to their health", implementation of the corresponding objects (occupations) in educational process, development at teachers and parents of skills of protection of children from information doing harm to their health;

together with the Ministry of development of information technologies and communications of the Republic of Uzbekistan, National news agency of Uzbekistan and National broadcasting company of Uzbekistan to provide informing general population, first of all to youth, parents, bodies of the public and economic board and other organizations, subjects of business activity, about the purposes, content and application of this resolution.

4. To impose control of execution of this resolution on the director of the Agency of information and mass communications and the Information analysis department concerning culture, art and youth policy of the Cabinet of Ministers of the Republic of Uzbekistan.

Regulations on criteria and procedure of age classification and examination of information products

Chapter 1. General provisions

1. This Provision determines the criteria used in case of age classification of information products, procedure of age classification and examination of information products for ensuring information security of children, their protection against information doing harm to their health according to the Law of the Republic of Uzbekistan "About protection of children from information doing harm to their health" (further - the Law).

2. Action of this provision does not extend to the relations in the field of turnover of the information products which are containing scientific, scientific and technical, statistical information or having considerable historical, art or other cultural value for society. This Provision does not regulate also educational editions recommended for use in educational process, the editions containing regulatory legal acts, information on state of environment or on activities of state bodies, SMS messages from the companies rendering services of cellular communication.

3. In this Provision the following basic concepts are applied:

information products - products of mass media intended for turnover in the territory of the Republic of Uzbekistan, printed materials, audiovisual products on any kinds of carriers, the information distributed with use of the software, placed in networks of telecommunications including in the Internet, computer games, and also information distributed by means of spectacular actions;

the prohibited information products - products of mass media which are not intended for turnover in the territory of the Republic of Uzbekistan, printed materials, audiovisual products on any kinds of carriers, the information distributed with use of the software, placed in networks of telecommunications including in the Internet, computer games, and also information distributed by means of spectacular actions;

turnover of information products - provision and (or) distribution of information products, including its sale (including distribution on subscription), lease, hire, distribution, issue from funds of information and library organizations, public display, public performance (including by means of on-air or cable broadcasting, spectacular actions), placement in networks of telecommunications, and also on the Internet;

age classification of information products - distribution of information products on age categories of children taking into account its scope, genre, content and decorating, features of perception of information which is available in it by children of certain age category, probability of causing by information of harm to health of children containing in it;

sign of age category of information products - graphic and (or) text symbol of age category of information products;

children are persons before achievement of age of eighteen years (age of majority);

health of children - condition of physical, mental and social wellbeing of children;

spectacular action - demonstration of information products in the place available to children where there is considerable number of persons which are not belonging to regular circle of family including by means of holding theatrical and production, cultural and educational and spectacular and entertaining actions;

information security of children - condition of security of children in case of which there is no risk connected with causing by information of harm to their physical, mental, spiritual, moral development;

information doing harm to health of children - information products which distribution among children is forbidden or limited according to the Law;

information of pornographic nature - the materials and objects which are not of art value and not having scientific, medical or educational appointment, containing the description or photo, video or other image of genitals of the person either who is really made by the person or the sexual intercourse imitated by it, including in unnatural form;
