Based on part 1) article 48 of the Law on health protection No. 411/1995 (The official monitor of the Republic of Moldova, 1995, No. 34, the Art. 373), and also according to the Order of the Government No. 768/2011 about approval of the National strategic program in the field of demographic safety of the Republic of Moldova (2011-2025) (The official monitor of the Republic of Moldova, 2011, Art. No. 182-186, 851) and the Order of the Government No. 434/2014 about approval of Strategy of protection of the child for 2014-2020 (The official monitor of the Republic of Moldova, 2014, Art. No. 160-166, 481) DECIDES: the Government

1. Approve Regulations on providing families with goods in case of the birth of children it (is applied).

2. To the Ministry of Health, work and social protection:

1) to provide and perform monitoring of process of application of the Regulations on providing families with goods in case of the birth of children;

To represent 2) to the Government annually till March 31 of the year following after accounting year, the report on implementation of the specified Provision.

3. Providing families with goods in case of the birth of children based on this resolution will be performed since December 1, 2018 for the account and within the means approved in the government budget and also from other sources, according to the current legislation.

4. This resolution becomes effective from the date of publication.

Regulations on providing families with goods in case of the birth of children

I. General provisions

1. The regulations on providing families with goods in case of the birth of children (further - the Provision) establish procedure for providing families with the goods entering set, in case of the birth of children, being pro-active action of the Government of the Republic of Moldova for support to families in case of the birth of children - "New life".

2. Action "New life" takes root in all territory of the Republic of Moldova.

3. In this Provision the basic concepts are determined as follows:

the beneficiary - physical person (mother or, in case of her death, person who is looking after the newborn) which corresponds to the selection criteria established in this Provision and to which set of necessities for the newborn was offered;

the supplier - domestic manufacturer who makes and delivers goods according to the criteria established in this Provision;

the economic operator - the legal entity who within the professional activity buys stores, sorts, packs and distributes sets of goods according to requirements of this provision.

4. The ministry of health care, work and social protection (further - the Ministry) selects according to the Law No. 131/2015 on public procurements by means of the procedure of open tenderings of the economic operator who based on the agreement signed with the Ministry will provide accomplishment of the actions specified in this Provision within the established powers.

II. Selection criteria

5. The beneficiary shall correspond to the following conditions:

1) to be the citizen of the Republic of Moldova or the foreigner determined in part (1) article 2 of the Law No. 274/2011 on integration of foreigners in the Republic of Moldova;

2) to give birth to the living child, including in case of multiple childbirth.

6. The supplier shall correspond to in total following conditions:

1) to be domestic manufacturer whose activities are connected with production of goods, including for children, according to the existing regulations;

To use 2) in production process raw materials, harmless for health of the child and friendly to the environment according to the existing regulations.

III. Set content

7. Content of set of necessities for each newborn is established according to the methodology approved by the ministry.

8. Set of goods shall be national production, except for goods which are not made in the Republic of Moldova.

9. Colors of goods shall be neutral, suitable for girls and boys.

IV. Obligations and rights of the economic operator

11. The chosen economic operator has the following obligations:

1) the organization of purchases of goods according to the legislation;

2) storage, sorting, packaging, distribution and delivery of sets is free by tax delivery note / delivery-acceptance certificate, according to the Order of the Government No. 901/2015 about approval of the Regulations on procedure for transfer of objects of public property, to the medical and sanitary organizations rendering perinatal services (in further - medical and sanitary organizations), according to the list constituted by the Ministry;

3) sealing of set of goods;

4) reproduction and distribution of the estimative questionnaire by medical and sanitary organization;

5) monthly representation to the Ministry of tax superimposed / delivery-acceptance certificates sets medical and sanitary organizations, and also information on total quantity of sets of the goods and estimative questionnaires multiplied, distributed and which remained available in the medical and sanitary organizations developed on the basis of the monthly reports submitted by medical and sanitary organizations according to form from appendix No. 2 to this Provision.

12. The chosen economic operator has the following rights:

To request 1) from the Ministry lists of medical and sanitary organizations;

2) monthly to obtain from medical and sanitary organizations information on total quantity of the sets and estimative questionnaires distributed and which remained available in medical and sanitary organizations according to form from appendix No. 2 to this Provision;

3) requests the additional information necessary for accomplishment of contractual commitments.

V. Procedure of the offer and accounting

13. Set of goods is provided free of charge to the beneficiary after the birth by filling of form according to appendix No. 1 to this Provision to which the copy of the identity certificate of the beneficiary and the medical certificate about the birth is attached.

14. If set of goods was not provided to the statement from medical and sanitary organization because of its absence, the economic operator gets set of things to the beneficiary home and provides also transfer of form to medical and sanitary organization according to appendix No. 1 to this Provision.

15. To the statement from medical and sanitary organization the beneficiary fills in the estimative questionnaire.

16. The medical and sanitary organization represents monthly to the address of the Ministry in electronic form lists of beneficiaries and the completed estimative questionnaires.

17. The medical and sanitary organization monthly provides to the economic operator in electronic form information on total quantity of the sets received, distributed and remained available according to appendix form No. 2 to this Provision.

18. The ministry provides processing and data analysis, the questionnaires received by filling and submission of semi-annual and annual statements.
