About licensing of separate types of activity on rail transport

1. Approve enclosed:

Regulations on licensing of transportations of passengers and baggage by rail;

Regulations on licensing of transportations by railway transport of loads;

Regulations on licensing of transportations by railway transport of cargo baggage;

Regulations on cargo transportation licensing (cargo transfers without the conclusion of the transportation agreement) on railway tracks public, except for cleaning of the arrived loads from railway exhibition tracks, their return on railway exhibition tracks;

Regulations on licensing of handling activities in relation to dangerous goods on rail transport.

2. To the Ministry of Transport of the Russian Federation together with the Ministry of Economic Development and Trade of the Russian Federation to submit in accordance with the established procedure within 2-month term the draft decision of the Government of the Russian Federation about approval of essential terms of the contract of civil responsibility insurance of the license applicant or licensee in the presence of which the simplified procedure for licensing of the following types of activity can be applied:

transportations by railway transport of loads;

transportations by railway transport of cargo baggage;

cargo transportation (cargo transfer without the conclusion of the transportation agreement) on railway tracks public, except for cleaning of the arrived loads from railway exhibition tracks, their return on railway exhibition tracks;

handling activities in relation to dangerous goods on rail transport.

3. Recognize invalid:

the order of the Government of the Russian Federation of June 5, 2002 N383 "About Licensing of Transportation and Other Activities on Rail Transport" (The Russian Federation Code, 2002, N 23, the Art. 2183);

Item of 77 changes which are made to the resolutions of Council of Ministers of RSFSR, the Government of RSFSR and the Government of the Russian Federation concerning state registration of the legal entities approved by the order of the Government of the Russian Federation of October 3, 2002 N731 (The Russian Federation Code, 2002, N 41, by the Art. 3983).

Regulations on licensing of transportations of passengers and baggage by rail

1. This Provision determines procedure for licensing of transportations of the passengers and baggage by rail performed by legal entities and individual entrepreneurs (further - transportations of passengers and baggage).

2. Licensing of transportation of passengers and baggage is performed by Federal Service for the Oversight of Transport (daleelitsenziruyushchy body).

3. The license for implementation of transportations of passengers and baggage is provided for 5 years. The validity of the license can be extended according to the procedure, provided for renewal of the license.

4. The licensed requirements imposed to the licensee when implementing transportations of passengers and baggage are:

a) observance of the Federal Laws "About Rail Transport in the Russian Federation" and "Charter of Rail Transport of the Russian Federation" regarding requirements to carrier, rules and conditions of implementation of transportations of passengers and baggage;

b) observance of rules of rendering services in transportations on rail transport of passengers, and also loads, baggage and cargo baggage for the personal, family, house and other needs which are not connected with implementation of business activity, approved according to article 3 of the Federal law "Charter of Rail Transport of the Russian Federation";

c) observance of rules of transportations of the passengers, baggage and cargo baggage on rail transport approved according to article 3 of the Federal law "Charter of Rail Transport of the Russian Federation";

d) providing on rail transport of ecological safety, fire safety, and also sanitary and epidemiologic wellbeing of the population according to article 22 of the Federal law "About Rail Transport in the Russian Federation";

e) observance of requirements to qualification of the workers approved according to article 57 of the Labor Code of the Russian Federation;

e) respect for features of the mode of working hours and time of rest, working conditions of separate employee categories of rail transport which work is directly connected with train service, established according to article 25 of the Federal law "About Rail Transport in the Russian Federation".

5. Licensed conditions of implementation of transportations of passengers and baggage are:

a) use by the licensee intended for transportations of passengers and baggage of the railway rolling stock conforming to requirements, the stipulated in Clause 17 Federal Laws "About Rail Transport in the Russian Federation";

b) availability in staff of the license applicant (licensee) of specialized division on liquidations of emergency situations or availability of the relevant contract with the third specialized parties;

c) availability in staff of the license applicant (licensee) of person responsible for the organization of transportations of passengers and the baggage having the higher or secondary vocational education and length of service in the field of implementation of the licensed type of activity at least 3 years over the last 10 years of labor activity;
