About approval of Licensed conditions of implementation of economic activity on wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants)
According to article 8 of the Law of Ukraine "About licensing of certain types of economic activity" and in pursuance of the resolution of the Cabinet of Ministers of Ukraine of November 17, 2004 N1560 "About Modification of the List of Bodies of Licensing" is ORDERED:
1. Approve Licensed conditions of implementation of economic activity on wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants) (daleelitsenzionny conditions) which are applied.
2. To department of registration and licensing Gospredprinimatelstva of Ukraine (Barbelyuk O. B.), to Department of the markets of products of crop production and development of seed farming of Minagropolitiki of Ukraine (Lazarus T. I.) in accordance with the established procedure to provide provision of Licensed conditions on state registration in the Ministry of Justice of Ukraine.
3. To provide to department of the markets of products of crop production and development of seed farming of Minagropolitiki the publication of Licensed conditions in mass media.
4. To impose control over the implementation of the order on the First Deputy Chairman Gospredprinimatelstva of Ukraine Vashchenko K. O. and deputy minister of agrarian policy of Ukraine Melnik S. I.

Approved by the Order of the State committee of Ukraine concerning regulatory policy and entrepreneurship, the Ministry of agrarian policy of Ukraine on February 1, 2006 No. 9/30
1.1. Licensed conditions of implementation of economic activity on wholesale, retail trade (daleelitsenzionny conditions) are developed by pesticides and agrochemicals (only regulators of growth of plants) according to the Laws of Ukraine "About licensing of certain types of economic activity", "About pesticides and agrochemicals", "About protection of plants", "About labor protection", "About protection of the surrounding environment", "About ensuring sanitary and epidemic wellbeing of the population", other regulatory legal acts.
1.2. Action of Licensed conditions extends to all subjects of managing - legal entities irrespective of their forms of business and patterns of ownership which perform economic activity on wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants), except public authorities and local government bodies, and also physical persons - the subjects of business activity performing activities in the specified sphere.
1.3. Licensed conditions determine organizational, qualification and other special requirements of implementation of economic activity by wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants).
1.4. Economic activity on wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants) based on the license granted by body of licensing which the Ministry of agrarian policy of Ukraine is is performed in all territory of Ukraine, and economic activity of retail trade by pesticides and agrochemicals (only regulators of growth of plants) based on the license granted by body of licensing which the Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations is is performed in the territory of the corresponding administrative and territorial unit.
1.5. Execution of statements for licensing, about issue of the copy of the license, about renewal of the license, about issue of the duplicate of the license is performed by subjects of managing in the established forms (appendices 1-4).
The statement for licensing and documents which are attached to it are accepted according to the inventory (appendix 5) which copy is issued to the applicant with mark about acceptance date of documents body of licensing and the signature of the responsible person.
1.6. The license is the document of the state sample which certifies the right of the subject of managing to implementation of economic activity on wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants);
1.7. The subject of managing when implementing activities for wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants) shall follow requirements of such regulatory legal acts:
Law of Ukraine of 01.06.2000 N1775-III "About Licensing of Certain Types of Economic Activity";
Law of Ukraine of 02.03.95 N86/95-BP "About Pesticides and Agrochemicals";
Law of Ukraine of 14.10.98 N180-XIV "About Protection of Plants";
Law of Ukraine of 24.02.94 N4004-XII "About Ensuring Sanitary and Epidemic Wellbeing of the Population";
The law of Ukraine "About protection of the surrounding environment" of 25.06.91 N1264-XII;
resolutions of the Cabinet of Ministers of Ukraine:
of 08.02.95 N108 "About Procedure for Occupation Trading Activity and Rules of Trade Servicing of the Population";
of 14.11.2000 N1698 "About Approval of the List of Bodies of Licensing";
the order of the Ministry of Economy and European Integration of 11.03.2004 N98 "About Approval of Rules of Retail Trade by Nonfoods", registered in Ministry of Justice of 29.03.2004 N 379/8978.
2.1. Implementation of economic activity on wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants) before their state registration is forbidden.
2.2. It is forbidden to subject of managing which performs economic activity on wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants), to accept for sale and storage pesticides and agrochemicals from subjects of managing which have no license for their production or trade.
2.3. The subject of managing shall record availability and use of pesticides and agrochemicals (only regulators of growth of plants) in account books (magazines) and to submit the statistical reporting under the approved forms of availability and realization of pesticides and agrochemicals (only regulators of growth of plants) according to the Procedure for the state accounting of availability and use of pesticides and agrochemicals (only regulators of growth of plants) approved by the resolution of the Cabinet of Ministers of Ukraine of 02.11.95 of N881 "About Approval of the Procedure for the State Accounting of Availability and Use of Pesticides and Agrochemicals".
3.1. Wholesale trade by pesticides and agrochemicals (only regulators of growth of plants) is performed only through warehouses.
3.2. The subject of managing shall have:
the storage facilities for storage of pesticides and agrochemicals (only regulators of growth of plants) which are meeting the sanitary and hygienic requirements and safety regulations and having the sanitary passports certified by sanitary and epidemiologic service, bodies of the state fire supervision, bodies for questions of protection of the surrounding environment, the station of protection of plants;
guaranty letter;
instructions for labor protection;
job descriptions;
the positive conclusions of sanitary and epidemiologic service, bodies of the state fire supervision, specially authorized bodies concerning protection of the surrounding environment concerning compliance of trade rooms to sanitary and hygienic requirements, safety regulations, ecological safety.
3.3. The subject of managing according to article 10 of the Law of Ukraine "About pesticides and agrochemicals" shall issue to the consumer on each commodity unit of pesticides and agrochemicals (only regulators of growth of plants) the recommendation concerning its application with indication of cultures and objects for which processing pesticides and agrochemicals (only regulators of growth of plants), methods, regulations and frequency rate of use, waiting terms (are intended for pesticides), prohibitions and restrictions for application, methods and means of neutralization of pesticides and agrochemicals (only regulators of growth of plants), and also security measures during the work and measures of first aid in case of poisoning.
3.4. The subject of managing according to article 11 of the Law of Ukraine "About pesticides and agrochemicals" shall perform sale to the population of pesticides and agrochemicals (only regulators of growth of plants) in small packed up type and with obligatory availability of the instruction of their rather safe application.
3.5. The subject of managing when implementing retail trade by pesticides and agrochemicals (only regulators of growth of plants) shall follow requirements of rules of sale of nonfoods.
4.1. Workers of the subject of managing whose activities are connected with wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants) shall be trained on adopted agenda, retraining once in three years, medical examination, to have the admission on the right of work with the specified medicines, the certificate and the medical book of the established samples (appendices 1, 2, 3 to the resolution of the Cabinet of Ministers of Ukraine from
18.09.95 of N746 "About Approval of the Procedure for Receipt of the Admission (Certificate) on the Right of the Work Connected with Transportation, Storage, Application and Trade in Pesticides and Agrochemicals") and to show them upon the demand of representatives of the state supervision and control.
4.2. Workers of the subject of managing who organize performance of works, connected with wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants) shall have experience in this work, vocational education or have training on the corresponding rates and seminars under the stations of protection of plants, special educational institutions, and also to annually increase the knowledge on rates and seminars, to have medical examination, to have the admission (certificate) and the medical book of the established samples (appendices 1, 2, 3 to the resolution of the Cabinet of Ministers of Ukraine of 18.09.95 N746.
5.1. The subject of managing for implementation of economic activity on wholesale, retail trade by pesticides and agrochemicals (only regulators of growth of plants) shall provide:
the organization and carrying out certification of workplaces according to the Procedure for carrying out certification of workplaces under the terms of work approved by the resolution of the Cabinet of Ministers of Ukraine of 01.08.92 of N 442, in the terms provided by the collective agreement, but at least 1 time in 5 years;
the organization and carrying out preliminary (in case of employment) and periodic (once a year) medical examinations of workers according to the Regulations on medical examination of workers of certain categories approved by the order of the Ministry of Health of Ukraine of 31.03.94 of N45 and registered by the Ministry of Justice of Ukraine 21.06.94 for N 136/345.
5.2. The subject of managing according to article 8 of the Law of Ukraine "About labor protection", Regulations on procedure for providing workers with special clothes, the special footwear and other individual protection equipment approved by the order of the State committee of Ukraine on supervision of labor protection of 29.10.96 of N170 and registered in the Ministry of Justice of Ukraine of 18.11.96 for N667/1692, shall provide free of charge workers with special clothes, footwear and other individual protection equipment.
6.1. The subject of managing according to the Laws of Ukraine "About ensuring sanitary and epidemic wellbeing of the population" and "About protection of the surrounding environment" in use production, household and other rooms, constructions, the equipment, equipment, vehicles, using technologies, shall provide:
safe and corresponding working conditions and rest which meet the requirements of sanitary standards;
the actions directed to prevention of diseases, poisonings, injuries, environmental pollution;
ecological safety of people, rational use of natural resources, observance of standard rates of harmful effects on the surrounding environment.
6.2. The subject of managing shall provide neutralization and utilization of toxic waste (firm, liquid).
6.3. Pesticides and agrochemicals (only regulators of growth of plants), and also container of foreign production which are imported on the territory of Ukraine shall be followed by documents on technology of their neutralization and utilization according to article 10 of the Law of Ukraine "About pesticides and agrochemicals".
6.4. Utilization, destruction and neutralization of the unsuitable or prohibited to use pesticides and agrochemicals (only regulators of growth of plants), and also container from them are performed by the companies of the subject of managing at which they are made, and also other companies which have permission of sanitary and epidemiologic service of specially authorized central executive body concerning health care and specially authorized central executive body concerning protection of the surrounding environment, on contractual conditions according to the Procedure for withdrawal, utilization, destruction and neutralization unsuitable or prohibited to use of pesticides and agrochemicals and container from them approved by the resolution of the Cabinet of Ministers of Ukraine of 27.03.96 of N354.
