About approval of the state program of the Russian Federation "The available circle"
The government of the Russian Federation decides:
1. Approve the enclosed state program of the Russian Federation "The available circle".
2. To the Ministry of Labour and Social Protection of the Russian Federation:
place the state program of the Russian Federation approved by this resolution on the official site, and also on the portal of state programs of the Russian Federation on the Internet in 2 weeks time from the date of official publication of this resolution;
take measures for implementation of actions of the specified state program of the Russian Federation.
3. Recognize invalid:

In the Russian Federation is about 12,1 of one million disabled people now that constitutes about country population percent 8,2, and more than 40 million handicapped citizens - population percent 27,4.
In 2008 the Russian Federation signed and in 2012 ratified the Convention on the rights of disabled people of December 13, 2006 (further - the Convention) that was indicator of readiness of the country for forming of the conditions directed to observance of international standards of economic, social, legal and other rights of disabled people.
Signing of the Convention actually approved the principles on which the policy of the state for disabled people shall be formed.
According to the Convention the State Parties shall take proper measures on providing to disabled people on an equal basis with other citizens of access to physical environment, transport, information and communication, and also to other objects and services opened or provided to the population. These measures shall extend:
to buildings, roads, transport and other objects, including schools, kindergartens, apartment houses, medical institutions and workplaces;
on information, communication and other services, including electronic and emergency services.
One of the most important directions of the Convention is achievement of the greatest possible independence of disabled people what requires forming of complex rehabilitation and abilitatsionny services. Complex rehabilitation and abilitation of disabled people, including handicapped children, shall resolve issues of medical, social nature, education and employment, and also to consider that disabled people represent heterogeneous group of persons and requirements them are different.
Complex rehabilitation and abilitation shall begin as soon as possible and be based on needs of the disabled person (handicapped child), promote its involvement in local community and to be available to it as it is possible closer to places of its direct accommodation.
For program implementation of complex rehabilitation and abilitation of disabled people, including handicapped children, it is necessary as training of the specialists and personnel providing rehabilitation and abilitatsionny services, and obtaining by disabled people and members of their families of information on use of the assistivny devices and technologies relating to complex rehabilitation and abilitation.
Taking into account requirements of the Convention, and also taking into account provisions of the International classification of functioning, restrictions of life activity and health the solution of questions of forming of the available circle and system of complex rehabilitation and abilitation of disabled people, including handicapped children, is determined as the priority direction of state policy.
One of the purposes of state policy in the field of social protection of disabled people is creation of conditions of development of the available circle for disabled people and other handicapped national groups, and also systems of complex rehabilitation and abilitation of disabled people, including handicapped children, by development and deployment in practice taking into account the Russian and foreign experience of normative, technical and organizational solutions.
The legislation of the Russian Federation, including the Federal Laws "About Education in the Russian Federation", "About Social Protection of Disabled People in the Russian Federation", "About Bases of Social Servicing of Citizens in the Russian Federation", "About Physical Culture and Sport in the Russian Federation", the Town-planning code of the Russian Federation and the Russian Federation Code of Administrative Offences, determine requirements to public authorities and the organizations irrespective of their form of business by creation of conditions for easy access of disabled people to objects of engineering, transport and social infrastructure, information, and also responsibility of public authorities and organizations for evasion from execution of these requirements.
The Federal Law "About Modification of Separate Legal Acts of the Russian Federation concerning Social Protection of Disabled People in connection with Ratification of the Convention on the Rights of Disabled People" enters such concept as abilitation of disabled people, and also the foundation for effective interdepartmental interaction for the purpose of increase in availability of services in rehabilitation and abilitation of disabled people, including handicapped children is laid. Establishing effective interdepartmental interaction of the medical, social organizations and organizations performing educational activities is the compulsory provision of realization of the principles of the early help and escort of disabled people, including handicapped children, in regional system of rehabilitation.
According to the Convention provisions, the Main activities of the Government of the Russian Federation for the period till 2012 approved by the order of the Government of the Russian Federation of November 17, 2008 No. 1663-r, the Main activities of the Government of the Russian Federation for the period till 2018 approved by the Government of the Russian Federation on May 14, 2015, the Concept of long-term social and economic development of the Russian Federation for the period till 2020 approved by the order of the Government of the Russian Federation of November 17, 2008 No. 1662-r, the state program of the Russian Federation "The available circle" (further - the Program) provides realization of complex of the actions allowing to provide easy access to priority objects and services in priority spheres of life activity of disabled people and other handicapped national groups and also enhancement of procedure for granting of services in the field of rehabilitation, including the solution of questions of education and employment of disabled people, and the state system of medico-social examination for the purpose of realization of their rights and fundamental freedoms that will promote full participation of disabled people in country life.
For the purpose of increase in objectivity of the state system of medico-social examination the Program provides complex of the actions directed to increase in availability and quality of survey, strengthening of material and technical resources, implementation of modern information technologies and advanced training of specialists of organizations of medico-social examination.
Requirements to state policy in the field of social protection of disabled people in the Russian Federation are established:
subitems "an" and "g" of Item 1 of the Presidential decree of the Russian Federation of May 7, 2012 No. 596 "About long-term state economic policy" - determine need of creation and upgrade of 25 million high-productive workplaces by 2020, performance improvements of work by 2018 in time 1,5 concerning the level of 2011;
subitems "an" and "e" of Item 1 of the Presidential decree of the Russian Federation of May 7, 2012 No. 597 "About actions for realization of the state social policy" - determine need of increase by 2018 of the average salary of doctors, teachers of educational institutions of higher education and research associates to 200 percent of the average salary in the respective region, increases by 2020 in the number of highly-skilled employees which shall constitute at least a third of number of skilled workers, increases by 2018 in the average salary of social workers, including social employees of the medical organizations, junior medical personnel (the personnel providing conditions for provision of medical services), average medical (pharmaceutical) personnel (personnel, the providing condition for provision of medical services) - to 100 percent of the average salary in the respective region, employees of the medical organizations,
having the higher medical (pharmaceutical) or other higher education, providing the medical services (providing provision of medical services), - to 200 percent of the average salary in the respective region;
the subitem "an" of Item 1 of the Presidential decree of the Russian Federation of May 7, 2012 No. 601 "About the main directions of enhancement of system of public administration" - determines need of increase in level of satisfaction of citizens of the Russian Federation by quality of provision of the state and municipal services by 2018 to 90 percent.
For the purpose of accomplishment of provisions of presidential decrees of the Russian Federation within program implementation since 2012:
the action directed to pay increase of work of health workers of the federal state institutions of medico-social examination subordinated to the Ministry of Labour and Social Protection of the Russian Federation is implemented and also forming of the number of staff of federal state institutions of medico-social examination taking into account need of high-quality rendering the state service in conducting medico-social examination is performed (according to the Program of step-by-step enhancement of the wages system in the public (municipal) institutions for 2012 - 2018 approved by the order of the Government of the Russian Federation of November 26, 2012 No. 2190-r);
the actions directed to increase in transparency of the passed decisions on disability establishment are implemented, the information technologies allowing to reduce the disabled person's route during the passing of medico-social examination and receipt of rehabilitation and abilitatsionny services take root, specialists of organizations of medico-social examination, including concerning ethics and deontology are trained when conducting medico-social examination (since 2016 annual carrying out social researches of assessment of level of satisfaction of citizens with quality of provision of the state services in medico-social examination and providing disabled people with technical means of rehabilitation is performed);
subsidies are provided to hospitals of difficult prosthetics on cost recovery on payment of days of stay of disabled people in hospitals.
For the purposes of the Program social researches of satisfaction with quality of provision of services on medico-social examination and providing disabled people with technical means of rehabilitation include including information on the following main questions:
possibility of receipt of complete, up-to-date and available information about procedure for provision of the state service;
adherence to deadlines of provision of the state service;
provision of possibility of receipt of the state service in electronic form;
accuracy of the information about the course of provision of the state service;
visualization of information on ministerial procedures;
availability of receipt of information on procedure for provision of the state service;
other questions reflecting satisfaction with quality of provision of service.
In pursuance of the Presidential decree of the Russian Federation of May 7, 2012 No. 601 "About the main directions of enhancement of system of public administration" Administrative regulations of provision by Social Insurance Fund of the Russian Federation of the state service in providing disabled people with technical means of rehabilitation and (or) services and separate categories of citizens from among veterans prostheses (except dentures), prosthetic and orthopedic products, and also on payment of compensation for the technical means of rehabilitation which are independently acquired by disabled people (veterans prostheses (except dentures), prosthetic and orthopedic products) and (or) paid service and annual monetary compensation of expenses of disabled people on content and veterinary servicing of seeing eye dogs, the approved order of the Ministry of Labour and Social Protection of the Russian Federation of September 23, 2014 with No. 657n, expectation term in queue by provision and receipt of the specified state services in bureau, the main bureau, Federal bureau of medico-social examination, territorial authorities of Social Insurance Fund of the Russian Federation is reduced to 15 minutes. Besides, the possibility of receipt of these state services in electronic form by the disabled person is realized.
By the Federal Law "About Social Protection of Disabled People in the Russian Federation" it is determined that public authorities of subjects of the Russian Federation on areas of jurisdiction of subjects of the Russian Federation and objects of joint maintaining the Russian Federation and subjects of the Russian Federation create conditions to disabled people (including the disabled people using wheelchairs and seeing eye dogs) for easy access to objects of social infrastructure (residential, public and factory buildings, structures and constructions, sports constructions, vacation spots, cultural and spectacular and other organizations), and also for free use of railway, air, water, intercity road transport and all types of urban and suburban passenger transportation, means of communication and information (including the means providing duplication with sound signals of light signals of traffic lights and devices the pedestrians regulating movement through transport communications).
By the Federal Law "About the General Principles of the Organization of Legislative (Representative) and Executive Bodies of the Government of Subjects of the Russian Federation" it is determined that also measures of social support and social servicing of citizens of advanced age and disabled people belong to powers of joint maintaining the Russian Federation and subjects of the Russian Federation.
According to the Constitution of the Russian Federation the state guarantees equal rights of the person irrespective of the residence, and also against other circumstances.
Provisions of the Convention extend to all parts of federal states without any withdrawals and exceptions.
Providing the available circle for disabled people and other handicapped national groups is one of the major social and economic tasks affecting the rights and requirements of millions of citizens of the Russian Federation living as in the city, and rural zone.
For the purpose of the solution of tasks of the Sustainability strategy of the rural territories of the Russian Federation for the period till 2030 approved by the order of the Government of the Russian Federation of February 2, 2015 No. 151-r Program provisions regarding realization of complex of the actions allowing to provide easy access of disabled people and other handicapped national groups to priority objects and services in priority spheres of life activity of disabled people and other handicapped national groups, extend to the rural territories. At the same time priority objects are determined by subjects of the Russian Federation with direct participation of representatives of regional public organizations of disabled people.
The purposes and tasks of the Program answer priorities and the purpose of state policy in the field of social and economic development of the priority territories of the Far Eastern Federal District, the Baikal region, the North Caucasian Federal District, the Kaliningrad region, the Arctic zone of the Russian Federation (Murmansk region, the Nenets Autonomous Okrug, the Yamalo-Nenets Autonomous Area), the Republic of Crimea and Sevastopol (further - the priority territories).
The purposes of implementation of actions of the Program in the priority territories are:
increase in level of availability of priority objects and services in priority spheres of life activity of disabled people and other handicapped national groups;
increase in level of security of disabled people with rehabilitation and abilitatsionny services, and also level of professional development and employment of disabled people;
increase in availability, objectivity and transparency of activities of organizations of medico-social examination.
Achievement of effective objectives is provided by means of the solution of the tasks directed to overcoming infrastructure and institutional restrictions and creation of equal opportunities for the population of the priority territories.
The main actions of the Program directed to effective solution of tasks in the priority territories are:
provision of subsidy for implementation of actions of subjects of the Russian Federation in the field of ensuring availability of priority objects and services in priority spheres of life activity of disabled people and other handicapped national groups;
provision of subsidy for the purpose of joint financing of payment commitments of the subjects of the Russian Federation connected with implementation of actions, included in state programs of subjects of the Russian Federation on forming of system of complex rehabilitation and abilitation of disabled people, including handicapped children;
provision of the state guarantees to disabled people.
The Program implementation of actions in the priority territories will allow to provide:
carrying out complex of actions for additional equipment, adaptation of priority objects and services of social, transport and engineering infrastructure in priority spheres of life activity of disabled people and other handicapped national groups for easy access;
creation of conditions for receipt of education by handicapped children in system of the regular educational organizations;
strengthening of material and technical resources of the organizations of sports orientation for adaptive physical culture and sport in subjects of the Russian Federation;
realization of the right of disabled people to rehabilitation and ensuring rehabilitation with technical means;
provision of social guarantees to disabled people (ensuring rehabilitation with technical means);
creation of network of the basic professional educational organizations in subjects of the Russian Federation.
According to the decision of the Government of the Russian Federation executives in charge of state programs of the Russian Federation need to include in state programs of action for creation of the barrier-free circle for disabled people and other handicapped national groups.
At the same time the Program actions directed to forming of conditions of availability of priority objects in priority spheres of life activity of disabled people exert impact on goal achievement and tasks of other state programs taking into account the principle of industry accessory.
According to the Federal Law "About Social Protection of Disabled People in the Russian Federation" the layout and building of the cities, other settlements, forming of living and recreational areas, development of project decisions on new construction and reconstruction of buildings, constructions and their complexes, and also development and production of vehicles public, means of communication and information without the device of the specified objects for access to them for disabled people and use by their disabled people are not allowed. This requirement fully belongs to objects in the field of sport in case of their capital construction and reconstruction. Availability of such objects shall be provided both for the disabled audience, and for disabled athletes, at the same time it is necessary to consider experience of holding the XXII Olympic winter Games and the XI Paralympic Winter Games in Sochi, the FIFA World Cup in 2018.
According to the Federal Law "About Modification of Separate Legal Acts of the Russian Federation concerning Social Protection of Disabled People in connection with Ratification of the Convention on the Rights of Disabled People" for the purpose of providing conditions of availability to disabled people of objects of social, engineering and transport infrastructure and conditions for free use of services executive bodies of subjects of the Russian Federation, local government bodies claimed and realize in the established field of activity actions plans ("road maps") on increase in measure values of availability to disabled people of objects and services. In case of implementation of the specified actions plans ("road maps") the results, regulating documents and methodological provisions developed during the course of performance Program actions were considered and used.
Thus, the main requirement to state policy of subjects of the Russian Federation is providing in the territory of the subjects of the Russian Federation of implementation of actions directed to elimination of the existing obstacles and barriers, ensuring availability to disabled people of objects and services, complex rehabilitation and abilitation for disabled people, including handicapped children.
For ensuring uniform approach in case of realization of complex of the actions directed to elimination of the existing obstacles and barriers, the Ministry of Labour and Social Protection of the Russian Federation in 2012 approves the approximate program of the subject of the Russian Federation for ensuring availability of priority objects and services in priority spheres of life activity of disabled people and other handicapped national groups (further - the approximate program).
For the purposes of the Program priority objects are understood as the objects which are most visited by disabled people selected taking into account opinion of disabled people in spheres of life activity of disabled people and other handicapped national groups (health care, culture, transport and pedestrian infrastructure, information and communication, education, social protection, employment, sport and physical culture).
The purposes and tasks of programs of subjects of the Russian Federation (further - regional programs) are similar to the purposes and tasks of the Program that gives the chance to perform overall assessment of process of forming of the barrier-free circle both across the Russian Federation in general, and concerning subjects of the Russian Federation, and also to reveal uneven forming of conditions of availability of priority objects and services in priority spheres of life activity of disabled people and other handicapped national groups in the territories of subjects of the Russian Federation.
Application by subjects of the Russian Federation in 2013 and 2014 of the approximate program as basis in case of development of regional programs and established practices of their realization in subjects of the Russian Federation predetermined need of modification of the approximate program. In 2015 the changes establishing number of mandatory provisions which are considered by subjects of the Russian Federation in case of implementation of actions of the regional programs concerning the purposes and tasks, target measures and indicators, their values (in breakdown on priority spheres of life activity of disabled people and other handicapped national groups), the list of actions, reasons for amount of the financial resources necessary for implementation of the regional program, risk analysis of implementation of regional programs and the description of measures for their management, including the description of interdepartmental interaction, efficiency evaluation of implementation of actions are made to the approximate program. At the same time in the approximate program more disaggregated list of actions is established:
on enhancement of regulatory framework and organizational mechanisms of forming of the available circle for disabled people and other handicapped national groups, and also on ensuring interaction and coordination of activities of executive bodies of the government of subjects of the Russian Federation and representatives of public organizations of disabled people;
on forming of conditions of availability to disabled people of objects and services (in breakdown on priority spheres of life activity of disabled people and other handicapped national groups);
on information methodically ensuring activities of the specialists involved in forming of the available circle for disabled people and other handicapped national groups (preparation and holding seminars, conferences, professional development course, preparation and the publication help, methodologies, recommendations);
on holding the information and educational actions directed to overcoming social dissociation in society and forming of the positive relation to problem of providing the available circle for disabled people and other handicapped national groups.
Also in 2011 - 2015 subjects of the Russian Federation (municipalities) on the terms of joint financing participated in implementation of actions, directed:
on creation in the general education organizations of conditions for inclusive education of handicapped children, including creation of the universal barrier-free circle for easy access and equipment of the general education organizations by the special equipment, including the educational, rehabilitation, computer equipment, and motor transport;
on support of organizations of sports orientation on adaptive physical culture and sport in subjects of the Russian Federation.
On realization of the specified actions from the federal budget subsidies were provided to budgets of subjects of the Russian Federation in 2011 - 2015.
Within the Program to subjects of the Russian Federation since 2016 the consolidated subsidy from the federal budget is provided to budgets of subjects of the Russian Federation on joint financing of expenses on implementation of actions in the field of ensuring availability of priority objects and services in priority spheres of life activity of disabled people and other handicapped national groups, including expenses:
on the actions included in the programs of subjects of the Russian Federation developed on the basis of the approximate program of the subject of the Russian Federation for ensuring availability of priority objects and services in priority spheres of life activity of disabled people and other handicapped national groups;
on actions for creation in the preschool educational, general education organizations, the organizations of additional education of children (including in the organizations performing educational activities for adapted main general education programs) conditions for receipt of quality education by handicapped children, including creation of the universal barrier-free circle for easy access and equipment of the specified organizations by the special equipment, including the educational, rehabilitation, computer equipment, and motor transport;
on support of organizations of sports orientation on adaptive physical culture and sport in subjects of the Russian Federation.
The consolidated subsidy from the federal budget will be provided to regions since 2019 only on implementation of actions on creation in the preschool educational, general education organizations, the organizations of additional education of children of conditions for receipt by handicapped children of quality education, and also actions for support of organizations of sports orientation for adaptive physical culture and sport.
Subjects of the Russian Federation will realize within the powers actions for creation of the conditions of availability to disabled people established by the legislation of the Russian Federation at the expense of own means, and also within implementation of actions plans ("road maps") accepted in compliance by the Federal Law of December 1, 2014 No. 419-FZ "About modification of separate legal acts of the Russian Federation concerning social protection of disabled people in connection with ratification of the Convention on the rights of disabled people".
For the purpose of execution of orders of the President of the Russian Federation following the results of East economic forum which took place on September 4, 2015 for ensuring priority nature of financing of tasks of social and economic development of the Far East when scoping of the consolidated subsidy from the federal budget the coefficient of the advancing development, equal 1,3 is provided.
Besides, according to offers of the Ministry of the Russian Federation for the North Caucasus of the Russian Federation of February 1, 2018 for ensuring priority nature of financing of tasks of social and economic development of subjects of the North Caucasian Federal District when scoping of the consolidated subsidy from the federal budget the coefficient of the advancing development, equal 1,3 is provided.
During program implementation drafts of regional programs pass the examination and selection at meetings of Coordination council on control of the Program.
Actions of the regional program are estimated based on the target measures and indicators included in it which completely correspond to similar measures and indicators of the Program. For carrying out monitoring at the regional level the regional program can include the additional measures and indicators offered by the subject of the Russian Federation according to which efficiency of expenditure of budget funds of the subject of the Russian Federation is estimated.
By results of carried out according to established by the Ministry of Labour and Social Protection of the Russian Federation procedure and conditions of competitive selection in 2017 and 2018 in Sverdlovsk region and Perm Krai the pilot project on working off of approaches to forming of system of complex rehabilitation and abilitation of disabled people, including handicapped children during which realization number of regulations is accepted is implemented.
For the purpose of ensuring uniform approach in case of realization of complex of the actions directed to enhancement of system of complex rehabilitation and abilitation of disabled people, including handicapped children, the Ministry of Labour and Social Protection of the Russian Federation approves technique of development and implementation of the regional program for forming of system of complex rehabilitation and abilitation of disabled people, including handicapped children (further - the standard program of the subject of the Russian Federation).
The standard program of the subject of the Russian Federation establishes number of mandatory provisions which shall be considered in case of implementation of actions of regional programs (the purposes and tasks, target indicators and their values, the list of actions, reasons for amount of the financial resources necessary for implementation of regional programs, risk analysis of implementation of regional programs and the description of measures for their management, including the description of interdepartmental interaction, and efficiency evaluation of implementation of actions).
The standard program of the subject of the Russian Federation includes actions:
on the organization of interaction of the organizations created and performing the activities irrespective of patterns of ownership, departmental accessory, including socially oriented non-profit organizations providing complex rehabilitation of disabled people, including handicapped children;
on inclusion of the organizations performing employment, social resettlement and abilitation of disabled people, including handicapped children in system of complex rehabilitation and abilitation of disabled people, including handicapped children;
on inclusion of the early help and maintenance in system of complex rehabilitation and abilitation of disabled people, including handicapped children;
on training of disabled people and members of their families in matching and use of technical means of rehabilitation, rehabilitation skills, and also in training of members of families in skills of care of disabled people and handicapped children, communication with them as soon as possible in case of disability approach;
on the organization of work of the centers of hire of technical means of rehabilitation for disabled people, including for handicapped children;
on forming and maintaining the register of rehabilitation, abilitatsionny actions and services to disabled people, including handicapped children, in the subject of the Russian Federation;
on distribution of information materials among the population for perhaps earlier identification of signs of violation of health, including mental, for the purpose of rendering the early help and prevention of disability.
On implementation of actions, included in the regional programs developed on the basis of the standard program of the subject of the Russian Federation in 2019 and 2020 from the federal budget to budgets of subjects of the Russian Federation subsidies are provided.
During program implementation drafts of the regional programs developed on the basis of the standard program of the subject of the Russian Federation pass the examination and selection at meetings of Coordination council on control of program implementation, at the same time values of target measures and indicators of regional programs shall correspond to measure values and Program indicators taking into account regional specifics.
The structure of target measures and indicators of the Program includes the following target measures and indicators which are based on the data obtained from subjects of the Russian Federation:
share of the subjects of the Russian Federation having the created and updated cards of availability of objects and services in total quantity of subjects of the Russian Federation;
share available to disabled people and other handicapped national groups of priority objects of social, transport and engineering infrastructure in total quantity of priority objects;
share of the subjects of the Russian Federation which created the system of complex rehabilitation and abilitation of disabled people, including handicapped children corresponding to the standard program of the subject of the Russian Federation in total quantity of subjects of the Russian Federation;
share of busy disabled people of working-age in the total number of disabled people of working-age in the Russian Federation.
For the purpose of decrease in possible negative effects and risk minimization in case of implementation of new approaches in system of medico-social examination when carrying out survey of the handicapped children and persons who received injury of health as a result of labor accidents and occupational diseases in 2017 - 2018 pilot projects were realized (in each direction separately):
on working off of approaches in case of approbation of the new classifications and criteria used when implementing medico-social examination of children in the Smolensk and Voronezh regions - in 2017:
on working off of approaches in case of approbation of the criteria used in case of determination of extent of loss of professional working capacity as a result of labor accidents and occupational diseases in Stavropol Krai and Sverdlovsk region - in 2018.
