About introduction of amendments to some acts of the Government of the Russian Federation concerning measurement and accounting of production volumes and turnover of bioethanol

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning measurement and accounting of production volumes and turnover of bioethanol.

2. To the Ministry of Finance of the Russian Federation:

a) approve procedure for equipment of the capital processing equipment for bioethanol production by automatic gages and accounting of concentration of denaturant substances in bioethanol;

b) approve the list of information transferred by automatic gages and accounting of concentration of denaturant substances in bioethanol in technical means of fixing and information transfer about production volume and turnover of ethyl alcohol, alcoholic and alcohol-containing products in single state information system of accounting of production volume and turnover of ethyl alcohol, alcoholic and alcohol-containing products.

3. To Federal Service for Alcohol Market Regulation to approve format of information transferred by automatic gages and accounting of concentration of denaturant substances in bioethanol in the technical means of fixing specified in the subitem "b" of Item 2 of this resolution.

4. This resolution becomes effective from the date of entry into force of the Federal Law of November 28, 2018 No. 448-FZ "About introduction of amendments to the Federal law "About State Regulation of Production and Turnover of Ethyl Alcohol, Alcoholic and Alcohol-containing Products and about Restriction of Consumption (Drinking) of Alcoholic Products" according to part 1 of article 2 of the specified Federal Law.

Changes which are made to acts of the Government of the Russian Federation concerning measurement and accounting of production volumes and turnover of bioethanol

1. In the order of the Government of the Russian Federation of June 28, 2006 No. 396 "About requirements to automatic gages and accounting of concentration and amount of anhydrous alcohol in finished goods, amount of finished goods" (The Russian Federation Code, 2006, No. 27, Art. 2941; 2007, No. 5, Art. 670; No. 43, Art. 5211; 2009, No. 4, Art. 505; 2010, No. 12, Art. 1335; 2012, No. 11, Art. 1299; 2014, No. 12, Art. 1298; 2016, No. 22, Art. 3210; 2017, No. 36, Art. 5437):

a) the name, Items 1 and 2 after the words "in finished goods" to add with words "denaturant substances in bioethanol,";

b) in requirements to automatic gages and accounting of concentration and the amount of anhydrous alcohol in finished goods, amount of finished goods approved by the specified resolution:

in Item 1:

add with the subitem "g" of the following content:

"3(2). The automatic gages specified in the subitem "g" of Item 1 of these requirements shall provide measurement and accounting of concentration of denaturant substances in bioethanol, percent.";

add with Item 5 (2) the following content:

"5(2). The automatic gages specified in the subitem "g" of Item 1 of these requirements shall provide:

a) measurement of concentration of denaturant substances in bioethanol with relative error of no more 2,5 of percent;

b) in case of stop of the automatic gage specified in the subitem "g" of Item 1 of these requirements, preserving results of measurement and accounting of the indicator specified in Item 3 (2) these requirements, with registration of time and date of stop and resumption of work of gage;

c) in case of stop of the automatic gage specified in the subitem "g" of Item 1 of these requirements, interruption in supply of bioethanol from the capital processing equipment or switching to the reserve automatic gage specified in the subitem "g" of Item 1 of these requirements in case of continuous supply of bioethanol from the specified equipment;

d) prevention of misstatement and counterfeit of results of measurements and accounting of the indicator specified in Item 3 (2) these requirements;

e) safety of the indicator specified in Item 3 (2) these requirements, in case of change or interruption in supply of energy from external sources within 5 years;

e) accounting of the measured indicators of concentration of denaturant substances in bioethanol at temperature of +20 °C";

add with Item 9 of the following content:

"9. The capital processing equipment for production of bioethanol in addition to the automatic gages specified in the subitem "an" of Item 1 of these requirements is equipped with the automatic gages specified in the subitem "g" of Item 1 of these requirements according to the procedure approved by the Ministry of Finance of the Russian Federation in the places providing opportunity and reliability of measurement and accounting of the indicators specified in Items 2 and 3 (2) these requirements, and also interruption in supply of bioethanol in case of stop of the automatic gages specified in subitems "an" and "g" of Item 1 of these requirements in case of impossibility of switching to reserve gage.".

In the Rules of functioning of Unified State Automated Information System of accounting of production volume and turnover of ethyl alcohol, alcoholic and alcohol-containing products approved by the order of the Government of the Russian Federation of December 29, 2015 No. 1459 "About functioning of Unified State Automated Information System of accounting of production volume and turnover of ethyl alcohol, alcoholic and alcohol-containing products" (The Russian Federation Code, 2016, No. 2, Art. 335; 2018, No. 14, Art. 1974):

a) in Item 6:

"8(1). The organizations using the capital processing equipment for bioethanol production in addition to information specified in Item 7 of these rules represent to unified information system with use of software and hardware information specified in subitems 5, 8 - 15, 17, 18, 20, 25, the 30 and 36 Item 6 of these rules.".

In requirements to technical means of fixing and information transfer about production volume and turnover of ethyl alcohol in Unified State Automated Information System of accounting of production volume and the turnover of ethyl alcohol, alcoholic and alcohol-containing products approved by the order of the Government of the Russian Federation of July 9, 2016 No. 650 "About requirements to technical means of fixing and information transfer about production volume and turnover of ethyl alcohol, alcoholic and alcohol-containing products in Unified State Automated Information System of accounting of production volume and turnover of ethyl alcohol, alcoholic and alcohol-containing products" (The Russian Federation Code, 2016, No. 29, the Art. 4826):

a) in Item 6:
