About introduction of amendments to some orders of the Minister of investments and development of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders of the Minister of investments and development of the Republic of Kazakhstan to which changes are made.

2. To provide to committee of industrial development and industrial safety of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

The list of some orders of the Minister of investments and development of the Republic of Kazakhstan to which changes are made

1. Bring in the order of the Minister of investments and development of the Republic of Kazakhstan of December 30, 2014 No. 350 "About approval of Rules of issue of permission to production of explosive works" (it is registered in the Register of state registration of regulatory legal acts for No. 10273, it is published on February 27, 2015 in information system of law of Ad_let) the following changes:

in Rules of issue of permission to production of the explosive works approved by the specified order:

"2. Permission to production of explosive works is issued by territorial subdivision of authorized body in the field of industrial safety (further - territorial subdivision) through the web portal of "the electronic government" www.egov.kz (further - the portal).";

exclude Item 3;

and 5 to state items 4 in the following edition:

"4. List of documents necessary for receipt of permission to production of explosive works:

1) the statement on issue of the permission to production of explosive works according to appendix 1 to these rules in electronic form certified by the EDS of uslugopoluchatel;

2) the electronic document containing the data with indication of calculations specifying conditions of safe accomplishment of explosive works, safe distances on scattering of pieces, action of shock air wave, effect of poisonous gases in case of explosion, seismic impact;

3) when carrying out explosive works:

on the land surface the electronic document containing site plan with drawing production site of explosive works, borders of the danger area, place of exposure of posts of protection of the danger area and the residential and factory buildings which are in its limits, constructions, railway tracks, highways, channels, pipelines, power lines is provided;

in underground conditions the electronic document containing the plan of mining operations with drawing production site of explosive works, borders of the danger area, place of exposure of posts of protection of the danger area, and also data on danger of the mine (the mine, object of exploration works) on gas and dust is provided;

4) when carrying out seismoprospecting works with use of explosive materials the electronic document containing schemes of profiles of works and protection of the danger area is provided.

5. The term of consideration of the submitted documents by territorial subdivision constitutes 5 (five) working days from the date of registration of a statement.";

"7. The bases for refusal in issue of permission to production of explosive works:

1) establishment of unauthenticity of the documents submitted by the applicant for receipt of permission to production of the explosive works, and (or) these (data) containing in them;

2) discrepancy of the applicant and (or) the provided materials, objects, supplied and the information necessary for receipt of permission to production of explosive works, to the requirements established by the Rules of ensuring industrial safety for hazardous production facilities approved by the order of the Minister of investments and development of the Republic of Kazakhstan of December 30, 2014 No. 343 (it is registered in the Register of state registration of regulatory legal acts for No. 10244);

3) concerning the applicant there is decision (sentence) of court on prohibition of activities or the separate types of activity requiring receipt of permission to production of explosive works which took legal effect.

In case of representation by the applicant of incomplete document package, stipulated in Item 4 these rules, the territorial subdivision within 2 (two) working days from the moment of their obtaining gives motivated refusal in further review of the statement.

In case of elimination by uslugopoluchatel of causes of failure in rendering the state service the uslugopoluchatel can address repeatedly for receipt of the state service according to the procedure, established by the legislation of the Republic of Kazakhstan.";

Bring in the order of the Minister of investments and development of the Republic of Kazakhstan of April 28, 2015 No. 511 "About approval of standards of the state services in the field of industrial safety" (it is registered in the Register of state registration of regulatory legal acts for No. 11363, it is published on July 9, 2015 in information system of law of Ad_let) the following changes:

to state the standard of the state service "Issue of Permissions to Production of Explosive Works" approved by the specified order in edition according to appendix 2 to this List;

in the standard of the state service "Approval of the Project Documentation on Construction, Expansion, Reconstruction, Upgrade, Preservation and Liquidation of Hazardous Production Facilities", the approved specified order:

2) of item 4 to state the subitem in the following edition:

"2) from the moment of delivery of documents in the State corporation for receipt of the state service through Committee of industrial development and industrial safety located in Nour-Sultan's city - 15 (fifteen) working days, from other regions - 22 (twenty two) working days.";

to be reworded as follows appendix 1 to the specified standard according to appendix 3 to this List.

3. Bring in the order of the Minister of investments and development of the Republic of Kazakhstan of April 30, 2015 No. 563 "About approval of standards of the state services in the field of the industry and export control" (it is registered in the Register of state registration of regulatory legal acts for No. 11636, it is published on August 5, 2015 in information system of law of Ad_let) the following changes:

to be reworded as follows the standard of the state service "Licensing for Implementation of Activities for Development, Production, Acquisition, Realization, Storage Explosive and Pyrotechnic (Except for Civil) Substances and Products with Their Application" approved by the specified order according to appendix 4 to this List;

in the standard of the state service "Licensing for Implementation of Activities for Operation of Mining and Chemical Productions", the approved specified order:
