About rules of implementation of assessment procedures of compliance of industrial output from the regulated area and application of national mark of conformity of SM

In pursuance of item 105 of the National program of the development of technical regulations approved by the Order of the Government No. 873 of July 30, 2004. (The official monitor of the Republic of Moldova, 2004, No. 132 137, of the Art. 1046), the Government DECIDES:

1. Approve:

Rules of implementation of assessment procedures of compliance of industrial output from the regulated area according to appendix No. 1; Rules of application of national mark of conformity of SM according to appendix No. 2.

2. To the industry bodies of the central public management and bodies equipped with functions of regulation in the respective area:

in the course of development of technical regulations to establish assessment procedures of compliance of industrial output according to this Resolution;

at development stage of technical regulations to approve with Service of standardization and metrology, as National authority on confirmation of conformity of products, drafts of technical regulations on the assessment procedures of compliance applied to industrial output from the regulated area.

3. To impose control over the implementation of this Resolution on the Ministry of Economy and Trade and Service of standardization and metrology which once in half-year will provide to the Government the relevant information.

Rules of implementation of assessment procedures of compliance of industrial output from the regulated area

I. General provisions

1. Rules of implementation of assessment procedures of compliance of industrial output from the regulated area (in dalneyshempravil) shall be applied by industry bodies of the central public management and bodies with functions of regulation (further - the regulating bodies), responsible for development of technical regulations to industrial output (in dalneyshemproduktion) both domestic, and import.

2. These rules establish procedures which should be performed in the course of assessment of conformity of products from the regulated area provided in part (1), Item (e) of part (2) and parts (4) Art. 19 of the Law No. 186-XV of April 24, 2003 on assessment of conformity of products.

3. The regulating bodies are established in technical regulations of assessment procedure of compliance of products (in dalneyshemmodul) according to these rules.

4. Process of assessment of conformity of products can differ from modules if to it oblige special requirements of one of technical regulations. These departures shall be limited and accurately proved in the corresponding technical regulation.

II. The used terminology

5. In these rules the terminology stated in the Law on assessment of conformity of products with the following amendments is used:

testing of type - the procedure by means of which the authorized body on certification establishes and confirms that the representative product sample meets requirements of the applied technical regulation;

the test certificate of type - the document issued by authorized body on certification, certifying that the type (representative sample) of the industrial output which is subject to assessment of conformity according to the technical regulation (which provides assessment of conformity of products on the module B "testing of type"), meets the requirements of this technical regulation;

manufacturer:

a) producer with the location in the Republic of Moldova or any other legal entity with the location in the Republic of Moldova representing the rights of producer by drawing on products of the name, commodity or other distinctive mark and also the legal entity recovering products;

b) the representative of producer with the location in the Republic of Moldova if the producer is not located in the territory of the Republic of Moldova;

c) the importer of products, if there is no representative of producer with the location in the Republic of Moldova;

d) other economic agents, elements of commercial chain or other method of distribution depending on activities which can do harm or influence safety of products;

technical documentation - the documentary results including the assessment of conformity of products issued by conformity assessment bodies which confirm products compliance to the registered requirements of technical regulations or national standards on the basis of which the declaration of conformity is issued. Technical documentation shall gather, constantly be updated and be stored by the manufacturer for ensuring traceability of the declaration of conformity of products which treats.

III. General criterions of the choice and use of modules

6. Main objective of assessment of conformity of products is assurance of consumers, the regulating bodies and bodies equipped with functions of supervision and control that products placed in the market meet the main requirements of the applied technical regulation.

7. Assessment of conformity of products is performed on blueprint stage and/or on production stage, before placement it in the market if technical regulations do not provide other measures in this plan.

8. For assessment of conformity of products at the stages provided in item 7 of these rules, the regulating bodies determine in technical regulations of possibility of use of modules or their combinations so that to provide the desirable level of safety of specific item.

9. The modules provided in the corresponding technical regulations depend on degree of complexity of product and the risk estimated in case of its use.

10. In case of establishment of modules which can be used by manufacturers the regulating bodies shall consider:
